I guess country quota is root of all our green card related griefs. everybody else can dream of getting a green card someday, but EB-3/EB-2 India & China should stop dreaming about Green cards...I am sure this can be prooved illegal.
Yes true. This is the only angle that is viable in theory. All that can be done is challenge that the per country quota violates the constitution. Then the judge can strike that clause off.

In our pre-trial conference, we don't have chance to say any words in our case. Judge only asked my wife if she need no-contact or peaceful contact with me. My wife said no for either. But that DA still insist peaceful contact. Finally judge set peaceful contact for us.
SO far my wife's police statement is only words from her. Definitely my wife support me, she even asked my attorney if she plead guilty to peace disturbance, is that possible to dismiss my battery charge. Sure I don't want to risk her for any bad record. I will say we are in good marriage although we play around all the time. (Definitely we much careful since that terrible event)
Is that useful we find some witness, my wife's colleague and friends to demonstrate we are in good relationship?

If you could send checks instead of paypal, it would help us save transaction fees. Every penny counts. We are getting about $1000 a day on weekdays and as high as it may sound, its not the best we would wish as Sam Alito's confirmation gets the senate closer to other items on agenda one of which is Comp Immigration bill.

Citizenship is going to happen only after 5 years . But by then it would be long time gone .

I also got a RFE from nabreska , but finally got approved.

That's encouraging! I have lot more hurdles than the Bsc + MCA issue. My employer had filed my GC in EB3 and is now willing to refile under EB2, since I was promoted to a senior role. The company attorney though is hesitating to file under EB2, his reasons are as follows:
1. 3 + 3 degree will not be approved under EB2. ( This is in response to my question about using my Bsc + MCA. My current role requires Master's degree or Bachelor's + exp. I do not want to use the experience (9 years) gained from my current employer. So I suggested we could use my master's degree + 4+ years of experience that I have before joining my current employer. )
2. Attorney thinks Software Engineer role (EB3) and Principal Software Engineer role (EB2) are not 50% different. I agree that it is not 50% different. But my question to him was - "Does it (new role) have to be 50% different even if I don;t use the experience gained from the current employer". Haven't heard back from him yet.

Once again. You will get an EAD ONLY if you filed form I-765 along with your I-485. Your I-140 has no bearing on your EAD.

My understanding was that once the 485 is filed, you go by RD. It doesn't matter what your PD is...

EB3-India cannot be discriminated.
Anyone in EB3 after 2-3 years waiting is qualified under EB2-I. And we see people waiting for much more. How can we be discriminated then. We have to do something.
We are able to get very good number of people with like minds in Edison, NJ and other big cities with big concentration. We are planning to start a drive against this discrimination, in about 2-3 weeks from now. We would like to write to the honorable policitians and processing centers like Texas and others and to USCIS to treat all fairly.
1. EB3 India cannot be treated unfairly, wheras EB3-China is much ahead. Why is this.
2. EB2-India is Feb 2004, wheras EB3 India is Nov 2001 for many years. Why is this.
3. Why are allowing family immigration when skilled immigrants are waiting.
4. Why should greencards be counted head-wise, whereas H visas are not.
5. On the whole, why backlogs and punishing us.
These are the lines in which our group plan to drive this.,send more ideas.
For this we need money and more impo'ly efforts, so please contribute smartly as we request below.
We have teams in all major software hubs like NJ, DC, Livermore, CA, TX, Detroit, and and will need volunteers. We will soon come up with a yahoogroup to communicate.
We plan to send 10,000 letters and other awareness programs letters to the concerned people.
We plan to have our small booths in temples where many people will come.
We will print all the letters, you just need to buy the stamp from us and mail it.
Or give us an envelope with the 42c stamp. We need about 5-10 from you all.. So its will be $5.00 per head. That way there will be no quesiton of transparency. But if you want to donate more, you are welcome, instead we will prefer you put your efforts in creating strenghr and pass the word.
We cannot keep quite like this. There is no reason why EB3-India will move forward in current situations and with current rules.
We know EB2 will be upset, but based on your contribution, we can fight together, else we will go alone. EB3 is big enough to go by itself.
We plan to wear white dress with white caps.. for peace.. So we can be easily spotted. Give us a envelopes and stamps.. or we will give you addresses to send and the document.. As you wish...Or buy the stamps from us and take the printed content from us in free envelopes.

The poll shows that there are substantial number of cases from Yr 2004 or earlier. This shows that the Dates will be going back in October Visa bulletin. If the number of applications are 50 times of the polled numbers, then also it will take 2-3 years to clear the Yr 2004 and earlier applications.

AOS applied early June, FP was completed early July, and I am lucky to have a pretty unusual name. 3. It would be interesting if shimul99 would share with us as when exactly his status was adjudicated. I've read somewhere that there are cases, that people got their GCs approved by mistake and lawyers suggested to inform CIS and return the GC. I was under the impression based on some posts I read on other websites that even if your I-485 is approved before you applied for I-485 for your spouse, you can still add her if you were married before your I-485 approval date. Can someone confirm this ?? I feel the best way to handle the situation would be to apply for the I-485 of spouse on the date the PD becomes current. Keep all documents and applications ready and file on the first date. Since visa bulletin comes out 15 days in advance its good lead time to make preparations even if the movement of date is sudden.

Thanks Almond. At this point, I am hoping USCIS will at least allow me to change jobs (remember - I am on 7th year H1b - approved I-140, did not apply for I-485 due to retro). some members here said this is possible and some other members said I cannot do this. so I am confused if I can do this or not. If at all USCIS lets me do this, it would be great if I can find a new employer who can do EB-2. I am praying to God to help me while I try this route. I am not asking too much here... am I ?
No, not at all. It's perfectly normal to want to advance in life and to want to move on to better things. I think the best thing to do right now would be to go for a consultation with an immigration lawyer. Or, if you cannot afford it maybe you can schedule an InfoPass appointment and ask the rep there what your options are. But I'd say a lawyer would be the best option.

Obama is probably the worst President we have had in history OR may be his advisors are to be blamed. All they want to do is stop and punish business and then get votes by giving illegals free stuff. Legal residents spend at least $10-20K to remain legal and these freaking democrats want illegals to pay $500 and get citizenship (not even just GC).
Vote out all democrates in the coming elections. GOP is the only party that cares about America - not just for short term votes.

The burden should be on the employer to find out. Slowly, without jobs latinos (yes, the majority of illegals) will start leaving...going back - self deportation.
While we may have our personal views on the efficacy or effectiveness of the US political system and the politicians, we should refrain from using this forum to cast aspersions on individual actors and parties in the system or painting them with a broad brush.
