    I fully resonate with gc_chahiye;169769 . People like GooblyWoobly are good for nothing. They have no right to pick on one of our distinguish ,well respected and an active member. The Rally have been quite successful and have made people think about our issue.
    Unfortunately, people like GooblyWoobly will also be benefited by the hard work of people like Franklin.

    "Those people???". What do you mean by that? These are people who are trying to get permanent residency on their own right, based on the skills they have honed for years. I don't like the condescending tone of your voice. What makes you better?

    ok, that really ticks me off. This post is probably going to get me a red splotch, but you should'nt have picked on Franklin:
    I think all the work that Franklin did in preparation for the Rally and then at the Rally itself makes it obvious that she is better than most of the IV members (me included) who could not make it to the Rally.

    If you dont like the condescending tone of the voice of someone who has worked hard for IVs goals, feel free to stop coming to IV and posting here. Honestly why should someone here care about whether you like the voice or not when the voice speaks the truth?

    Look at all the blog posts and pictures of the DC Rally before saying anything against any of the volunteers who worked at the rally. unlike the people who are "trying to get permanent residency on their own right" these dedicated bunch of IV volunteers are trying to get permanent residency soon for all of us. See the photos, the videos of the speeches and then talk.

    What Franklin meant by that post (I think) was that IV is much more than a discussion board for reports of who signed whose Fedex package and what was the timestamp of the package. Its very important that we all actively participate in getting IVs goals met. The rally was a big, for-the-first-time event, and still people seem more excited by tracking receipt notices, and the short-sightedness of it all has made many people ticked off. The turnout could easily have been higher (like someone said, see the lines to the doctors office for getting medicals done when the dates were current, and compare that with how many showed up at the rally).

    Knowing about future, or predicting what is to come, would help if we ought to do something in preparation; an advance action, such as nailing our windows shut if we are predicting a storm. That is not the case here. Therefore, sure shot 'prediction' is just to wait and see. It is only a few days away. If new cutoff date encompasses your PD, pray and check your email every day (or every hour or even minute), and hope for the best.

    I agree with you. Next week we will see the bulletin and then some people will be elated if their predictions come right and some will be disapointed. Again in 20 days we will start a new thread for Oct bulletin and FY 2010. I guess it is just that we are keeping alive our hopes.

    Unless somebody explains it to me in clear terms, it appears to be discriminatory.

    I am planning to write to Indian Ambassador (Meera Shankar) and complain about this less preferential treatment to Indian citizens by Indian government for OCI. I suggest you guys do the same.

I and my wife are Indian citizens with Indian passport who currently reside in ABCDEFG. While researching whether we should apply for PIO or OCI for our child, we found that OCI option is not available for our child. OCI in my opinion is a better option for our son than PIO because of the 180 days limitation on stay in India for PIO card holders and various other benefits.

    What I was appalled to find was that if I and my wife both held a non-Indian passport then our son is eligible to apply for OCI card. I find this policy to be very discriminatory to foreign born children of parents who both hold Indian passport and citizenship. I would like you and other policymakers to revise this policy and allow children born in foreign countries to be eligible to apply OCI card as long as any of their parent was or is an Indian citizen.

    ‘(5) The school will submit an annual report to the Secretary that includes updated information on the school with respect to student enrollment, student retention, graduation rates, passage rates on the National Council Licensure Examination for Registered Nurses, the number of graduates employed as nursing faculty or nursing care providers within 12 months of graduation, and the number of students who are accepted into graduate programs for further nursing education.

    ‘(6) The school will allow the Secretary to make on-site inspections, and will comply with the Secretary’s requests for information, to determine the extent to which the school is complying with the requirements of this section.

    ‘(f) Reports to Congress- The Secretary shall evaluate the results of grants under this section and submit to Congress--

    ‘(1) not later than 18 months after the date of the enactment of this section, an interim report on such results; and

    ‘(2) not later than September 30, 2012, a final report on such results.

    ‘(g) Application- An eligible school of nursing seeking a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information and assurances as the Secretary may require.

    ‘(h) Authorization of Appropriations- In addition to the amounts in the Domestic Nursing Enhancement Account, established under section 833, there are authorized to be appropriated such sums as may be necessary to carry out this section.

    ‘SEC. 833. DOMESTIC NURSING ENHANCEMENT ACCOUNT.

    ‘(a) Establishment- There is established in the general fund of the Treasury a separate account which shall be known as the ‘Domestic Nursing Enhancement Account’. Notwithstanding any other provision of law, there shall be deposited as offsetting receipts into the account all fees collected under section 106(f) of the American Competitiveness in the Twenty-first Century Act of 2000 (Public Law 106-313; 8 U.S.C. 1153 note). Nothing in this subsection shall prohibit the depositing of other moneys into the account established under this section.

    ‘(b) Use of Funds- Amounts collected under section 106(f) of the American Competitiveness in the Twenty-first Century Act of 2000, and deposited into the account established under subsection (a) shall be used by the Secretary of Health and Human Services to carry out section 832. Such amounts shall be available for obligation only to the extent, and in the amount, provided in advance in appropriations Acts. Such amounts are authorized to remain available until expended.’
    (c) Global Health Care Cooperation-

    (1) IN GENERAL- Title III of the Immigration and Nationality Act (8 U.S.C. 1401 et seq.) is amended by inserting after section 317 the following:

    ‘SEC. 317A. TEMPORARY ABSENCE OF ALIENS PROVIDING HEALTH CARE IN DEVELOPING COUNTRIES.

    ‘(a) In General- Notwithstanding any other provision of this Act, the Secretary of Homeland Security shall allow an eligible alien and the spouse or child of such alien to reside in a candidate country during the period that the eligible alien is working as a physician or other health care worker in a candidate country. During such period the eligible alien and such spouse or child shall be considered--

    ‘(1) to be physically present and residing in the United States for purposes of naturalization under section 316(a); and

    ‘(2) to meet the continuous residency requirements under section 316(b).

    ‘(b) Definitions- In this section:

    ‘(1) CANDIDATE COUNTRY- The term ‘candidate country’ means a country that the Secretary of State determines to be--

    ‘(A) eligible for assistance from the International Development Association, in which the per capita income of the country is equal to or less than the historical ceiling of the International Development Association for the applicable fiscal year, as defined by the International Bank for Reconstruction and Development;

    ‘(B) classified as a lower middle income country in the then most recent edition of the World Development Report for Reconstruction and Development published by the International Bank for Reconstruction and Development and having an income greater than the historical ceiling for International Development Association eligibility for the applicable fiscal year; or

    My advice to most people who do not perfectly fit into eb2 is to do the eb3 petition first (which is guaranteed to be approved). Get your place in line for the greencard.

    If it is taking too long then you can try an eb2 later; if it gets approved then you will get the old priority date. If it doesn't; well you can say you tried but you didn't lost your place in line for the greencard because you still have the old eb3 in place.

    However, if your cases is not clear for eb2 and you try this first and it gets denied then you will lose valuable time in line for the greencard because you have to start from the beginning.

    Since, last august DOL has become weird with even approving eb3 labors. Generally, attornies will put language in the eta 9089 that they will accept three years of experience for each year of bachelors degree missing (this is in line with education evaluators and uscis).

    However, this isn't the same criteria DOL uses. They will state that if a person doesn't have a degree then you are willing to accept 12 years of experience which is excessive and they deny the labor (before they were giving hard time to eb2 but not it is eb3 that they are after). So now we have an issue that DOL criteria is different then uscis critera. You use dol criteria, labor gets approved but 140 gets denied. Use uscis criteria and labor gets denied. Now, everyone has to adjust and file eb3 labors as skilled workers and only require two years of experience (it's getting more and more messy)


    The 3 year experience = 1 year education towards degree is used for H1 NOT for GC. It has never been for GC.

    For EB3 GC, there is a classification for skilled workers which do not require a degree.

    What a jerk your desi employer is. It makes me so angry that these scumbags are getting away doing these things.

    First things first - deliver the baby. Take some of the suggestions given here by other members regarding insurance.

    Once all this is done sue the hell out of your desi employer. There really isn't anything (I guess) you can do about your client. But you can definitely take your desi employer to court for terminating your employment. These guys deserve to pay a hefty fine and lose their business license!

    Yesterday, I was told by the client that my project is going to end by this month end i.e Apr 30. Actually it was supposed to go for the next 2 years. I am currently in the project working for the project. They said the lay off was becoz of budget issues. But I see I am the only one that is target in this lay-off. I am working with the same client for the past 3 years. The lay off news was really shocking and devastating.
    I am currently 9 months pregnant. As the client did that to me, I thought that atleast I might have some options with my current employer. My employer is a desi consultancy. I never been on Bench for single day for the Past 6 years ( Day 1 that I entered into US to till now).
    When I spoke to my employer today he gave me a termination letter stating that my project end date will be my last date with them. It was more shocking. I will be on maternity leave anytime in month of may depending on the delivery. I don't see any possible options that any client can take me into project when I am in 9th month of pregnancy.
    As my husband is doing consulting, I filed the green card thru this employer, 485 is pending more than 180 days, 140 approved in EB2 category. We paid all the attorney fees and filing fees from our pocket. We spent nearly $10,000 for the GC process. My husband was on bench for the past 2 months. He got a job on EAD which is going to start next week.
    1. I see that my employer is terminating me immediately because he can avoid maternity expenses. I told him that I will take 3 months FMLA for unpaid maternity leave from Apr 30th. And look for the Job immediately after delivery and get into the Job. But still he is telling he won't provide me that time. Maintaining the status is very important for me as me and my husband depends on the EAD.
    2.My medical insurance is with my employer, If I get laid off in this critical situation, I won't be having insurance. We can't afford the delivery expenses without insurance.
    3. Even though my husband will get insurance with the new company, We are not sure that company will cover the pre-existing pregnancy that is in final stages.
    4. And also not sure that the insurance will be under the network of OBG/YN and the hospital I registered for delivery. His job is in different state but he will find out the options once he starts his job next week.
    5. Does anyone think that my employer is discriminating the law? He is terminating me immediately becoz I am pregnant.
    I am not sure whether he is doing the right thing but the situation I am in is the worst situation I ever expected of. Its lot of stress on me and my baby. We are unable to sleep for hour with all the tensions ahead. My husband's job is dependent on my valid status. If something screw up we both be in very bad situation. I really don't want any one in my situation.
    Please help me, if any one know any options where I can maintain my status during the pregnancy and maternity leave, Please tell me.

    All NVC documents take 3-4 weeks before you get them. NVC sent Biographic forms data to my lawyer's office on July 2nd and they reached my lawyer's office last Friday. So it was approx. 3 weeks.

    Trust me my friend, I have seen it happen all the time, from large Telecom firm to Govt., its always there, most of the consultants just doesn't come to know about it, but the cut for the managers is there in some form, almost always. Why do each manager has a specific vendor through whom they want to hire most of the time? What else is the reason for the client to pay the consulting company $180/hr but they won't give 'valueablehurdle' anything more than $50-60/hr?

    On a different note, now that NSG approved the waiver, most desi uncles, some of them are also owners of desi consulting companies will claim that they are the father of Nuclear deal. These bastards (sorry for my french) always oppose any GC fix and they tell their favorite congressman/senator (each has atleast one favorite politician for whom they do fund raisers) that gc backlog is not an important issue for the community. India Abroad, Times of India, rediff and other desi portals/newspapers will write 'Oliver North' style stories about these desi uncles knowing well that companies like GE etc put their weight behind the deal as it will create commerce to commerce over $20 billion/yr. But desi uncles/orgs will not stop claiming to be the father of nuclear deal. The fact is, most of these desi uncles made noise not because they wanted to do something for their country of birth, they are doing it because they think that if the nuclear deal passes, they can play middle man for US companies to sell the technology/material to Indian companies/govt. Most of the so called 'united voice of Indian-Americans on the Hill' organization's goal is to make big bucks by playing 'middle man' for companies wanting to sell technology to India. And as always, just as 'valuablehurdle''s client (paying $180/hr) Indian govt. will pay double the cost. These desi companies have squeezed blood of people waiting for gc, but now they think its time to move on to play big game with the big boys. These desi uncles/orgs are going nuclear.... time for Rediff and India Abroad to play Oliver North. Sometimes the line between capitalism and cycle of corruption is extremely blur. The problem is, these desi uncles/orgs claim to be representatives of entire Indian-American community, sometimes the entire immigrant community. They don't know more than 100 people, but they claim to be the leaders of all 2.5 million indian americans. Sorry for my french, but these bastards are the owners of desi consulting firms who have done a lot of harm to many communities.

    I think IV should compete openly with USINPAC which realistically doesnt have any grassroots support.

    I agree, you will be competing with all the illegals. But.....

    1. How likely are they to file their apps on the first allowable day that USCIS will accept the applications? Not very. Most of us know what's going on and will be ready to send in our apps first. Ofcourse if some EB based guy is pottering around instead of moving fast, thats his problem.

    2. How many illegals can afford the high priced attorneys? Most of these poor guys dont know to speak, read or write english, forget about filing out USCIS forms.

    3. How many illegals maintain perfect records of their time and can recreate a paper trail of the time they spent in the US. I certainly can and most legal wannabe immigrants can definitely prove the time they have been here (paystubs, utility bills, credit card statements, bank statements, etc.)

    The point I am making is - this is the best option I have seen in a long time. Even the stupid point based system had its drawbacks. This is unconditional. It will get vast support from the hispanic community also. The UK has the same thing. Be on a work permit for 5 years and then you are eligible to apply for Permanent Residency. I believe there is also some clause in the UK system that states that you have to have been in the UK illegally for 10 years as against 5 years for a legal immigrant. I'm sure setting the illegal bar at 10 years and legal bar at 5 would be acceptable for most people.

    If we reapply under this section, we will be competing with the massive illegal-to-AOS guys based on our Receipt date for adjudication.

    Ladies & Gentlemen
    I can understand the emotion and commotion among my fellow beings who are stuck with BECs. I waited agonizing 5 years to get my labor cleared. We all clearly understand what are you guys going through.

    But the thing is that Labor Certification issues are taken care with PERM implementation. Also the administration set up 2 BECs to take care of them back logs. Now the issue is purely administrative and not law making. Also BECs made it clear that by Oct 2007 all the back logs will be cleared.

    Right now big things are happening in the immigration law making. So I think we should concentrate to get the best out of it and achieve our goals on the Green Card Visa issues. As Tom Tancredo is going to fight with teeth and nail against Immi Bills, we have to do the same.

    There are many others issues we can lobby for such as

    1) Starting H1B stamping inside the US again( Which was stopped in 2005)
    2) Allow H1B spouses to work. etc etc


    But I believe our priority for the time being should be Retrogression. I request all of you to use this thread for finding a person to testify.

    I came to us 02 june, bought home in 03 August. I applied for GC in Sept 2006. GC has nothing to do with house. If you can get a loan and buy in a decent locality buying any time is beter than renting.
