Hi
I am the Susan from www.expatsvoice.org and just so you know my husband passed away last year
He was the petitioner for my son who was to follow to join. We only heard son had aged out in Oct 2005 and was getting a court case ready in early 2006.
Sadly my husband became unwell in March 06, diagnosed terminal on 4th May and died 13th May 2006
Someone posted, there maybe only a few cases but the cost is huge from an emotional standpoint
If I win my court case this may result in others having benefit who were previously denied lets hope so and stand together on this.
The grief and deprression I have suffered is unbearable due to errors, delays and husbands death
The memo in cspa clearly says that the CSPA should be interpred expansively, to me that means common sense and compassion.
Until we get an amendment to CSPA I feel there will be so many more cases of hardship and termoil to come to notice

eb3-row is staggering at june 2004. It will be a long time before we can see any spillovers from that to eb3-I..and this is not the case in EB2-ROW. Its current as of today.

Approval email on 5/12.
Physical card: 5/28(me & spouse).

Pasadena congressman Adam Schiff from CA supports legal immigration. I received an email from him recently stating the same.
"In considering immigration reform, Rep. Schiff has repeatedly stated that he does not believe in amnesty for undocumented aliens, but he does believe that those who have been living in this country -- working and paying taxes -- should be given an opportunity to embark on a lengthy and hard-earned path to citizenship. However, he has made it clear that he does not support immigrants who are here illegally being rewarded for breaking our laws by jumping ahead of those who have sought to enter this country legally."

You have to start all over if you find a EB2 qualified job and also if you qualify for that job,and your prospective employer couldn't find a qualified US Citizen or permanent resident for that job, you may port your current PD at the time of new I-140.

Currently I am on H1B visa. My labor petition and I-140 were approved sometime last year. I have been on H1B for many years now and my current H1-B is valid till 2010. My wife is on a H1-B visa too. Her labor petition and I-140 were approved too last year.
I have been admitted to some of the top ranking business schools full-time MBA program and intend to join one of those. I understand that transfer to F-1 status might be challenging. Hence I was planning to transfer to H4 status. School starts in Sept and I plan to be working till end of August. My question is : When do I need to file the I-539 change of status from H1 to H4 ? There is no date on the form I-539 that I can request my status change to be effective from. Also there is no guideline as to when my H4 status application may be approved. If I file now and it gets approved quickly, I cannot work for my employer and would have to sit at home. However, if I wait till end of August, then resign, how fast do I need to file for the H4 change of status ? Would the school have any issues if the approval is pending and I wanted to start classes. (Note I do have H1 valid till 2010, but once I quit my job I may no longer be in H1 status). Most schools did not have any accurate answer and hence I am throwing it at you gurus.

Friends,
Yesterday, it was our turn too to get the approval notice. It was a long wait like many of you. Checking into IV forums has helped me cope up with the delay. It is more than 8 years since entering US, 6 years since signing up with employer for GC, and five years since filing for labor. BEC and 485 were the biggest unpredictables in the journey. There were times when I thought if it was all that worth. Anyway, now we have completed this arduous journey (being an Indian).
As a token of appreciation for IV and good will for my fellow countrymen continuing the journey, I am also making a contribution of $100/-. I saw someone already made such comment here. Needless to say, my contribution is along the way.
Good luck to all in waiting.

One can have a Perm labor and a BEC approved labor. I know people who have both the labos with them each from PERM and BEC. and each case PERM was approved before BEC
