even if IOs dont know and even if they reject it, we can at least enforce it through MTR, courts etc if they ever walk into this grey area and actually decide to deny the case based on non-intent to undertake permanent employment... right?

Many here are 'strongly against' those 'horrible' desi or whatever companies after getting an h1b through them. As we know most of the software consultants are here only because those companies could utlize the loopholes in the system. (We all know that this labor certification and such things are nonsense!). It is great to fight for 'legal' things but when you see those who misusd it themselves are 'fighting' for it, makes people feel so funny! We all know that what we all need is GC, whatever be the way, and whatever happens to 'others'. It is legitimate and understandable to fight for 'our cause', otherwise who will fight for us?
[According to me nothing is 'wrong' to be here using any method even being an 'illegal immigant', but fortunately I am here in USA 'legally' and not using 'desi' or such companies]

I am sending my second contribution by Check today!
Yesterday night I have send around 100 emails to my friends and collegues here in USA regarding the efforts IV is making and helping out ! Some of them are already got their GCs but they know the Pains during this process.,
I requested all of them to pass information to other immigrants friends!!

Seems like MOtor Vechile dept is fianlly caught up with the Retrogression. I have been driving with Temp DL past 5 months. I was thinking it was the random check but this thread makes sense to me now

I think the OP has some valid points. Certainly recapture lawsuit may work as the law does not say that allocated EB visas expire. Do not listen to nay-sayers, just do it.
Here is one example of the succsessfull class-action (even though the court case died in a court of appeals, it was beneficial to immigrants):

In 2005 my first kid got an OCI as the rules were diiferent then but in 2009 the current rule is that one parent MUST be a US citizen and I had to take a PIO for my second kid in 2009.
Following is from the FAQ`s of Indian consulate at SFO
6. Are minor children whose both parents are Indian citizens eligible for OCI?

You are correct. The rules must have changed recently. I wonder what made them make that change, Now children of US citizens (who were once Indian citizens) have an advantage over children who has both parents as Indian citizens. Weird.. isn't it?

All arguments are very sensible. No doubt about it. am working on an EAD and they did not incur any legal cost. However, I get frustrated thinking why they charge $180 per hour to the client.... even when the cost to company for me is about $110K per annum or around $60 per hour. I do not know whether I am worth $180 per hour or not....but probably more than $60/hr since they can charge $180 / hr
We really need to analyze this deeply if we want to come up with a strategy....

Ideally , if you want to find out how much you should get/worth , put yourself in the market and do interview and try to negotiate and see what the range you are being offered . You may not take the offer but at least you will know where you stand.
Be aware full time ( with all benefits) and W2 / C2C/ consulting rate are very diffrerent and another dimension is region for different rate.

Folks I wish your suggestions would be helpful, but I have taken 3 infopass appointments, and to my badluck, everytime I visit I meet the same old-fat-lady who now happens to remember me, and says, "Didnt I tell you last time that blah blah blah ", believe me, she was not willing to even accept request to send interim ead , she gave some reason that NSC outsourced callcenter work to contractors who dont know what they are saying and send us to local office to request interim EAD. She says my FP for ead was done only in Nov(my 2nd infopass resulted in 2nd FP) so it will take 4-6 weeks after that to get EAD. Anyways I will take your advice for a 4th infopass next week.
Print that USCIS memo (see page 1) and insist that they follow procedures outlined in the memo. They required to provide you a written notice that they followed the procedures. Do not leave until they give it to you in writing. If they refuse, ask for their names and write them down. Ask them for a written notice that they refuse to follow the procedures from the memo. Try to be polite, even though it is hard during infopass, I know :) I know how frustratiing it can be when you go for infopass appointments, but be persistent and talk to the supervisor.

Do not leave until they give it to you in writing. If they refuse, ask for their names and write them down. Ask them for a written notice that they refuse to follow the procedures from the memo. Try to be polite, even though it is hard during infopass, I know :) I know how frustratiing it can be when you go for infopass appointments, but be persistent and talk to the supervisor.

not personal, addressing many issues.
1. if your company pays for everything, why such reluctance to put up a few more dollars for your own cause? think of those that pay for everything themselves and still contribute.
2. each contribution to paypal costs, they take a chunk off it. making small 10 buck contribution is really not the intelligent way to go.
3. there used to be a 20/mnth recurring contribution. now it does no exist. what do you want? should we throw out the original 20 buck guys? of course they can continue doing it. i can't imagine why it would put you off? btw we did not really lose any money by going to a minimum of 50- you know why? those who were serious still contributed. others who were whining at that time (why is there not a 10/mnth option) were in many (though not all) cases not going to contribute anyway. this is just fyi.
4. what is 50 bucks a month? step back and think sometime. a family meal/movie? do you indulge yourself occasionally worth 50 bucks?
i think in many cases the answer is yes. the money we need for lobbying ie very large....it's hard to make it form 20 bucks at a time when barely 5% of the membership contributes.
you have the choice hereof donating 100 now and considering it as two 50 buck donations, so your next one will be delayed. there are various ways of looking at this.
there are various ways to contribute, money is just one of them- although very important. if you have not done this, join a state chapter and start meeting lawmakers in your area. get friends to join iv. put up fliers and posters in local grocery stores/fairs and festivals etc. there are many good examples of these activities being done successfully. in the end it's going to matter is whether we put enough effort to push over the line- whether it's today or in 2 years.
we all have a choice. please make a wise one.

Far as I am concerned, unless you hae situation of life and death, you must not steal. The only other scenario, where theft could be pardoned is if you are out of work, have no money, have no friends who would help you, have been turned out by the local soup kitchen and the food bank, and have starving children at home and you decide to pich a loaf of brad from a store

I am talking about a person (like 485mbe - the one who has posted next to yr post) who has a PD of 2001 ..I am not saying that they should give Eb2's quota to EB3 ..but they should try to pull the category that is worst affected..or atleast give EB3 something ..
my question to you is ..say in the year 2010, would u support a situation where all categories are current or at 1 year difference ...while a particular category (eb3 I in this case) is at 2001 ??.. even if you do ..my feeling is that USCIS will try to pull EB3 - I (if something like above happens)..but then they are just a govt agency ..and in the end they are similar to govt agency in India ..only difference is that maybe little better
can I force them to do something just --No. can I pray for it -- maybe ..should I be ready for it (i.e. Eb3 - still in 2001 - 2002) - definitely !!
actually Eb3 - I should try and see something positive from this (I know it is difficult) ..maybe this long queue may motivate them to work harder or to get additional certifications (as I do ..) ...also, in my case, this delay in GC ..prevented me from buying a house when the prices were at peak ..(there is no doubt ..that had I got GC in 2006 ,..then I would have rushed to buy a house at inflated prices --far away from the city)
Just curious, why are you not porting your PD?. Nowadays Perm takes less than 2 months and with premium, 140 takes a few months.

Since USA home land Security depends on Legal immigrants bondage and slavery .. ..I mean fees they pay to stay in this country .. Amendment to File I-485 with out Visa being Current should pass easily. That way EAD reneavals will keep USA Govt running ..
