I am surprised some friends thought Ed should mention our agenda in an article which is talking about how to keep & increase the vote of the GOP.
Even if every member of IV is given a green card this afternoon, none would be able to vote in 5 years, unless you are in the military. We have less connection to the citizens in the United States than the undocumented workers. Latino citizens vote for more Latinos, but some Chinese citizens may think there are too many Chinese in the United States already!
In one word, none of us can vote in 5 years. Neither can we persuade the citizens we know.

I am glad that some EB2 guys can empathise with us....EB3(I) is completely hopeless....but I doubt if IV will take this up...even a small admin fix like applying the spillover to EB3 this year...that will take away some stress on the EB3(I) pipeline....

Hello, here are few practical things you can do right away:
1. Call your embassy.
2. Ask to speak with a Legal Attache / Equivalent
3. Explain the case in your native language.
4. Ask for help. Most foreign embassies are setup to help.
Tell them you are helpless. Dont know where to go. Given them 100% facts. Dont feel shy about the 'gory' details.
Remember, this is in the legal system now. Bulletin board responses from here are not as good as solid legal advice and help.
Next, find a local Chinese / Asian community organization. Google for it. If you cant find one locally, search for ones in big cities like NY, Boston etc and ask them for a reference. These groups are setup to help immigrants in distress. You might find an Asian-friendly or Asian lawyer willing to take up your case, FOR FREE. Just ask.
Finally, stop talking to all your neighbors. You can always reserve the right to file a Civil Rights / Discrimination suit. The American Civil Liberties Union (ACLU) can help. Call them. After you call your embassy.
This can be resolved easily if you have the right people on your side. Got it?

Green Tech, There is a history of posts with buddyinfo alias buddyinusa alias buddyinuk etc etc. This guy has a background of sounding like someone from India, and attacking specific community, pitching one against the other, which it typical terrorist mid-set. The other day he pretended like someone from north India and attacked people from AP. He was also supportive and sympathic towards terrorist who attacked Mumbai on 11/26. A Quick Question.
Can parents stay here for 5 1/2 months go back for say a month or two and come back again for 5 1\2 months? Would this pattern be suspected during visa renewal?
if its a 10 year visa...i doubt there should be a concern about visa renewal.

Since, last august DOL has become weird with even approving eb3 labors. Generally, attornies will put language in the eta 9089 that they will accept three years of experience for each year of bachelors degree missing (this is in line with education evaluators and uscis).
These days USCIS is trying to stick to the rules, so all people who are trying to beat the system by using wrong credentials are getting stuck. Lawyers have nothing to lose, they will make more money from you.....one from your eb3 application and two from your high risk eb2 application which will eventually be rejected.
This is a very simple assessment.

BTW you don't need rbi clearance.
You can send an overseas wire from india through your bank a/c where the cost would be minimal( only exchange rate diff and cost of wire($25-50).
Your parents can safely gift you $100,000 a year. Your bank only would need a letter from them saying its a gift.
I have tried this to repatriate my assets and it works all the time.
No need to open nre or nro a/c or anything.
ps. don;t entertain any solicitation on this site for reverse hawala or anyhthing as you don;t know who will cheat you!

1) Show me that no more than 90% of the population experience depression tendencies at some point in their life.
among EB applicants I believe it would be 99%. So are you alone? I guess not:D:D
Things you could do: Try watching talks with the Dalai Lama (available on youtube). Read books on Gandhi. Increase frequency of quiteness / meditation. Watch atleast one comedy show per day. Visit/remember the sick/disabled/poor or other less fortunate people than you.
Things you could avoid: Heavy drinking. Watching news, movies/shows which are high tension. Most important is not to fight the emotions/thoughts that you consider are destructive. Allow them to come and go. Just watch them come and go........
What you consider as "Good luck" can happen to you in the fraction of a seccond, however, it will never happen if you keep on defining yourself as unlucky. So focus on the good things you have now and refrain from comparing to "what you should be having or are worthy of having". :D:D:D:D

Recently I returned after a one month trip to India. At DC airport the CBP secondary inspection officer grilled us rough. First he called my wife and asked why did we leave US. She told that since my parents are old and not in good health we visited them. Then he started asking for documents proving it. And told us that without documents he won't let us enter. He went on to say that AP is only on humanitarian basis and unless CBP officer is satisfied with proof they cannot allow AP holder to enter. Finally after convincing him for another 30 min he let us in.
This was a really shocking experience. Are employment based GC's AP supposed to be treated like humanitarian AP? or was the CBP officer over reacting? Gurus please throw some light.
I have used AP at least 4 times this year while coming back from Europe,India.I came through New York(JFK),Newark(EWR). Only once I was asked a question about whether I have EAD. This is the third time an Indian American has won the competition in a row.
BTW, the huge number of Indian American partcipants is not due to the fact that " Indian Americans" are brilliant... These children (at least most) are partcipating not becasue they have talent but they are being forced to by the aspirations of their parents.
All the Indian American children are crying, sitting on the lap of their parents etc... See any other kid who lost, they were cool.
Maybe your parents did not hug you enough when you were growing up, but that's not a justifiable reason to be jealous from these kids.
We are all born as genius, life de-genius us. Each one of us have the ability to be brilliant, it just depends how each one of us chose to spend our time. Folks who spend their time constructively are brilliant, because they have learned to ignore the negative. That's why these kids are brilliant and that's why they have the talent.
A growing child with aspirations looking for a parent to comfort and console them is not a sign of weakness, its a sign of a strong bond between the child and the parent, I guess thats a cultural thing. And a strong bond with parents that takes away nothing from them for being recognized for their talent.
As far as being forced by parents is concerned, I know for fact that I would have NOT gone to University to get a degree if my parents were not there to guide me at that age. If parents use constructive guidance that allows the children to strive and become better citizens of the society, that's called "personal responsibility". Last time I check, someone became the President of this country speaking in favor of "personal responsibility" and "responsibility of parents". Was that wrong?

I can understand the emotion and commotion among my fellow beings who are stuck with BECs. I waited agonizing 5 years to get my labor cleared. We all clearly understand what are you guys going through.
But the thing is that Labor Certification issues are taken care with PERM implementation. Also the administration set up 2 BECs to take care of them back logs. Now the issue is purely administrative and not law making. Also BECs made it clear that by Oct 2007 all the back logs will be cleared.
Right now big things are happening in the immigration law making. So I think we should concentrate to get the best out of it and achieve our goals on the Green Card Visa issues. As Tom Tancredo is going to fight with teeth and nail against Immi Bills, we have to do the same.
There are many others issues we can lobby for such as
1) Starting H1B stamping inside the US again( Which was stopped in 2005)
2) Allow H1B spouses to work. etc etc
But I believe our priority for the time being should be Retrogression. I request all of you to use this thread for finding a person to testify.

Does your job requires you to have a Master's degree (or B.S. with some experience)? If it does not.....then you dont qualify for EB2. There is more to it. This is just a simple illustration. Even if you are a PhD if you take a job that requires only B.S. then you only qualify for EB3. This is my understanding.

I have applied for FOIA during Oct 2007. No response yet. Just checked the status. Thank you very much for the link. I did not know it existed earlier. Do you happen to know how I can change the address because I have moved ? I called the number they listed for FOIA on reciept notice. The asked me to call the regular USCIS number to update the address. The person who answered the regular USCIS customer service had no Idea about reciept notices starting with NRC. Any solution for this?

4) Information needed to search for record
--> Please specify only "ETA 9089" for PERM CASEs or ETA 750 PART A & B. ( I have asked for ETA 9089,)
--> You can also ask for I-140 approval copy(Since i have approval letter i didn't ask.)
*Note: If you specify portion of record in application, then it will be processed in Track one otherwise it is going to be in complex track(Track Two).

We all admit, the we haven't served our birth land as much as we have served America. Maybe there is calling here amongst all the turmoil with getting GCs.
Our home country wants us back. I know we have huge issues back in India. Population, Politician :-) etc etc.

msgs like this help establish the notion that this is an indian website dedicated to indian immigration issues. I didnt see any post wishing happy Eid/ Eid Mubarak nor did I notice last year that anyone wished a Merry Christmas/ Happy Holidays, nor do we wish our Chinese friends a Happy Chinese New Year.
The people who wants to be a part of American Society should first definately be a very open minded towards all cultures and social trends.
Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. Americans do not mind if one shows that he is Indian now and want to become in American future. Although they prefer that AND that is why they label Jindal as Indian-American although he born in USA. If there are majority Indians on IV board, it is not a crime but it is obvious. Some of my chienese friends on IV board may start thread for wishing chienese festival, I bet most Indians on this board will welcome and same goes with Muslim friends on IV board. Starting and wishing EID MUBARAK thread (By the way that is also a Indian tradition..And I am proud of that too) is not a crime and by now if nobody started it does not mean other people may not welcome it. If you are a Muslim, start the thread for EID Mubarak, I will be the first to welcome that step. You want to be American,, right? If you are a Muslim, start the thread for EID Mubarak, I will be the first to welcome that step. You want to be American,, right? Then first start learning open mind and start respecting the culture of majority IV memebers first. If you would not start that now how will you settle yourself in cultural pot of the world?
If you are an Indian citizen right now take control over your inferiority complex and get over it because if you do not respect your culture or your tradition what guaranty would be there for Americans that you would respect American traditions in future. Even Americans are not fool. And how dare you pretend that people form China and other countries just stop supporting IV as they just see few threads celebrating Indian culture? `Sec. 245B. (a) In General- The Secretary of Homeland Security may adjust the status of an alien to that of an alien lawfully admitted for permanent residence if the alien--
`(1) was physically present in the United States for a continuous period of not less than 5 years immediately preceding the date on which this provision was enacted and has maintained continuous physical presence since then.
This if i am reading and understanding right may not be too bad. Let me kow if i am missing anything......
Looks good, but is it talking about legal residents. If legal residents, then good chance to pass, else if its some type of amnesty, then it may not see light.
