Not quite, as I understand it, if your PD is not current, your AOS will continue processing and will eventually get to a "approved, pending visa number" state. You can pretty much be in this state for some time, and then when PD does become current (as happened from May through July this year with the significant shift in PDs in the bulletins) there will be a massive approval rate of all those pending applications.
USCIS doesn't stop the application process just because your PD is no longer current
This is how USCIS got through 60k unused visas in a staggeringly short time. There were a LOT of applications that were ready to go, they were just waiting for those numbers. USCIS didn't all of a suddenly quadruple their efficiency in processing :)
I think that they did it one time mainly to use all the unused visas. I do not know whether they will continue in the same fashion of such pre-processing in future too. If not, then that is going to be a bigger wait considering the number of applications received at their end after the July visa bulletin.
Do you think that they have enough resources available to process all?

I filed an apeal for my first PERM too and preparing to file another one (through another company - you can't file another PERM via the same company while your first PERM is in appeal). Your's is there for longer than mine. I heard 4 to 6 months would be the time. Please let us know when and how yours is resolved.

After receiving your I-485 USCIS conducts the following background Checks:
IBIS - Interagency Border Inspection System name check
FBI - FBI Fingerprint Check
FBI - FBI Name Check
IDENT - Automated Biometric Identification System
Other biometric checks - For some cases, USCIS itself conduct comparisons of photograph, finger prints and signatures stored in paper application with ISRS.
You have to clear all these checks (some of them has expiry as well) when your PD becomes current.
Till then keep renewing your EAD / AP. [I think this is the milking cow for USCIS :) ]

I revisited this thread today and saw several heartwrenching stories of some of our IV members. One way for IV to help you is through letting your situation be known to others via media. We have a few opportunities and if you are interested please send an email to himanshu at immigrationvoice.org. Do not PM me since my PM box gets filled very often.
It will not only help all of us generate awareness about our plight to american public, lawmakers too will be influenced by the magnitude of problems we face while waiting patiently in line for several years. I feel media is a great tool and we can use it very effectively when we all can get our message across in the world outside of this forum. Once we get IV members ready to volunteer for such interviews and to talk about their plight, IV will try its best to get their voices heard.
It will not only help all of us generate awareness about our plight to american public, lawmakers too will be influenced by the magnitude of problems we face while waiting patiently in line for several years. I feel media is a great tool and we can use it very effectively when we all can get our message across in the world outside of this forum. Here's what i can add - my ead too has been pending for 4 months now.!
I went in for a second infopass this morning (14 degrees F - 5 block walk from where i parked.! I almost had a facial nerve plasy from the biting cold!). Anyway after looking into her system - the IO told me that the A # on my 485 receipt has not been linked to the 765 & 131 applications.! So she was busy typing so stuf for like 2-3 mins and then said that since my 485 was filed intially and the 765 & 131 were sent in after a month or so - hence this generated a miscommunication between both these sets of applications.
So since the A# is not tagged to the EAD & AP applications in thier system - i guess it seems like i have not filed for the EAD & AP at all.! Makes sense.?? I guess..!!
Anyway she was kinda nice....she was like... don't worry...etc..the last thing she said after i said thanks was "good luck - hang in there"..Imagine that coming from USCIS IO..!! Lets wait and see now if at all there is any progress on my case.!
My wife and I had the same exact experience at a local office. My 485 was filed on July 12 and my EAD/AP were filed on Aug 9. We went to the local office (2nd time) last week. We called USCIS before going there and were told to go there and then they would call the main center (NE) to "initiate" an interim EAD processing. Yet when we went there, the supposed to be supervisor told me that I was misinformed. She started bi*****g about how the USCIS customer service has been outsourced to a 3rd party company and they only read from old documents thus misleading people , blah, blah, blah...
Another officer who called my wife called NE center and gave them the A number and it did not show up. Reason: Although my 485 and EAD/AP were all sent to NE, for some reason, they shipped my 485 to TX thus leaving my EAD/AP without an A number. Their system is so screwed that they don't even have an option to amend that and put a note on my EAD/AP saying that the 485 is sitting in TX. Bottomline: We were sent back. We again called the USCIS and have initiated a "service request" to expedite. We will have to wait and see where it takes us. In the meantime, my wife is in a limbo as she is getting interview calls but is no sure what to tell them as her H1 is about to expire.

The reason why most people end up with such situations is that the employers don�t file for H1 extensions on time. Though the law allows filing of H1 extensions upto 6 months before its expiry, most employers file for extensions only at the last moment. It�s advisable to go for premium processing in such cases, so as to get the approvals on time.
You can apply H1 extn earlier than 6 months. Mine was expiring in Sep 07. I applied on Jan 5th 07. Got 7-8-9 year extn in April.

I guess using our degrees to pass on a message is a fool-proof idea. That can immediately catch on with media like flowers did. If not stoppers, we can write our message in bold colors on the degrees.

Such a move do not bring much complaints from anti-immi groups. But this move will reduce the noise from people who have not yet filed for 485s. May be after getting EAD all those people will invest more in America.
This is maximum bang for the immigration buck from the USCIS/DOS point of view.
Ron says it will be current for a "brief" period. (similar to july 2007 fiasco ?)
It will be a good opportunity for people waiting to file 485. For people already in the queue, it may not make that much difference.

The instructions say this "NOTE: Please spell out U.S. Department of Homeland Security; do not use the initials "USDHS" or "DHS.""
You have written the most important words, atleast u did not abbreviate!
Also remember there is NO OTHER "department of homeland security" in the world. Check has gone to USCIS office. They know u mean US, even if u did not write it.
So I am confident that their banks will cash your check. Keep a watch on your bank online. Texas cashed our checks in 7 days and also sent receipt. Dont know how Nebraska is doing. Call USCIS in 1-2 weeks if they did not cash checks.
Worst case they will send the application back. You can then quickly fix the check and resend application. Hopefully if you have applied in time, then a delay of 1-2 weeks does not matter.

This question has been bugging the HECK out of me as well. I mean the only way this makes sense is if 245(i) + EB3 for India >> 245(i) for Mexico. Now from all that i have read/heard/seen, it seems like 245(i) is the major hurdle. Then how is it that EB3 India is stuck and everyone else is moving? The above equation must mean that there is a SIGNIFICANT number of 245(i) cases from India as well. Any thoughts anyone? :confused:
There is a general assumption that there not many 245(i) cases from Indian nationals. In reality, there are many people from India working in Grocery stores to Gas pumps applied for 245(i) during that period.
As USCIS started looking in to the continuation of services, couple of my friends who did not worked more than 180 days land into trouble during their I-485 denied. Their attorney suggested them to take the same 245(i) route and many such tech workers are also might have fall into this category.
I believe there may be several such 245(i) cases from India and we will be able to know the exact number of cases one and only if DOL / USCIS publish the number of cases at their end. Till then we have to live with our own prediction similar to that of visa bulletin.
This also gives a good idea for someone to start a predication thread for 'Number of 245(i) cases for India' :)

Also, what forms do you need to apply for H4 extension? can you have 2 valid visas at the same time say B1/B2 and H4?
