    So, what are the options for EB3-I? It appears that porting to EB2 will be more difficult moving forward due to difficulties in getting PERM approved especially for IT professions.

    If the recapture of unused visas does happen, what is the estimate on how much EB3I would move?

    Figures suggest that there are over 800,000 pending applications. Recapture will get around approximately 215,000 green cards. We are shot of around 600,000 green cards, which will take around 4 years (@140k/yr EB green card) to address the current backlog, which contains your and mine application. This is a deep deep hole and EB3-I is at the bottom of this hole.

    Are you serious lawyers suggesting to return GC?

    I think there was one case that I saw at Murthy web site where the guy went backhome and got married. Came back and found that his green card was approved while he was in his home country and before the wedding took place. Interesting part was that his PD was not current at that time. Because of the situation, he couldn't bring in his wife in H4 anymore.

    The lawyer recommended him to return his GC as it was mistakenly issued by USCIS. Lawyer had to deal with USCIS and returned the GC.

And after 90 days, it is highly unlikely that USCIS will have a problem with the alien’s change of employment

    In its Response to the Ombudsman’s 2006 Annual Report recommendation (AR 2006 – 01), USCIS agreed in principle to provide a breakdown of all incomplete cases by the number of months pending and application type.

    Given the constraints of existing legacy case management systems, USCIS would today need to perform a cumbersome, labor intensive, recurring manual audit of all pending files in order to compile the suggested data. Such audits would be cost prohibitive.
    USCIS has opted not to use its limited financial resources to extract data from current systems and prefers to spend it on prospective systems that are years in the planning. For example, USCIS has not made corrections to the CLAIMS 3 system to capture data on applicants’ priority date information, country of nationality, and the preference category under which the application is filed that USCIS must review before the application is accepted for green card processing.
    Failing to correct the system annually results in hundreds, if not thousands, of wasted hours by all levels of USCIS leadership in trying to account for an often asked question by Congress, the Ombudsman, stakeholders, and others: “Exactly how many employment-based green card applications does the agency have pending?” USCIS still cannot answer that question today with certainty.

    I think most important things you need to consider: (Considering the fact that PD will be pushed back to stone ages in September Bulletin)

    a) Hope that your I-485 Application is not approved before your PD becomes current. If this happens, it's a royal screw up until your wife keep's her own status (F1, H1).

    b) Earlier, it was predicatable when your PD would become current and it allowed most of the folks to add their spouses at later time.

    c) Bigger question is whether they would process on the basis of PD or RD. I think it's unfair to do it on basis of RD as most of the people would be jumping lines. Currently it's done on the basis of RD, but USCIS might change their SOP because of this July VB Fiasco.

    d) As others suggested, make sure to maintain your H1B status as long as possible without invoking your EAD. This way, you can continue to keep your wife on H4 status (Unless she can keep her own status for atleast another 2-3 years).

    I am in the same boat with EB-2 PD of Aug 2005. My spouse is outside US to get her F1-H1B stamping as her OPT Expired few weeks back.

    Hope, USCIS would allow filing for dependents at a later stage even your PD is not current. :confused:

    Hello there,

    I have been wanting to make an IV contribution for a long time and here is my problem..I probably can be labeled a miseror a magpie! ..Whenever I go to the IV link to contribute and see the $50 or $100 option I panic and get out..yes I do!
    I have some desi colleagues and was discussing this issue with them at work..and they had the exact same experience..wow..I am not the only magpie..

    But hey is'nt IV the one which is at the receiving end not getting our contributions..

    I speak from my own experience and call me a mapie or a miser..or whatever..I cant make myself make a $50 or more contribution .. thats the way I am..But I can sure make a smaller contribution (like a monthly recurring $10 contribution which really is easier to make) and I am quite sure IV will benefit from my small contributions as well as i think a lot more people will not hesitate making contributions in smaller denominations than a whopper $50+

    And really this is not related to IV effort but more to do with my own way of thinking about parting with my money..I love my money..:)...

    My history - Made $0 contributions so far..and have been wanting to contribute for a long time now..but keep backing away..

    I feel bad about your health ... get well soon :) ...

    And yes nothing come free in life and not even your GC even if your company pays for it ... by the way my company also pays all GC related expenses but still I am with IV ... just filing the application is not enough to get to GC ... in present situation we need a very strong advocacy group and IV is our only means ....

    Hope you will soon realize the truth about your GC dream ....

    Your driver's license in NY EFFECTIVELY expires the day your EAD expires. It will probably show a later date as an official expiration date, but that date is of little use. In red letters they have another date that shows the date of your EAD expiry, which cannot be 2013. That is the date of expiration of your DL. Make sure you get it renewed before it expires.

    I have had to renew my DL two times here in NY State because my EAD expired.

    Does anyone know whether hard copy of Labor approval is required for filing Form 1-140. My Labor status shows certified, but my lawyer is conveying that they have not received my hard copy of approval to process Form I-140 and 485. Can some one tell me if we can take a print out of Labor approval from online status and use it for filing 140.

    Yup...according to my lawyer, hard copy is required. I had all my paperwork in by the 22nd..and the reason they did not file on Friday for Monday delivery was that there was no Labor copy. Luckily the labor arrived on Friday...but then my case got pushed behind others...

    Hi,

    I am joining with Tek systems and they don't give as permanent position in offer letter rather just said contractor.. but I am full time with my current employer.

    Do you think its going to be any problem from changing Full time to Contractor?

    AC21 letter - wording is very important - the offer MUST be Permanant fulltime and the prospects for future employment must also be good - this is exactly what they request in a RFE or a NOID.

    If your letter says it is temporary position, you will have issues.

    Labor is done via perm process and they are now centrally processed (only prevailing wage is state dependent). Your company can apply for it online and you should get a result in 3-4 wks if the case is not audited. Good Luck to you.

    makes sense...they are expecting alot of 140/485 combine filings in July and by issuing this bulletin they have stopped people from filing 140 in PP

    When I saw the huge movement in June followed by the July bulletin, I'd thought to myself - it's a question of time before they suspend/terminate the 140 PP. The PP demand would come not from people who are filing 140/485 together (because that would be only people who just got the LCs) but rather people who had already applied 140 but not 485, or those who 140 is pending but 485 got current.

    This change could at least benefit those who have a "normal" 140 in the pipeline, but that's doubtful because I'm sure these resources would get sucked into the tsunami of 485s in July.

    The fact that it says they'll reconsider this after Aug 1 suggests that they do not anticipate too may 485 filings in Aug => chances of retrogression in Aug bulletin is now higher, if it does not retrogress mid-month!
