This is horrible and some community organizations and law firms must talk to the DOS/Whitehouse about this issue. National Security is must but there must be better way than playing with the future of so many innocent people (99% most likely of which will have acceptable backgrounds).
You must have already done some of this - try to contact your local Congressman, Attorney, Employer and try to find more info. This is completely unacceptable. After the PIMS introduction, I am hearing a lot of horror stories. It never used to be so bad earlier.
How can the consulate keep passports for so long? Basically, they are even barring you from taking any journey anywhere abroad. Why?

I too spend 1500 in 2006 becasue dates were not avaialble in india at that time... ( Iremeber ( 2-3 ) months waiting was there .. and Canada has 1-2 weeks.

Apart from the French language and referendum threat, are there any other downsides for Montreal? I guess the reason I seem to be fixated is that I think if I am going to make this change I might as well change the life setting to somewhat more European (in terms of architecture and the environment overall) as I am getting tired of American setting some times. So Montreal sounds more European in that sense. I do however, have a wife and kids and not sure if that makes a difference in the choice of destination as oppose to being a single migrant. Any differences in terms of education quality or family friendly policies between Ontario and Quebec?

like_watching_paint_dry your points are valid but try to see from the other side I mean think if would have chosen for CP instead of 485.
Please don't hink that CP filers are not contributing in any efforts of immigration voice, I have also sent letters to president for this latest campaign although there was no point mentioned for CP. I know that we can win this battle together.
In short I just want to say that it would be good if we all work together please do consider the CP filers as part of this community.

Completely baseless and irresponsible statement from Mr. Gotcher!!!
He contradicts his own statements:
"If these statements are true, then the end of the current mess is in sight.
If the CIS really has wiped out its processing backlog, then when the "pre-adjudicated" cases are given visa numbers in the next fiscal year, cutoff dates should advance rapidly. At a minimum, we should see them return to February 2007 levels, if not closer."
CONTRADICTS:
" EB2 China and India: Outlook is "grim" and there may be further retrogressions until later in the fiscal year."
On what basis he thinks that EB3 India will have PD in 2001 but EB2 India will further retrogress (currently it is stuck in 1999):
"EB2 China and India: Outlook is "grim" and there may be further retrogressions until later in the fiscal year.
EB3 India: November 1, 2001"
AND THE MOST OUTRAGEOUS REMARK IS FOR CIR: Look at this:

So I would say out of 500k it didnot reduce 2 years but only 1 year ... so total left are 360k - 140k ( 2009 ) = 220k remaining. Now that they have pre adjucted 110k so 110k left. If they stop accepting new app for next 2 years then they can clear all mess in 2 years but law prevent them to do so...... so end of mess for ROW contries is near ( with improved USCIS process )... but for India out look is grim as law prevent india to get more than 3k if there is more demand from ROW and Eb4 and Eb5.
also If CIR passes and they add recapture then it will make dates current becasue those visa go on oldest app first. ( God knows who is oldest here ) but given that india has lot more app pending in back those recapture can clean lots of indian backlog while new supply keep going to ROW countries.
To me the bottom line is " VISA RECAPTURE " either law suit way or congress through.............. other than pack ur bag and head to wards home.... ( specially people like us who didnot file AOS and very tough to be on h1b after 6th year is over ) ..

The disadvantage of not filing for AC21 is if your AoS is approved with USCIS believing that you will be working for the original petitioner after approval.
That is the disadvantage. USCIS will not know that you intended to port to new employer by invoking AC21 and come the time your apply for Naturalization, USCIS will discover it and may suspect you of fraud.

I had an infopass appointment in NY to get information on my case (specifically concerning the FP/Name check status, have received my EAD, AP). Although the officer was very courteous and seemed patient, he thought I had come there too soon for the inquiry. I got very sketchy information. He said one should wait at least 6 months after the 485 RD (mine is June 2007) before beginning inquiry (shoot me, I went a month too soon), and that it usually it takes a year (or more) after FP to get the GC, so I should not worry too much about my case for at least one more year.
He said there is nothing to worry about and that there are “many small small things” that have to be taken care of after FP and FBI name check clearance before one gets the GC. I asked him what are the other “things” that need to be taken care of following the clearance on name check, but didn’t get an answer (“just small small things” is what he said again). I had to repeat my question about the status of FBI name check on my case three times during the conversation before I got an answer which was vague anyways (nothing’s been done yet). I was hoping to get some kind of information with regards to the status in terms of the search results (no record/hit etc.) but I didn’t get any information at all, so it was a disappointing meeting for me.
Some pointers:
*Have your print out of the appointment confirmation ready before you enter the building-the security officer outside the building checks it to verify that you indeed have an appointment there.
*The queue at the entrance for security check was long, so make sure you reach there well ahead of the scheduled appointment.
*There is one more counter in the lobby (and one more queue) where you get your token number for the infopass room. They asked to see the appointment confirmation receipt here as well.
*The infopass interviews are held on the third floor. I waited for 30-35 mts. before my number was called.
P.S. Received EAD card at home address and AP documents at the law firm address.

I think MPADAPA' assumption about FB quota usage is not correct and I completely agree with realizeit.

I personally think Mr. MPADAPA's assumption is wrong. Last year (2008), the spillover came from Family quota of 2008. Spillover from Family or Employment quota of a particular year cannot be given to the following year. So the fact that there is nothing left from the family quota of 2008 doesn't change any situation here.
So, this year the spillover that Employment category can get from Family quota will be the unused numbers of 2009 Family quota.
This is just my thought!

i think this is just another interim or supplemental memo. Oh's website says that the rule making agenda for ac21 has been pushed out until next year.
About 2 weeks back Murthy posted an article in it's bulletin "new AC-21 regulations expected soon" http://www.murthy.com/mb_pdf/050208_P.html which i believe was a result of some discussions USCIS had with AILA?
Now is this new AC-21 memo released today the one being referred to in the above mentioned Murthy bulletin? OR i should still hold my breath for more AC-21 changes coming from USCIS, so they can jeopardize status of people by changing their interpretation of laws every now and then? Anyone?
