what do you mean? Who are these rest who will go into a new merit-based system? Even if you count only the number of people here who have approved I-140, that alone is enough to delay us for a very long time even with the current quota (140K). Otherwise we would not have had retrogression.
It won't be so terrible for those who filed in 2006/07 to wait another 2-3 years. Plus poeple like me (PD sep 2004) will file in the new Point system reducing backlog for others.

If I switch jobs by doing H1B visa transfer and my new employer picks up the green card process from the EAD stage, does my new employer have to be located in the same city as the one mentioned in my PERM labor application of my current employer. The reason I ask is because my PERM application says my current job location is in Town X, State Y and I wondering if I have to stick to Town X, State Y when I find a new job or if I'm free to work anywhere in the US.

I believe any efforts to make USICIS accept all applications can be couter productive. You can have some people getting stuck for sure for many years before they get their green cards. also since new fees kick in on July 30th, you will have to pay for the EAD,AP.
The law-suit can benefit only a few of us, so why is IV behind this.
Can the core members comment on this.
I tihnk all these efforts do not define a common cause right now.

This is just to let you all know that my I-140 has been approved.
As a response to an RFE, following evidences were submitted:
1) Transcripts for all the years (BSc and MCA)
2) List of courses completed (Just a list without any course by course evaluations)
3) Education Evaluation Report (Re-submitted)

Forgot to mention: it took so long on my FOIA because all the documents had been archived into National Archives. If your notice is still in USCIS, it'll be much faster.

Those who are using EAD have to use AP, as H1 is no longer valid!! This whole correct/incorrect thing is useless as these rules were made when AOS processing time was less than a year. People with older PD who dont expect to get GC in coming 2-3 years and already working using EAD have to use AP. This was even the case when H1 used to be valid for six year only and once someone got EAD/AP they were using it happily during 2004-2005.

lobby the U.S. government. Most of the members are foreign nationals on
H-1B visas. They want the U.S. government to issue more green cards so that
H-1Bs can gain permanent residency. Immigration Voice seems to be a single
issue advocacy group because they don't mention H-1B, however, they are
supporting the Specter bill in the Senate that has a massive increase in
Green Card visas as well as H-1B and a new visa called F-4.
H-1B is a temporary visa that can last for up to six years, but due to a
new 7th Year Extension rule visas can be renewed indefinitely until the
visa holder obtains a green card. As long as the green card application is
in the cue the H-1B can stay. There are limits to the number of green cards
issued per year, and that is what IV wants to change. As Dr. Philip Martin
from UCDavis wrote, "There Is Nothing More Permanent Than Temporary Foreign

the article is not objective, and therefore should be considered lousy

for H-1B visa holders goes totally unchallenged:
"This is a sympathetic story," said Nick Maduros, a lobbyist

I would sympathize with you if you can do the following:
1) Show me that no more than 90% of the population experience depression tendencies at some point in their life.
among EB applicants I believe it would be 99%. So are you alone? I guess not:D:D
Things you could do: Try watching talks with the Dalai Lama (available on youtube). Read books on Gandhi. Increase frequency of quiteness / meditation. Watch atleast one comedy show per day. Visit/remember the sick/disabled/poor or other less fortunate people than you.
Things you could avoid: Heavy drinking. Watching news, movies/shows which are high tension. Most important is not to fight the emotions/thoughts that you consider are destructive. Allow them to come and go. Just watch them come and go........
What you consider as "Good luck" can happen to you in the fraction of a seccond, however, it will never happen if you keep on defining yourself as unlucky. So focus on the good things you have now and refrain from comparing to "what you should be having or are worthy of having". :D:D:D:D

This rule of having at least one parent Indian citizen is in existence since atleast 2006. Just search around. I also know this as one of my close friend's OCI application was his kid was rejected based on this rule more than a couple of years ago !
You are correct. The rules must have changed recently. I wonder what made them make that change, Now children of US citizens (who were once Indian citizens) have an advantage over children who has both parents as Indian citizens. Weird.. isn't it?

So, what are the options for EB3-I? It appears that porting to EB2 will be more difficult moving forward due to difficulties in getting PERM approved especially for IT professions.
If the recapture of unused visas does happen, what is the estimate on how much EB3I would move?

I am suprprised if IV is working towards abiltiy to file 485 and hard country limit...Just want to know how IV is working towards these 2 items...
If any of these two wont show out in coming bill,..then I would say goodbye to IV..because all other items in bill were there without IV;s interaction....
Can somebody calrify if these options will anyway include in this bill..by means of ammendements...
We have been fighting very hard to introduce a number of amendments including the ability to file I-485 and also to remove the country limit. We have spoken to a number of senators in this regard.
While we have no guarantees that they will be introduced, one thing I can guarantee, we will fight as hard as we possibly could.

Send email to who ? Can you pls describe in detail what email they need to send and what reason they need to put in. My local office always says NSC is processing July cases so you should have it soon, but that "soon" has never happened. It is 160+ days since I applied.
