The Information Technology Association of America (ITAA), a lobbying group representing high-tech companies, says the bill won't do enough to compensate for a shortage of skilled workers and will make it more difficult to hire qualified people from overseas.
In a letter to Senate Majority Leader Harry Reid and Minority Leader Mitch McConnell, ITAA President and CEO, Phillip J Bond, said America's economy is strong and vibrant, but the country's future competitiveness rests on the ability of firms to recruit globally.
"As you know, the H-1B cap for FY '08 was reached in April, shutting out US employers from recruiting highly skilled foreign nationals who are graduating from US institutions with degrees in computer science, engineering, mathematics and other scientific and technical fields.

I went through the Federal Firearm Law and here is what I found:
(d) It shall be unlawful for any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person�

As per my understanding, if you are legally in the US, you can own a small firearm...walk into a store and tell them u need a gun and they will tell u what paper work you need or go to your local police station and ask the requirements. Yes but in Canada you will breathe clean air and drink clean water. You will have electricity 24 hrs a day and water 24 hrs a day. You wont find trash on the street and you wont be considered second class citizen if you arent SC/ST/OBC due to reservations. You woint have to give "donations" to get your kid admitted to Class 1. You wont face a system where a simple court case drags to 50 yrs or a case where doctor will not treat if before police does a "Panchnama" if you had an accident. You wont have to bribe everyone from minucipality to police to start a business.
I have driven in and around Toronto for a couple of hours and did not find it much better than driving in Trivandrum/Cochin.
Other points, I can only talk relating to the US and here we go.

Almost same story for water. About a year back, the DC govt. even admitted that the water supplied by them contains too much bad stuff.
"You wont find trash on the street" - only when you live in a decent community. Just walk around half an hour around NorthEast DC and hope you will change your mind. Do not attempt to walk around the downtown of any US city after 6 PM. We don't want to loose any of the IV members.
"you wont be considered second class citizen if you arent SC/ST/OBC due to reservations." - Who is considered second class citizens is a subject unto itself. But if you are complaining about reservations, you have never heard of affirmative action.
"You woint have to give "donations" to get your kid admitted to Class 1." - Agreed public schools are free, just like they are free in India. If you want your kid to study in a private school, please pay $5000 per year.
"You wont face a system where a simple court case drags to 50 yrs" - I had prefer a case dragging for 50 years or more against a wrong court decision such as we saw during the 2000 US presidential election.
"a case where doctor will not treat if before police does a "Panchnama" if you had an accident" - I think the situation in India has now changed regarding hospitals refucing to treat people due to police case and such. Now, all hospitals (private hospitals included) are required to treat traffic accident victims asap.
I am not trying to say, India is paradise. We have lots of crap going around. Many things still stink, but so is the situation in many "great" countries.

Do you really agree with multi-national managers(via L1A). This is the area wherein the interpretation is pretty loose. If you dissect EB1 data you would find that EB1C used bulk of it except for this year due to bad economy and tightening of screws. There should be some very clearly defined guidelines for EB1-C, somebody being an onsite coordinator or managing 5 people should not be eligible. This category should be reserved for those who are managing at least 100 people or control business in several millions. I agree that EB1 should be just for the exceptional.

Because the process of allocating visa numbers is such that you can never use all of it...(you may listent to USCIS and DOS testimony several months back. They mentioned in that testimony that the best they can do is to waste 5% or less).
So my best guess is: they wasted about 5-7k EB visas this year.
They still will claim "great success" as they used >95% of numbers.
The real solution was in visa recapture bill; but it is no where in sight now...

thats the problem.... I cannot switch to another job as I am in the 7th year of H1B and I-140 approved but did not apply for I-485 yet. friends told me its risky to switch jobs now as I may be out of status.
Boss, I was exactly in same position as yours. You can call it a mirror image. I switched in 9th yr of h1 after being a white collar slave with same employer. I'll suggest before you loose self respect and confidence in your own eyes..... SWITCH.

my pd is march 07. my agency told me they converted my I 140 into premium on june 18.But my case status still hasn changed from 'RECIEVED N PENDING". Is there any delay by the uscis usually in changing the status?

My RFE response to the I-140 PP was sent on June 7th but I have received anything from USCIS. Status on theor wesite is still old. Its almost 3 weeks after I sent the response to the RFE. I am not sure what is going on w/ USCIS these days. They have taken money to process it in premium but it seems they don't bother to complete case in 15 working days anymore.
Can somebody please clarify?

You have 2 choices:
1. If your PD is before 2003 they it may become current in Oct and you can file for her, but if not then it is highly unlikely the dates will move in the next several years. If you both are not born in India/China ur chances are better.
2. She continues on her H1 and wait till your priority dates become current which can take upto 7 years.
This is a very bad situation i would highly recommend that you move heaven and earth together to get married and file this month. Pardon me for saying so but ur stars are alligned till Aug 16th only. Good Luck!

Now for those who cannot make it to NYC, please arrange your own MEET AND GREET events in a local Starbucks or meet up in a local mall food court or any other place you think is best - conference rooms in apartment complexes are very ideal places for meetings.
We want volunteers from the following areas
(1) Long Island, farther east - till Riverhead
(2) South Jersey, West Jersey
(3) Connecticut (Northern)
(4) Upstate NY (Albany and Poughkeepsie)
(5) Upstate NY - Syracuse, Rochester and Buffalo

There is one more option for you. H1 and L1 employees can go on long paid/unpaid leaves. If her company can support with document that she was on an unpaid leave for any reason (I do not know the reasons...make something) then there are chances that she will be able to change her status back to H4. All you have to prove that there was a good faith employee employer relationship for that particular duration. Talk to a lawyer, explain the situation..........every passing day is making your situation worse. Good Luck.
