This is a good idea. Cubans get the GC the day they land on this country. They can also count the number of years they waited on GC towards citizenship. All we need is a good EB-immigrant community lobby and few senators/reps who would do our bidding.

Thanks for trying to keep the focus on the solution.
I like pursuing option 3 and 2 at the same time. We don't know if option 3 requires a law change so need to clairfy that. While we prepare the slides/etc I think we should contact USCIS first and while working with them educate the law makers on EB3 category based on the points similar to below.
The fact that EB3 category requires less experience than EB2 shouldn't be looked at as EB3 applicant is less skilled. Infact I have applied EB2 twice and now in EB3 and I do have US masters and 10 + years US experience. It all depends on company's attorneys comfort level.
It shouldn't be viewed as we are taking visas away from EB2. Infact we are requesting realisitic approach to the skill sets. Instead of EB2 Current and EB3 at 2001, EB2 can be couple of years ahead of EB3.
We can come up with many ways to explain the injustice but it is time we ACT. I am with you on this.
Lets not get sidetracked by Mr Skillz with a Z.
Options for EB3I relief:
Option 1: CIR - This is not in the picture right now. Nobody knows when this is going to happen and I think we should not even bother to look upon this as a short term measure.
Option 2:Recapture of visas - Again this has to go through the legislative process. With the current political climate, it is going to take a tough task to get this one in as well.
Option 3:Re-intepreting and changing the spill over rule: This can be done without any legislative changes and USCIS can be asked to look on this if we can really force them to.
Steps to execute Option 3:
* Collect and consolidate all the data in a spreadsheet from the latest 485 inventory to the yearly reports of adjudicated cases
* Create a what if analysis for the next 3-5 years for EB2 I and EB3 I
* Create analysis to show what will happen with the old rule and changed interpretation of spill over
* Create a nice presentation
* Contact Senators, congressmen, USCIS and walk them through our presentation
Hopefully that can change their mind or atleast we gave our best shot.
Add your thoughts and inputs and let us create a plan on executing this, if folks want to do it.

Today I have contacted Ron Gotcher and here is his response.
1. Begin by contacting the office of the Inspector General of the Department of Labor. That office is supposed to ferret out mismanagement and misconduct within the agency. With cases pending as long as they have been pending, something is clearly wrong.
2. If you get no response from the IG's office, next prepare a formal letter to the Secretary of Labor, asking for assistance.
3. If that doesn't work (though it should), next contact the chairs of the House and Senate immigration sub-committees and file formal complaints, requesting their help. If you include a large number of victims, this should impress them enough to contact the agency to find out what's going on and get it resolved.
And also Ron Gotcher ready to help us.
So please guys post your inputs and what can be done futher. Its a collective effort and have to help outselves. Here is the action plan.
1. Rather than every one sending separate letter, let us send only one letter and every one signed that.
2. Let us create one yahoo group, send all your infomation, Name and adress.
3. Draft a letter to OIG, attach all our information.
4. Based on the response let us decide our next move.

I have to mail my application to cgi houston for my passport renewal. can anyone answer the following:
are they strict regarding the photo size of 3.5cm by 3.5cm?I have few old passport size photos of 2 by 2 inches and am thinking of using them.

I am little confused. As your wife is already in legal status (h4) till 09/2007, why do you want another extension when you switch job? As far as I know (I had similar situation in 2003), you can transfer your H1 to new employer and before her H4 expires, apply for extension with your new H1B (it may not be required even as she has already applied for H1). Once, I did exactly same when I switched job and I didn't had any legal problem with my wife/daughters' H4 extension.
Still I suggest you consult an attorney.

Hi All,
MY LC (PD May 2003) is still stuck in DBEC. So I may or may not be able to file withing Aug17th.
My question is regarding the procedure used by USCIS to process AOS applications. It would be great if someone could explain this to me.
These are my questions:
1. Is the AOS application processed by RD or PD?
2. Once USCIS starts processing the I485, do they check PD at any stage, or is it just used as the initail "gate " for allowing I485 application submission?
3. Suppose Tom with a PD of July 2006 applied in July 2007. Then Harry's case gets approved by BEC in August 2007 and he applies in October 2007. Who will get the GC first?

I-485 would be processed by RD if (and only iffffff) the PD is current.
That means:
. Your PD has to be current for approval;
. Older PD still has a lot more value than RD;
. If BEC victims are unable to file for I-485 now (for lack of labor approval), they would be able to file I-140 and I-485 later, when their dates become current (remember: no approvals without forward movement of dates)
PS: I just got out of BEC mess (after 3 years), can't even imagine what's going on in minds of those still stuck :(

The provision is now part of the minimum wage legislation being considered on the Senate floor.
"I've been working for 21 years on the Committee to promote expanded entrepreneurial opportunities for women and secure funding for these centers which help turn ideas into jobs, start-ups into success," said Kerry, Chairman of the Committee on Small Business and Entrepreneurship. "I cannot stress enough the vital role Women's Business Centers play in cities all around the country, like Boston and Worcester. This amendment ensures we will be providing women-owned small businesses the tools they need to grow and flourish."
"We cannot afford to ignore, or minimize, the extraordinary contributions America's business women are making to our economy, our culture, and our future. The achievements of women entrepreneurs are undeniable. Women-owned firms generate almost $2.5 trillion in revenues. They employ more than 19 million workers and are the fastest growing segment of today�s economy. In my home state of Maine alone, more than 63,000 women-owned firms generate an astounding $9 billion in sales," said Snowe. "Today, I am pleased to join Small Business Committee Chairman John Kerry and Senator Sununu with this amendment so women small business owners have the resources, the support and the opportunities they need and deserve."
Senator Sununu said: "Women's Business Centers contribute to the strength and diversity of the small business community, as we know from the great example set by Portsmouth's facility. Centers that have performed at a high level should have the option of applying for additional help to enable their important work to continue. The Senate�s action today marks an important step in the effort to preserve critical funding for WBCs in New Hampshire and across the country."
The amendment is similar to language that passed out of the Committee on Small Business and Entrepreneurship last summer as part of S. 3778, the comprehensive Small Business Administration reauthorization bill, which is based on the Women's Business Center Sustainability Pilot Program Kerry created in 1999.
Specifically, the amendment allows established Women's Business Centers to apply for 3-year grants on an ongoing basis. This permanent stream of federal funding is critical to helping the Centers secure matching private funds. This amendment also prohibits the Centers from sharing information about their clients without their consent, unless the information is required by a court order or to do an audit of the center.

Has anyone started fundraising yet??. I did not. I need to work on recruiting 6 more people atleast into Team IV. We should have 50 people for the Cal. Event atleast. I need to work on the networking events as well
