Another solution is to remove the dual intent nature of the H1B, and disallow filing of a green card petition for H1B holders. That will preserve the temporary nature of the H1B program and force a fresh look at the system for issuing green cards.

I am sure you would get that as well...and pretty soon. it would help though to not focus on the gc too much as who is getting earlier or later and how randomly USCIS look at things. It's better not spend our energies on something that we don;t control ..but focus on things we do or can..my 2 cents.

The three days were packed with drama - Like any good drama, this too had it's moments of tension, action, and humor....the funniest one was:
Right before the rally when Aman was EXTREMELY busy, he actually had 30 seconds for each reporter. Our sweet little Jane walks up to him and asks "Aman where are my clothes?"
Aman had the funniest expression on his face :confused:
Here is the background : All of us had stayed in the same hotel and at the check out time we had kept out luggage in the baggage room. Aman had the tags of Jane's bags and Jane thought that Aman would get her luggage @ the rally!

Looks like approvals has slowed down further.
This is why at the end of the year there are unused visas. All due to inefficiencies of USCIS.
We are doomed.

Unintentional, might be, but you did ruffle this topic of US Master's vs US Non-Master's with this rather sad comment (warm spit!). I dont want to go much further into this either but talking about something that you obviously dont know (useless subjects 'assembly language programming'), you havent added any valule addition here either. (Just FYI, even during peak recession, ppl with ALP skills were really very few because most of the direct recruits from '6 month NIIT courses' werent upto system level programming).
And btw, if think that a 6 month course in NIIT with a degree in tier 3 university is going to help get a job during times of recession, then i dont know what to tell you.
Yes, i do have an MS degree from the US and i did suffer lay-off during recession - bounce back, i did really quickly while i saw few ppl that only had '6 month courses from NIIT' suffer for long times without a job because all they had to offer was that...their six month experience at NIIT!!
Btw, i do appreciate all the work that you do and all your postings too, but i felt that i had to give a riposte to something that i find insinuating and written without a whole lot of thought....
Why do we always equate some educational qualification from some institute to capability? Remember Einstein, Bill Gates, Steve Jobs, Cornegie, Rockefeller.... list goes on.

Finally i got the email saying card production ordered on May 10th. My priority date is Ju26th 2006 , EB2. Thank You IV , Aman , Anu, Himanshu, Gopal and all other IVans for the help and most importently Aman for forming IV and giving us a forum to congregate and fight for our cause.
I am donor member since 1.5 yrs, was a member of advocacy day event last year. This april i could not take part because of a family emergency back home. IV has helped me immencely both informationwise and also psychologically during days of regression.
I will continue to be DONOR member in the future as well. I hope that will help other IVans.
I wish you all best of luck in your wait.

My employer says that he has lodged my PERM in July 2008. As yet there is no news and neither does he provide any information regarding the status. Is there anything I can do to find out whether the PERM has been lodged at all? What are my options?
Try contacting the attorney who filed for perm (if attorney was used), don't mention that employer is not providing you any information. You don't have much options as you will need your employer's or attorney's login details for DOL website to check status.

It depends on how many applications were filed that had priority dates before the Retrogressed Date (22 APR 01, 01 AUG 02, Etc).
If there were no big volume of applications before this date, then the USCIS is out of work as it relates to the I-485 applications processing. Thats when they move the date forward to allow more applications with later priority dates come to the processing desk.
My two cents.

Hi everyone! Hope you guys can help me.
We had our lawyer file my husband's H1B non-profit with me as his dependent. I guess you can say that we trusted our lawyer too much when he said that he filed both for H1B & H4. Now, I feel so stupid for not inquiring about it too much before.
My husband's H1B just got approved and the lawyer is asking me now if I got my H4 or a notice of receipt of my own. I did not know that the notice of receipt for both of us should be different. I thought there ought to be 1 notice of receipt for the two of us since my status would be totally dependent whether or not he will be approved.
When I asked them whether they are sure that they filed for the H4, they said that they did but they did not sound too convincing. They turn the table around by asking whether or not I received the notice of receipt and my approval.
What concerns me are:
(1) My husband's approval & notice of receipt arrived at the lawyer's/employer's office, why is mine supposed to be mailed at my place?
(2) The possibility of H1B being approved and the H4 disapproved since we are both currently here in the United States already.
(3) Do I have a real reason to be alarmed that I do not have an approval for H4 at hand? Is there a possibility that it's just delayed right now since the approval for H1B arrived just two days ago?
(4) How can I verify whether the lawyer filed for the H4 with the H1B?

I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. Just checked USCIS.gov. Both mine and my wife's I-485 were approved.
"On May 5, 2011, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283."

My lawyer said anyone applying for PERM EB2 is automatic audit to prove business necesity.
