apply for EAD for sure as it will help if your wife wants to work.
apply for AP if you think you will not have time to get the H1 and H4 visa stamps in your passport when you travel to your home country in that case you will have to entter back on AP

Group:
I am ready for anything GC, conditional GC or Citizenship which ever comes first. If it is required funding we can start a new funding drive. But we need to start actively. Still I beleive that we should ask for conditional GC first because USCIS itself can make a rule to give a conditional GC for people who are waiting for GC more than 5 years and staying legally in this country last 10 years.
We need to collect friends who are in same situation.
We should take advise from attorney if they can give some kind of help.

Filed for EAD for my husband along with the I 485's and have had all receipts, also had fingerprints done already, exactly one month after the receipt date. Sent both entire packets of forms with checks to Nebraska. We did not file advanced parole since I still have a valid H1B and plan to stay in my current job until I get my card. Husband will work on EAD and will not travel until gets his card, no family left in England.
Don't you have to file Advanced Parole for your husband or can he travel just on EAD?

The contents of this postings are based on what I have read from various Lawyer's website and my lawyer's suggestions.
Multiple I-485 Fillings Scenario:
1. Two I-485 for the with the same primary applicant
Case a: One I-140/I-485 Pending with another employer and one I-140/I-485 to be filed in July with the current employer.
Case b: One I-140/I-485 Pending due to substituted labor (and cannot be expedited because premium processing not available). Another I-485 to be filed based on approved I-140 (on one's own labor). Both from the same employer.
2. Two I-485 with different primary applicants (Primary on one and dependent on other)
Case a: I-140 for one is approved while other's pending
Case b: Both I-140 Approved
Case c: Both filling concurrently in June
Pros and Cons
Scenario 1, Case a: In this case there is a substantial risk that I-485 filed with first employer might lead to issues esp if I-140 is not approved. Thus is a good idea to file another one with current employer. (Pro)
Scenario 1, Case a: How can one Adjust the Status from two employer at the same time. (Con)
Scenario 1, Case b: Since first I-485 application is already filed and I-140's outcome is not known. It is a good idea to file another one as a fall back option. If one waits for the outcome of first I-140 and it is denied and then it will be too late to file another I-485 because dates might have retrogressed.
Scenario 2, Case a: One with the approved I-140 should file I-485 with other as dependent.
Scenario 2, Case b: I-485 for both is almost ensured and thus filling two will give added cover in case something happens. One might have a better priority date than other. (Pro)

Conclusion

There is nothing wrong with two filings, worst case scenario could be an RFE from USCIS to choose one. Best case scenario is USCIS upon approving one cancels other. Two filings indeed give you a peace of mind and reduce risk during the process. It doesn't change the outcome (like your application will not be denied just because you have filed two). If a little delay is acceptable to you as a price you pay to reduce a bigger risk and added benefits then multiple filing is right thing to do.

This surely is an idea worth pursuing. Will require a real hard push. Where does one start other than writing on change.gov? In this economic environment this may be a real hard sell in my opinion. I think all will benefit from this naysayers too.

Called almost everyone on the list and urged for support.
To all others like me, who are hesitant and are not sure about the talking points. Below is something that can help.
You would most likely be talking to a person taking messages and not the congressman/woman directly.
And you also dont have to explain them the details of the bill, as they are very well aware of it. All you have to tell them is it is about HR5882.
After one or 2 calls, my message was standardized and this is what I used in all the calls.
Good Morning. I am calling in regards to the bill HR5882. (Pause for the other person to give you a go ahead and then continue). I would like to express my support for the bill and would like to request the support of Congressman/woman for the bill. If you can pass the message to the Congressman/Woman, that will be greatly appreciated.
Thank You and have a Great Day.

And some might ask you where you are calling them from. My reply to them was - I am calling from the state of VA. I also reached out to my district's congressman, but also wanted to request the support of Congressman XXXX and so am calling your office.
I was initially hesitant and was not sure as to how to put it together, but it was real eazy and quick. After some calls, I even called up people who do not suppor this like Steve King, etc. It was only a matter of a call and letting them know our opinion. All that I lost was 2 minutes of my time and no money for my unlimited phone plan.
Not sure how much help it will be, but surely cannot hurt. It would atleast draw their attention due to the large call volume. Yes, some offices told me that they were receiving lot of calls for this bill.
So go on... do your part.

I am really surprised by the meek response...what is wrong with everyone?? We have just abt 54 letters so far and almost 200 members online right now !!!

I am thinking that we should do something like have IV attorneys look into this PIMS delas and we should may be do another letter campain? (strictly speaking, I know this cannot become an agenda item for IV).
If this trend with PIMS continues (which is what it looks like), sooner or later it may affect a lot of people on H1b month after month who are going for visa stamping. With priority dates retrogressed badly this will become another pain point.

This is ridiculous; all I see is unnecessary hurdles being produced � I see efforts of discouragement towards coming to this country on H1B. First they suddenly start auditing 60% PERM cases and now suddenly delaying visa unreasonably�increasing Visa numbers and making Green Card processing faster is aside, we are facing other problems.
I have started speaking with senior people at DOS. On a purely procedural level I don't see why an H1 applicant who may already be in the US is not 'security cleared' at the time of giving the I-797 approval. Totally ridiculous.

As a hypothetical example (because vehicle prices always depreciate, so please ignore the reality), let's say you bought that Gas guzzling SUV at 50k and now suddenly after 2 years, due to whatever reason, you go and try to sell the same SUV to the same dealer and he quotes you 5k. Wouldn't you fault that dealer for selling you the same thing at 50k when the actual value of the same asset 2 year back was 5k (but he sold you at 50k and you have only paid back 10k in monthly installments until now). Who is to blame for that 35k deficit? You? Forget the monthly payments here and concentrate on the actual asset value.
You forgot that dealer is also making 5K for the SUV that he bought from manufacturer for $50,000. In the end everyone lost 35K. So dealer will loose multiples 35K based on how many SUV he has in his inventory. You might suggest he should go to the manufacturer ?

You are living with a very simplistic and naive idea about the world and you are convinced that's the way of life. Not only that, you are trying to convince others of that. To me collateral damage to GC is more acceptable than the same to human life.
On economic front, the only person on either side who truly supports free market policies is Ron Paul. He is the one of the few Republicans who actually thinks about balancing the budget. Tax cuts are ok, only if you back them up with reduced spending, without increasing the national levergage. National debt is now at 100% of GDP (in the company of zimbabwe and jamiaca) , 20-30% of future income tax will go towards paying of the interest on Govt tax. It will definitely crowd out future private investments. Look at the history of national debt, and correlate them to the administrations.
"Supply side" tax reductions of Reagan admin were good but even he increased the debt during his tenure. Leveraging is good for private cos (to certain limit, as we can say from recent developments), but not for Govts, as they do not really do much economically productive activity. Keynesian economists have all been hiding in their basement in the last two weeks.
It is just my belief that Repubs dumb down everything.. from education to how to sell a war or economic plan to people.

Finally, 5882 is our only hope for now.
With the earlier method or the current method, EB3-I will always end up last. Vertically EB3-ROW gets the excess visas (old method), horizontally EB2-I gets the excess visas (new method). So, either way EB3-I won't benefit, the only solace being that with the current system atleast our EB2-I friends are getting their freedom faster.

I called the members and most of the calls went to voicemail. Left a message urging them to support the bill. I also started posting this in our university Indian student Association group so that they can start calling. I thank IV for the telephone numbers.
