Is there any information on what an "easy" case is?
I haven't seen one so far!
It appears, easy case is a subjective decision made by a USCIS worker based on amount of time needed for the case.
It is a job scheduler that schedules the shortest job first with a subjective estimate of the time needed to process the case.

If you have Citibank account in india, ask your parents or friends to deposit money into that account. Then you can withdraw money in dollars in citibank ATMs at 7-11 here in US since, Thats what i do.

This meet is a great way to meet with fellow IV-ersin the tri-state area. Hope everyone who are in the vicinity of maya's lounge can make it. It sure is going to be fun and a great way to make new friends with similar issues (GC).

Have we considered putting up ads in Indian/Chinese community
magazines like India Currents, Siliconeer ? It might work out to be
cheaper than online ads on Sulekha. I presume these magazines have
pretty good readership since most of them are distributed for free.
Also, it would give us good visibility if we could get one of these magazines
to do an article on EB retrogression and mention IV efforts as part of it.

my labor has to be pending 365 days or have an 140 approved to extend. so if pp goes away for 140 then my only option to stay in status is EAD. Also I am not in IT so patni, tcs etc...is out of question.
If you had a approved 140, you'd get 3-year extensions. If it is pending, you could still get 1 year extension.
While I'm sure about this rule, you should check with the attorney.

Gandhiji has a kind of magic, which can't describe in words. I don't agree with a logic that people wanted good leader and they accepted him without question.
At that time, returning British viceroy always advising incoming viceroy not to personally meet Mr. Gandhi, otherwise he will emotionally trap you. He had real magical power.
Gandhi was a great man no questions, he had the all the intellectual, personal and spiritual qualities required to lead the nation. With those qualities alone, he could not have convenced more than half a dozen people. The nation at that time was in need of a leader like him. When they found the right man, the followed without questions.

One big missing piece in your analysis - Country quota.
As per your analysis, there are around 125K pending cases. If there is no spill over (that is the case this year and that will be the case for the coming years as per State dept.), then EB3-I or EB2-I gets only 2700 visas per year.
Now, please redo your math and you can easily see that the current retrogress might look like there is hardly any retrogression.
country quota will not impact I and C once the dates are current for ROW due to the spillover. If the number of applications pending is, say 100K and 95 K out of that are I and C. And assume 10K applications from ROW are add to the queue, what I am saying is all 110K will be cleared by end of the fiscal year.

I personally think that 6 month rule-of-thumb is nonsense.
AC21 clearly states you can switch employers 6 months after your green card application has been pending. On what legal basis could USCIS then come back and deny citizenship to anyone for switching employers too soon after getting their green card?
I'd really be interested to hear if someone has specific knowledge of a case where someone had their citizenship denied due to switching companies too soon after getting their green card.
Refer http://www.murthy.com/pr_thngs.html and search for the following
"It is also important to understand that the green card approval will be reviewed at the time of the naturalization interview. For employment-based cases, this means inquiries into how long the individual worked for the employer after obtaining the green card. If the period is extremely short, there may be questions about the bona fide nature of the green card process."
As "a_yaja" said, "AC21 applies only if your GC has not been approved. You cannont invoke AC21 after your GC has been approved."

I apologize if I said something wrong, but I strong believe I didn't. We need the OLD IV to do something big and practical, that's the only way, you will attract new members. I respect, all you have done, but I guess its time for you and other core members to plan something real and in open. We don't want to be informed about close door talks, we want action.

If there is unity, and all of us walk out with all our money, this would definitely get the attention of the lawmakers.
I suggested the same action last year. Right now, waiting for 485 (EB 2 LC took close to 6 years) - but I feel if 20-30K of us left (and take our money with us too, don't leave it here to work for this country) because we are being screwed by the stupid immigration laws, that will have a bigger impact in changing the laws than any lobbying effort possibly would.

I also got a RFE from nabreska , but finally got approved.
Same Bsc + MCA
I think , they do approve , just waste some time and money of everyone , before they approve.
That's encouraging! I have lot more hurdles than the Bsc + MCA issue. My employer had filed my GC in EB3 and is now willing to refile under EB2, since I was promoted to a senior role. The company attorney though is hesitating to file under EB2, his reasons are as follows:
1. 3 + 3 degree will not be approved under EB2. ( This is in response to my question about using my Bsc + MCA. My current role requires Master's degree or Bachelor's + exp. I do not want to use the experience (9 years) gained from my current employer. So I suggested we could use my master's degree + 4+ years of experience that I have before joining my current employer. )
2. Attorney thinks Software Engineer role (EB3) and Principal Software Engineer role (EB2) are not 50% different. I agree that it is not 50% different. But my question to him was - "Does it (new role) have to be 50% different even if I don;t use the experience gained from the current employer". Haven't heard back from him yet.

If this is true, it is really scary for people who are solely on EAD and no longer hold H1 status.
It's true, here is the link:

Well, I don't think I am at the end of line of 300,000 people. There must be lots and lots of people whose priority date is after April 2004 might have filed. This includes 2004, 2005, 2006 and 2007.
So I think 3 years is intelligent guess. But who knows I am just trying to make myself happy and trying to stay positive.
Also remeber there is a big number of LC BACKLOG cases, all with PD prior to 2005, that will be cleared by end of next month and would get to apply AOS some time soon.

[QUOTE=oldschool;147268]Are there any implications of leaving my employer now who sponsored me for GC? I got my GC on the first week of July. I plan to leave on the 1st week of September. Thank you very much.
You can leave even before your GC comes through by invoking AC21.
Frankly, I think the 6 month period is propaganda.
its my opinion and not legal opinion.
If you already used AC21 then? how would you explain to IO. I think what matters is your explanation and there should be no reason for denial of citizenship if you are able to explain.
cheers

As you can see from the Science article how difficult it will be to pass anything in the lameduck session. IV cannot do it alone without the help of all its members. Pls send mails to the editors of these magazines highlighting our issues and mentioning IV.
Pls post a confirmation on this thread that you have emailed the editor so that we know how many people sent emails. We need more participation from our members on such tasks in order to highlight our issues in the media. We find a lot of people posting messages about what we ought to be doing on the forum but only a handful actually do when we urge members to do. Any efforts to get attention from media to highlight our isues will be highly appreciated.

Yes but in Canada you will breathe clean air and drink clean water. You will have electricity 24 hrs a day and water 24 hrs a day. You wont find trash on the street and you wont be considered second class citizen if you arent SC/ST/OBC due to reservations. You woint have to give "donations" to get your kid admitted to Class 1. You wont face a system where a simple court case drags to 50 yrs or a case where doctor will not treat if before police does a "Panchnama" if you had an accident. You wont have to bribe everyone from minucipality to police to start a business.
Canada is already worse than India (atleast for IT sector). Hard to find jobs. Salaries are 75-80% of corresponding US jobs. And Candian $ is also cheaper (though catching up with USD).
