USCIS declares in weekly updates that actual package receiving date will be recognized as the Receipt date. However, as filings are shuttled between centers in an effort to push work around, when data is entered, a different date appears. This needs to be corrected. Further, as there are still cases not owned by any center, weekly updates are misleading. Each center just reports on what it has accepted to deal with. This needs to be addressed as well.
I think congressmen should be approached with the larger and collective problem, which is likely to get attention/action. Individual cases just receive standard replies.

I only caught part of a report on Lou Dobbs regarding Beckham's visa. He received an O-visa. The Department of State (http://travel.state.gov/visa/temp/types/types_1271.html) does not give the number of these visas issued every year. However, the reporter on Lou Dobbs (http://transcripts.cnn.com/TRANSCRIPTS/0707/13/ldt.01.html) claimed there were over 12,000 of those given out last year . Where did they get that number?

Received the physical card and the welcome notice on mail yesterday for self and welcome notice for my wife. Status still under initial review for self and for wife it is under post decision.

Where does it say (please quote official DHS/USCIS/DOL publication or a bill) that employers must hire "US Citizens" first? I think the regulations are to give preference to US workers (note that its not US citizens) before brining somebody from abroad.
You do make a very good observation and we should clarify with the experts. Can anybody help clarifying this from the lawyers?
I dont know of any link to a particular publication, but I thought it was a common knowledge that the whole point of labor certification process, is for the DOL to monitor that a potential US worker (I thought it meant US Citizen but may be not), is not being displaced by a foreign worker. To be clear here though, the DOL does not prevent an employer from going ahead and sponsoring an H1B and hiring a foreign employee. But DOL is legally directed to reject such labor applications.
Though this is applicable only for H1B hiring and subsequent filing of GC process for such an employee, I am wondering whether there is any loophole in DOL's directives that might provide a cover for employers to enquire whether a propective employee is US Citizens are not.... Especailly in the PERM process don't they have to do active recruiting efforts and gather statiscis that they tried to hire US citizens ..?? How can an employer gather statistics if they didn't ask for work authorization related details....?

First off, interesting thought. I thought about this a lot. A lot of my friends are citizens now. Most of them came at the same time I did or even after I came. They were at the right place at right time and did not languish in SWA & BEC like I did and did not wait in 485 queue for years like I am now.
It may be difficult to sell the idea of 10 year presence , but I believe the following may be palatable :
Consider the 140 approval date or I485 filing date towards calculation of the 5 years of residency requirement instead of GC approval date. You are technically approved to be a resident when 140 is approved. You are ONLY WAITING to be status adjusted for lack of numbers.
having said that I have NO expectation that we can achieve this. Think about it, we can't get simple things about GC done and aim for Citizenship :)

Received 'card production (green card)' approval e-mails for both me and my wife this morning.
IV leaders and IV Texas State Chapter can still count on my voluntary involvement. I love walking through the walkways of the Congress House and the Senate, especially the tram that connects the House and the Senate via the tunnel. ;)

If I search my "Firstname Middlename" there are 10000 hits in google :-). And I know for sure there are few murderers , politicians and movie stars(most of them are arrested atleast once for crime or the other :-)) who have the same first name and middle name as mine back in India.Last name is what makes the full name unique.
My Namecheck was initiated Aug 4th as per TSC IO and is still pending.Looks like I am going to be waiting for a long time.

What are u guys trying to acheive and how will this help EB3 India?
This is awesome lead. It suggests that barring 203 (which does not talk much about per-country limits) and paragraph 2 (which goes moot when there is spill-over), there should be no discrimination. But does the anti-discrimination apply to "qualification requirements" ?? That will be the counter argument against applying this section.

I think this is an opening and the outcome will depend on how we respond to it.
We are in the middle of a fight to get recognised of our problems and for sure the director responded to our non-violent protest.
What we do next will count.
Should we lay down our arms a surrender now? This will be a sign of weakness. Lets fight on.
Why is everybody so happy? He has just briefly and curtly informed in the message that flowers will be forwarded. They won't be sitting on my desk and embarrasing me. There is no acknowledgement of the issue or any empathy or compassion with the sufferers. Now even the press coverage will make USCIS director look good. I don't see what's the positive development here.

Agreed on your point. But there are other discriminations at workplace such as , age, race, sex and sexual harrassment. Those who complain about it effectively terminate their careers. If you want to go , complain against this L1 misuse fine, but you are not going to get mileage, maybe some bad breath and bad publicity and eventual loss of reference & job. If your company / client has decided they do not want to persist with you, there are 101 ways they can get rid of you, legal or illegal, my suggestion is, if you were exposed,
can L1fraud hold his head high in front of his client and still ask for reference with no sense of guilt in future? If not, he has lost half the game but now wants to lose the other half in a self destructive manner.

Most of the cases, upper management decides to replace all the local contractors with these outsourcing firms and once the contract is signed these companies dump all their L1 resources to projects and middle management who deals directly with the resources has minimal say in the process.

If they change the "contract" you agreed to initially - then you have every right to get out of the contract without any termination fees. It may take some arguing with the CS - but I know some people who have done this successfully with telephone companies like Verizone/Sprint etc when they changed some inconsequencial T&C.

i am waiting too, for the full month of june my attorney was sitting on my case not filing it as they were busy preparing the doc's for the july filers, finally they filed on july 2.
