Looking at the movement of dates for EB3, esp India and China, it's hard to be optimistic of any changes. It's a very wretched position to be in for Indian and Chinese nationality, if they're in EB3. All those who are eligible to port will definitely try to port to EB2 as long as it's available and cut their waiting time. It might be risky and unpredictable, but it's a risk worth taking considering the endless torture in the form of a long wait and zero or little forward movement of dates.
There've been times when I've felt like attempting porting, but am not sure of the reaction of my employer - a big "reputed" company. If they revoke the I-140 in retaliation for using AC-21, then no chance of porting and back to square one. So it's the seemingly endless wait for me just like all others suffering from 2001 onwards. If only I'd not hesitated to take a bold step back in 2003. Too late to lament about that though.

it is an acceptable proof, they said they have a rule that if the document has no expiration date, they can only give you a driver license with validity 6 months beyond the receipt date of your document (with the wild assumption that any I-485 application is approved or denied within 6 months)
In some of States they accept EAD also which can be valid upto two years. But any way it is pain.

Hi JunRN. After reading your post I googled if labor certification does have an expiration. According to: http://www.hooyou.com/lc/faq.html , it doesn't. Did you have to re-apply for yours? Thanks!

Sandy ,Simply Insane man , write a letter to white house and try to get some attention.This is completely ridiculous and definetley we need to do some thing .. I dont know what is left in this country , And they care more about illegal immigrants ..stupid tv news and news readers , hope one day they realise about legal immigration when we all are eligible to vote in this country

If you think that I have to give you a daily update in writing on what I am doing everyday to support IV, you are up for a surprise because that isn't happening. Before you criticize others, at least think.

CORE members, do you have any inputs here? It necessarily doesnot have to be agreeing with us, just that ur silence bothers me!
Considering the current economic situation, i donot expect much progress in addressing country quota elimination/CIR's.
We should atleast try to get our issues addressed in bits and pieces. Overall, anything to address retrogression should be welcomed! rather than 'debate and beat the horse to death.'

How come such legislative efforts are not even in IV's radar now....
Always check with your state chapters.
State chapter leaders are more aware of our work than what we post on the forum for public.
There is lot of activity going on at this time. Everyone must join their state chapters to actively participate in IV effort.
There maybe some more news today. Hopefully... Stay tuned.

EB3-I dates are in Oct 01, there are no cases to approve, what will they approve?
What makes you think they are processing EB2-I more? Same logic applies here. Wait for the next bulletin, if you are EB3-I in 02 you'll get what is long overdue?
If thats the case then why don't they move the PD forward. EB3-I is stuck in 2001 since last 3 years and its not moving forward at all. How can we get some help here, ombudsman?

For all those people who haven't been willing to donate to IV until now, let this Immigraton Fee Rise serve as a wake up call.
Do you want to pay $60 to IV now, or pay 10X that amount in June (when filing fee will rise by almost $600 for 485 filing)??
I know some people didn't want to contribute to IV, but now the choice is clear: pay $60 to IV now for its efforts or pay $600 to USCIS in June (where there will be no choice left but to pay up).

Thanks. she is still working for the same employer who sponsored her H1. Now, she needs to continue maintaining relation and continue working for them.
I am still worried though.. I read in this and other forums that USCIS may issue RFE asking for proof and if says medical leave, then asking for medical records etc.. So, better to prepare for some 'solid' answer with out any loopholes by being honest. I do not think lying would help and may lead to more troubles.
It means, if at all they have any doubts, they may issue RFE, but if you have a good relationship in responding to those RFEs using company letters etc, there is no problem. Good relation means, employer has to suppprt you always in case of any RFE, thats it. He needs stand on your side. Then there is no problem. But if he won't stand on your side, then it is a problem. So, thats why relation with employer is very important when on H1 or EB.

You are not obligated to apply for citizenship if you are a permanent resident.
