Most people say wait a month. Atleast that's what I plan to do. Any word on how Infopass works?
My PD is May 16 2006 and my friends with later PD were getting approval emails. Being curious I went to the local USCIS office w/ infopass appt and found out that my and my wife's 485 cases were approved couple of days ago and card production was ordered. The online status @ USCIS.gov still shows initial review which I think is the case many others too. I'd recommend taking infopass appt at local USCIS center and kill your curiousity.

The second reason is fund raising. I have a fundraising goal of 5$00 this year ans starting out early will give me a higher probablity of meeting my goal or exceeding it. I am going to be writing letters to my friends/ family to contribute towards IV as early as next week. I will see if I can raise atleast 150 to 200$ by doing that. I am going to organize a summer BBQ and have a cover charge or put a donation box at the BBQ. I will see how much I can raise doing that. My third event will be around November. I was planning on partnering with some friends and baking some pie's, puff pastry's, Cookies, kebobs and selling them at a local farmers maket on a saturday. Hopefully I will raise more than $500 doing all these. This should be a fun filled year for me.

I want to emphasize on this posting by Santb1975. I know that several IV Members have put in a lot of hard work over several weekends for the past several months working on the letter writing campaign. This initiative, Team IV, is slightly different, and is centered around your personal fitness goals, and having fun. The fundraising goals for each Member are so nominal that about 2-3 events should get you to your targets easily. These events do not require more than 2-3 days of planning and execution combined. In the process, you are going to have some fun as well.

All you need to do now, is sign up with Team IV. You can sustain or start your committment to fitness training and sign up for one of the Team IV or local events. The fundraising can start as late as August and you will have plenty of time to wrap it up by January 18, 2009.

I am confident that several Team IV Members will exceed their initial goals of $300 or $500.

This is a year long, fun filled, fitness oriented way to support IV!!

Today I received e-mail from USCIS stating --> "Service records indicate that your case was approved and your I-551 card was mailed on May 9, 2011 to the address we had on file at that time. Please check with your local Post Office for undeliverable mail. Your document has not been returned to us. "

Looks like I am greened. But when I check my status on uscis.gov it shows "initial review" same from last 4 years, there is no LUD change also. I didn't receive any welcome e-mail or card production ordered. Is anyone in same scenario? Is this normal process?

Honestly I don't even see a point for these discussions, polls or predictions for EB3-I. The sooner we accept we are doomed the better. The only way out is to help ourselves but I don't think many EB3's are willing to do that.
I spoke to several in my office with earlier EB3 PD's (who might not even get GC's in the next 5-10 years !) and of course with EAD's and they have literally substituted EAD for a GC. They were once a part of IV (and some similar org's ?!) but now have completely lost hope and don't care. I tried to motivate them to join IV and support but they feel that IV does not cater to EB3's anymore. Sadly they are not even trying to port to EB2. They are just content with a job and EAD.
So, I am not really sure how many of us are actually willing to fight ?!
In fact it's even worse for people like me who are still waiting to file their I-485. Is it going to take us 5,10 or 20 years just to get an EAD ?!

I agree, EB3 is doomed and I agree its better to accept the fact but dont agree that IV has forgotten EB3 (I can understand your pain).
also as far as comprehensive Immigration reform is consodered...I would say whether anyone likes it or not. Its just for votes (fight is so as to who gets thec credit DEMs Or REPUBLICANS). I am againsit as it promotes giving amnesty to illegals.

u mean the old Passport ? Yes, my old one was issued in India (vizag).

renewal applied by mail to CG SFO, got the new one to my mailing address in US, on the fifth day.

the 10 days estimate they are giving might be including the buffer time for contingencies and
contacting vizag might be the worst case scenario they are telling, but most probably not needed.

i later learned that, u can renew ur PP in India in 3 days, with Tatkal.

BREAKING NEWS: LOFGREN GIVES USCIS THREE DAYS TO ANSWER QUESTIONS

    http://blogs.ilw.com/gregsiskind/

Congresswoman Zoe Lofgren (D-CA), chair of the House Immigration Subcommittee, sent Secretary Chertoff a list of questions and a request for documents from USCIS to get to the bottom of the whole Visa Bulletin fiasco. The letter is very interesting not just because it puts a heck of a lot of pressure on DHS right now, but also because Lofgren's folks imply from the questions that USCIS was short circuiting established security clearance procedures to "pre-request" visa numbers from DOS. If it turns out full security clearances were not carried out, USCIS will either need to say that they had the legal justification (which would be a public relations disaster for the agency) or that they intended to complete the checks after the fact (which would be a direct violation of their own regulations). The only way to avoid answering the questions and to make this go away would be to eat crow and start working the case July cases.

Here's the link for the letter Congresswoman Zoe Lofgren wrote: http://blogs.ilw.com/gregsiskind/files/letter_to_chertoff_re_visa_bulletin_issues_july_9_ 2007.pdf. She really is taking them to task here. Wow!

    Thanks,
    Jayant

Here is what my attorney has sent regarding the AILA release, i dont know whether to believe him or other attorneys, i think i have no choice but to go with what my attorney says.He has been really good in these kinds ofnotices for the past 3 plus years, hope he is correct even with this.

    1)There is no way that USCIS would get away with shutting down filing of EB-1, EB-2 and EB-3 Adjustment filings without a massive class action lawsuit against the agency;
    2)The power to determine the availability or non-availability of permanent residence visa numbers rests solely with the Department of State. USCIS rejected the Other Worker Adjustments based upon a notice from the Department of State that there were no longer any visa numbers for the category. I recently attended our annual AILA immigration conference and there were members in attendance who had interviewed the Department of State official who sets the priority dates. The understanding was unequivocal that the Department of State office felt the numbers would remain available throughout July, and perhaps, as late as September;
3)At this time, there are 40,000 immigrant visa numbers available for the rest of the fiscal year. This means that in order for the Department of State to issue any kind of notice to USCIS, 40,000 permanent residence petitions would have to be APPROVED prior to the end of July. I am highlighting the word approved, because I need for all of my clients to understand that between June and July, there will a lot more than 40,000 Adjustments filed. However, what determines an immigrant visa number usage is the approval of a permanent residence.

Now lets go back to simple math: there are 140,000 immigrant visas available per fiscal year. 40,000 visa numbers are available at this time. The fiscal year runs from October 1st through September 30th. That means that in the first 9 months of the fiscal year, the Department of State and USCIS have managed to approve 100,000, which turns out to be 11,111 petitions per month. There is no possible way that USCIS and the Department of State are going to approve almost 4 times the number of permanent residencies in the month of July. The agencies do not have the time, nor do they have the manpower to approve 40,000 petitions within the next 30 days or so. That is the very reason why the Department of State official solely responsible for the priority dates felt pretty good about the availability of visa numbers throughout the month of July when he spoke to my colleagues from AILA.

To be honest with all of you, I was really disappointed in the message from AILA. In the rush to inform, they forgot to pause, analyze and really discuss the true possibility that USCIS would be directed by the Department of State to halt receipt of Adjustment of Status petitions. I want my clients to know this: at this point, I am not worried that the visa numbers will not be available throughout July. If I were worried, I would let you know. My responsibility is to guide you through this process and if there is any genuine worry on my part, I will let you know IMMEDIATELY.

This attorney is right. DOS is the one that manages the numbers. Not USCIS. USCIS is just a robot in processing the applications. DOS has legal obligation to issue not more than 140K EB visas per year. They may issue less than 140k visas per year. Thats is alright, no one can question. They can not exceed the limitation. The purpose of all category current in July is to approve all eligible 485s that were pending due to lack of visa numbers. It is not meant for accepting tons of 485 in July. If they do not make current for July, they cannot issue 40,000 visas before the end of FY. USCIS ombudsman scolded them in wasting the visas, despite the heavy demand. That is the reason why it is current. It is current not for accepting the tons of 485s. Also, Ombudsman recommended strongly that USCIS has to accept only correct number of 485s to process within time.

Even AILA failed to understand the difference between law and regulation. The regulation is a detailed procedure to implement the law. If they violate law, then they are in trouble. If they violate regulation without violating the law, it is perfectly alright. But only thing, it is not transparent and ideal way of handling the process.

Again, visa bulletin is an advisory notice by DOS to manage the numbers. DOS can instruct any time USCIS to accept or not to accept any 485s in between two visa bulletins.

If any one browse, USCIS web site, you can see this

The requestor has verified that the current visa bulletin indicates that a visa number is available for the country and classification involved, and that the current bulletin has not been superseded by an advisory from the Visa Control Office.

The Department of State has guaranteed to USCIS that so long as the current visa bulletin and any superseding advisories indicate that a number is available, a number will be assigned.

    Thanks for your response.
If you have an argument with some members on the forum, I think it should be restricted to just that. Calling every EB2 applicant a bigot is rude and uncalled for.

My colleague who recommended me to this forum is an EB2 applicant and is supportive of complete EB backlog elimination and is active in the IV state chapter inspite of getting his green card last year. Even the EB2 applicants on this particular thread have largely tried to point to how we should focus on the larger issue instead of fighting among ourselves. If you do not believe in IV, thats your choice - but I think we need this platform to achieve any relief for EB3.
I look forward to working on IV action items and lawmaker meetings. lets get this issue resolved for every EB applicant

Hear that you EB2 bigoted persons. Here is An EB3 person who is supporting IV inspite of what ever is happening. Will this open your eyes to the fact that EB3 folks are not against EB2 folks, but all that they want is that they should get some measure ofjustice.

Mr gc_dream2009. I feel a respect for you which i do NOT feel for EB2 folks who have tried to denigrate whatever i talked about (Must be their superiority complex)

I would now like to comment on some facts which are result of my observation over a period of 3 years starting from 2007 till current date

The only proposal which helped EB3 is July 2007 fiasco with EAD and AP benefit and before we give thanks to IV please remember that back peddeling by USCIS was not just because of just IV but also because of strong pressure from AILA. If EB3 benefited from July 2007 fiasco it is only because EB3 was part of all the EB categories and not because IV was aware of EB3 plight.

Now after July 2007 nothing has been ever done to relieve pressure on EB3. All the benefit have been provided to EB2 and all EB3 is told is after EB2 gets current EB3 wil get benefit but nobady talks about EB2 never getting current and the fact is EB2 will never get current and till that time EB2 will get all spill over visa and EB3 will get 0 (Zero) spil over visas

Totally agree! I was appalled by some peoples suggestion to those still stuck in BEC to "enjoy the moment" on behalf of others and "not to be a spoilsport". It is really very unfair, but you know what, like arihant says, it'll be like, "See you at IV in September" (when the October VB comes out) to continue.

Only difference is, you'd have "filed" 485 and if lucky you'd have gotten a receipt, because you might as well kiss your AP & EAD goodbye because there is no way they can process this ton load of apps any time soon.

I hope USCIS finally sees the injustice that has be meted out to the all the folks - whether in BEC or not - and process the application in a FIFO basis.

All those who are still waiting in BEC black hole, I feel for you. I was stuck in BEC for four years. Only managed to get out a couple of months ago after they allowed TR cases to be converted to RIR.

I tend to think the same way as chanduv23. Our final goal is a Green card, and it may still turn out that the people who are currently still waiting in BEC may end up getting their GC in hand before many of the ones that can apply for 485 in July.

The reason is that USCIS has clearly stated that it will retrogress big time in September. So, people with recent PDs may get to file their 485 but may have to wait for a long time for their PD to become current again to get the approval notice (folks, I am not wishing ill against any group here! I wish we all got our GCs ASAP. But since that is not going to happen, just trying to analyze facts). On the other hand, if BEC comes through with their sep 07 prediction, then these people with much older PDs may be able to apply for their 140/485 at that time and may end up getting their GC 6-12 months later because their PDs will still be current at the time of approval (Of course, this is assuming that they will not get caught in the Name Check Black hole)

So, all those who are still stuck in BEC, please hang in there, your day of freedom will arrive (maybe sooner than you are currently thinking).

I had a feeling USCIS may retract that message - so I saved the USCIS webpage on the very same day it was released....
