Yes, my Bachelor and Master's are in same/related discipline. I think you can use any education evaluator but make sure that are aware of Indian Education System. We have responded to the RFE. I will post the outcome for the benefit for all.

    Thank you very much!

    Logiclife,

Below is a recent story on travel on AP. I see many posts where folks are asked at POE by CBP offcials if they are still working from the petitioning employer.

Can you advise why CBP officers are even asking to several AP travellers if they are still working for the GC petitioning employer?

My situation: I am not working for the petitioning employer anymore and dont have an attorney as well and so need to get prepared to answer the CBP officails why i am not working for the petitioning employer at POE and you know, CBP officails dont understand AC-21 etc

    Please read below.

    My story...

    --------------------------------------------------------------------------------

I feel like sharing mine as mine is the most horrifying.

After scanning my expired H-1 and reviewing my AP, I was sent to "secondary check" where they ask you few questions and verify the authenticity of the documents.

I was asked if I work for the original petitioner? I said no, currently I work for another employer. I showed them my H-1 approval (I-797). The CBP officer was about to stamp my AP and he was told by a "side-kick" that I have to be employed at the same employer otherwise what is the guarantee that I will go and work for that employer. I calmly explained the fact that GC is for future employment and per AC-21 I can change after 180 days. The CBP officer said wait here and then he walked in to some room. He returned after 20 minutes and I was told to go and wait and other officer will take care of the situation. From one officer to another and another to another. I was asked if I am trying to do any fraud. Finally after 5 hours of questioning, I somewhat lost my temper and told them that either send me back to home country or let me go. So after making few phone calls, they concluded that they don't have access to all my records on their system and it is very gray situation so the office in downtown will take care of the situation.
They took my passport, AP, H-1 approval letter and told me to go to downtown office after 30 days and they will decide what to do.
My lawyer was kind enough to accompany me as she was also upset with their act. When I went there, we were rudely asked completely out of place questions which had nothing to do with whose employer I work for or anything and I was told that "I" confused CBP officers by showing AP and H-1 and I should have just shown them AP and everything would have been fine. I am the culprit and I choose to get myself in trouble.....
I said nothing and just saw him stamping my AP and walked out. I don't know what to conclude out of it. But A friend of mine had valid H-1 and AP and they asked "has any one applied for AOS for you?" he said yes. They asked him to show 485 and AP if he had and same story,,,one officer to another and another to another which lasted for 3 hours and finally his H-1 was stamped.
So, again I am not sure what they are trying to get out of this but this is happening at the airport. I am not trying to scare anyone but just be prepared to deal with such situation and keep in mind that you are not doing any fraud and keep the honesty.

Mindblowing. Do people really believe the Oct 2007 deadline? Haven't we seen many deadlines come and go? This is extrememly unfair to those stuck at BEC; don't go around spreading this impression that the BEC issue has been resolved.

If indeed the majority at IV believe that BEC is not a problem, then it would not be a stated goal of IV. Let me repeat, so long as it is listed as a goal, it is the moral responsibility of all of to support and work towards resolving the issue.

This is important. Don't just pretend to support IV and play down what matters to others. Your must support all the goals we have at IV and not pick and choose what you like.

Also please don't repeat the false logic of "labor certs will be taken care of by PERM." If that is the case why would we at IV have BEC resolution as a goal? The least you can do it not try to dilute the seriousness of the BEC issue, even if you don't care much about the problem.

    anai,

Resolving the BEC problem is definitely one of IV's main goals. There is no way I will believe in DOL's claim of clearing all the back logs by Oct 2007.

IV has had a number of discussions with lawmakers and administrative officials, first to understand the issue and next to solve it. From our discussions, it has become clear that the lawmakers still view this as a temporary problem and are not willing to legislate for getting any more into this. Never the less all of them did agree that the efficiency of the BECs left a lot to be desired. So we were working a bi-partisan coalition of lawmakers who were willing to put pressure on DOL and USCIS on the need for efficiency and transparency.

All of this was before the crazy pace with which the Comprehensive Immigration Bill began to move. We do have to realize that this bill is a golden chance to have our provisions in place and we have less than 2 weeks to works on it. Frist wants either of the Immigration Bills to be passed before Apr 7th. If we do miss out on our goals in this bill and this bill gets passed, we will not be able to revisit our issues for a long time. So right now a lot of the attention is being given to it. This does not mean that BEC is forgotten. Hope you do understand.

    Dear friends,

As many of you are well aware, it has been about 50 days since IV was started. Since then, we have come a long way in setting up a platform to voice our concerns. We also established an able alliance with QGA to have a powerful channel for our voices to be heard on the hill.

    It is now game time!!

Two very significant legislative vehicles, namely the PACE bill and Comprehensive immigration bill are right on the corner. PACE is scheduled for discussion end of Feb, and the comprehensive Immigration bill beginning of March. In this dynamic legislative climate, it if very difficult to predict which of these potential vehicles could bear fruit, or even predict the timeframes accurately. IVs strategy is to pursue both the bills and push for our goals to be on them.

We are in immediate need of funds for that very purpose. We are seriously low on gas right now, for the journey ahead that we are only just starting on. We have only raised $30,000 in the last 50 days; even more alarming, fund raising has gone down drastically in the last 2 weeks. At our current burn rate, we will be out of money in a month or so, just when we expect the bills to come up for discussion on the Senate floors. As you can expect and appreciate, there is a cost for achieving anything politically. IV has already demonstrated a great deal of leadership and persistence to work on retrogression relief and labor backlog elimination. Many IV members will start making trips to DC in the coming weeks to meet lawmakers at the hill. We need your help NOW!

Members that have not yet contribute money, please do so TODAY! And members that have already contributed please consider another contribution. We need all hands on deck. Also pass on the message of the immediate need of funds to your friends.

If you have questions, as always, please send a note to info@immigrationvoice.org

    TSC 485 --> June 21, 2007

I don't see it either. If this is to be trusted, how come 485 dates moved only by 3 days for NSC? It was July 11th 2007 for the month of April

    Hi,

If you follow excellence, success with follow you..Its in your hands to make a choice, to make a difference.

Ref: motivational words from movie Rocky
    =============================================
But somewhere along the line you changed, you stopped being you.
You let people stick a finger in your face and tell you youre no good, and when things got hard, you started looking for something to blame, like a big shadow.
Let me tell you something you already know, the world aint all sunshine and rainbows, its a very mean and nasty place and I dont care how tough you are, it will beat you to your knees and keep you there permanently if you let it.
You, me, or nobody, is gonna hit as hard as life; but it aint about how hard you hit, its about how hard you can get hit and keep moving forward, how much you can take and keep moving forward.
    Thats how winning is done.

Cause if youre willin to go through all the battling you gotta go through to get to where you wanna get, whos got the right to stop you.
I mean maybe some of you guys got something you never finished, something you really want to do, something you never said to somebody, something.
And youre told no even after you pay your dues, whos got the right to tell you that, who? Nobody.
Its your right to listen to your gut, it aint nobodys right to say no, after you earn the right to be where you want to be and do what you want to do.

Now if you know what youre worth, then go out and get what youre worth.
But youve gotta be willing to take the hits.
And not pointing fingers saying you aint where you wanna be because of him, or her, or anybody.
Cowards do that and that aint you!
    Youre better than that!

US Economy Facing 'Death by a Thousand Cuts': Roubini - Financials * Europe * News * Story - CNBC.com (http://www.cnbc.com/id/32837255)
Additionally, non-government bonds will face pressure, the securitization market is all but dead, the credit markets are still frozen and consumers will continue to save more rather than spend and boost growth.

"It's going to be death by a thousand cuts," said Roubini, chairman of RGE Monitor and economics professor at New York University's Stern School of Business. "The financial system is severely damaged, and it's not just the banks."
Roubini predicted more than 1,000 financial institutions could fail before all is said and done.

At the same time, he said housing prices are likely to fall another 12 percent in the next year40 percent overall since the market began its steep declineand about half of all homeowners will owe more on their mortgages than their houses are worth.

Ahh, I was wondering what happened to the nay sayers. Here we go again. I agree with the general consensus that owning a house is a personal matter; depends on each person's own situation. I am amazed by why some folks are hell bent on making others agree to their extreme opinion; be it "yes you must buy" or "no you must not buy". Everyone is correct in what they think is right for them. For the record, I don't own a house, at least not yet. :)

even if IOs dont know and even if they reject it, we can at least enforce it through MTR, courts etc if they ever walk into this grey area and actually decide to deny the case based on non-intent to undertake permanent employment... right?

    this is great...

so does this Q8 and the response mean that the intent of continuing with full time employment applies at the time of applying for I-140 and not at the time of adjudication?????? if that is the case, it will be GREAT!!!! hip hip hurray.. then i really dont need a green card... in a way at least...

Do you believe IOs understand any of these complex rules? Few days before someone posted that at the time of final GC interview IO even didn't know at all about July fiasco!

And why do you think the White House was in touch with Immigration voice leaders and not with some corporate lawyers during the July 2nd fiasco if they did not recognize the strength and commitment of the skilled immigrant community and btw what makes you say 'july 2nd will never happen again.' what are you? God?
I smell a closeted Anti Immigrant here.....

you need to remember that you are not a us citizen and you have no rights, you're previleged to have a job here...you can campaign till the cows come home and you aren't going to get squat.
july 2nd was a mistake that uscis had to rectify....there were a lot of companies who had spent the money in preparing I-485 applications and then uscis would have to face a class action lawsuit. july 2nd will never happen again.

    Hi

While waiting for GC ( which may take several more yrs !!!) I want to go for Life Insurance, Since I am at age of about 40 its need to be done, though I have enough of that in India, not in US. In that regards I just started evaluating different options. Plesase share your comments and experiences during search of Life Insurance.

    (1) which is better to go for term life or whole life
Term Life is better , agents will push for whole life as the commission are more
You have to come to the term , till when you need life coverage, like your son graduating after 7 years or after 12 years you may not have financial liability towards kids etc

    (2) I started contacting agents (mainly desi) and they recommend Whole life ( if you can afford premium). They tell that it is ultimately result in Saving, Dividend etc. So my question is Does paying EXTRA PREMIUM ( i think it will be substantially high for whole life) RESULT in EQUIVALENT OF SAVINGS OR DIVIDENS? or just agents recommends that because they get more commissions with that?
Yes they get more commission on whole life , basically you dont need , if at all you think then you can go for term life which offers extension after the initial period with same premium

    (3) I see lot of DESI agents in New york Life, So is it due to their speciallity in Indian Community market? Does they offer competative products?
    No clue

    (4) How to search of best rate for Whole or Term Life, Does Select qoute and Other such agencies are good to their promise of getting low cost? Does companys that we get through Select qoute give Insurance to NON-PERMANENT RESIDENTS like US
    Check these websites
    http://www.insure.com/
    http://www.accuquote.com/

    (5) Which reliable comanies offer Life insurance to non-greencard holders (menas H-1B holders)
Some of the companies doesnt offer for Non GC ( not permanent resident) or offer with higher premium

    (6) please list websites that you thnik are good as per your experience while searching and evaluating different Life Insurance Options?
    http://money.cnn.com/magazines/moneymag/money101/lesson20/
Also have some information web site listed in 4

thanks for your insput which will help several members like me.

P.S subscribed monthly contibutions to IV and participating in its other faxing and email campaigns.

    Good Luck

Yes, you are right. Cases are assigned (not picked), which is done in order they were physically received at the center they are being assigned at. If PD is not current, case is put aside and next file is considered. Due to huge filings in July'07, resultant chaos, and shuffling cases around between centers before entering them in the system, if your file is way below in line (eventhough you deligently made sure to have it with USCIS on July 2, AND your PD is current), no one is going to look at your file, until your turn (in order of final data entry) reaches.

If I recall correctly, I saw many posts about people called to ask about their 485 case status. And many got response as NC is cleared, waiting to be assigned to a IO and/or waiting for visa number.
That is why I think when you are current, you are then have a chance to be assigned to an IO, and then be able to get a visa number. I don't think cases have been assigned to IO when CIS receive your I-485 form. And if you look at 's data, many of old PD have been approved, even if their RD is 2008. So I think RD only plays a rule as control how many people can do SR. It is not matter about they will process your case if you are within processing time at all. When your PD is current, you have a chance.

On Ron's website, he talks about this move in Feb. He thinks there's not enough cases processed(not meet VO's goal) for EB2 China and India, that is why dates move forward. For EB-3, CIS meets VO's goal for the month so VO doesn't advance the date.

    Guys
Don't worry about this bill being rejected. I am pretty sure one way or the other they need to increase the EB visa number soon, else definetely USCIS will be in big trouble with thousands of applications sitting there for them, now having said that USCIS will find a way to get some bill which will have EB visa count increased passed in congress, so untill then cheer up and complete your filing.:) :) :)

Or they will find a way to make to make it more difficult to qualify...

Thanks for clarification. I still disagree with you. Media outlets do measure the intensity of the issue but not by amount of SPAM they receive in e-mails. From my personal experince in talking to a journalist, if you send them an e-mail regarding the issue they have published they will definitely defend their point or refute yours and may even look at the issue from your point of view but in all cases they will reply. Now if you want to bring an issue to their attention all you need is take their article and simply put your perspective on it. It will have a far greater impact if it comes as a collective voice of an Organisation such as IV. That's why I originally questioned our approach of spaming them by sending 1000's of e-mail with the same issue. It doesn't bring much to the table. Right ? That's precisely the reason why all organisations have a media relations person who represents the collective view of the entire organization and manage the press releases and all contacts with media.

Tell me about getting a response from reporters. It all depends on their whims and fancies. If they want to write, they are after you. If they dont want to they evade your emails. You have already considered our emails SPAM :) Thats what it would be considered if a bunch of people send the exact same email body. If we do send different message, it might still occur to them or a click to these forums will make them feel that we are trying to get more media exposure. What if the reporter you are writing to has an opinion similar to that of Tancredo on H1B? You are talking about taking an article and putting a perspective on it. Can you be more elaborate? If you are talking about articles being written on us, I believe there are not a lot. How ever there are talk shows that go into every home in the country that do propaganda work. For example a reporter at NPR replied to my email, how ever she doesnt revisit any story atleast for an year. I agree with your idea of Press Releases and I believe it was discussed before. I believe Pappu is working on it and I can do any help needed. How ever, I do not agree that we will be considered SPAM unless its the same message COPY/PASTE. 1000 emails?? Are you kidding me? I am sure it hasnt gone beyond 10 and will not go beyond 25 in the worst case.

If you dont believe what I am saying try contacting the local radio/tv station and see how you the thing works. What you are talking is IDEAL, But we dont live in one. Do we?

Bad for consulting companies (no H1B; may lose job)

Bad for physicians (no H1B for medical residents; no provisions for NIW...terrible)

Bad for H1b transfers and extensions (severe restrictive provisions on H1B)

    AC 21 repealed (disastrous)

Bad for pending I 140 .... left in limbo

Bad for pending LC .... left in complete limbo

Bad for retrogressed.... backlog will increase phenomenally 'cos of decreased visa numbers

This bill is a massive attack on us; we should put all our efforts to oppose and kill the bill. There is little chance that we can get amendments to reverse the potential damage that this bill can do... that is disaster for us.
    You mention "AC21 repealed"

Is this applicable to people who have already invoked AC21 (PD Sep 2002, I485 Rcpt Date May 2003) and have no backup H1B?
