    I am planning to get H1 stamped in Chennai in April.
    (I also have AP, but would prefer to use the H1B1 )

    In case the process takes too long, due to PIMS, can I cancel this process, get my passport back and enter the United States using AP?

    Too lazy
    Too scary
    Too selfish

    So far I am lazy. I am sending them today.

    Just 51? Only 51 members used AC21 or what?

    What will it take the rest to participate? USCIS sending denials to your address? If this campaign fails there is no one to help you if this happens.

    Send those letters ASAP

    What will happen after that? I mean what would be the rate of movement

    I have had couple of LUDs on my cases (9/10 and 9/13) and nothing after that. The last time I gave my fingerprints were in Jan 2009, so I am sure they have expired. Should I proactively get the biometrics done (by taking an infopass and requesting biometrics notice) or wait for them to send me the notice?

    Not sure if this will help if I open up an SR or take an infopass. Anyone got their 485 approved while their biometrics were expired?

    My lawyer received a letter from USCIS asking for verification of employment and whether the position is still available and being offered to me. Once they respond, hopefully the approval will come through.

    I came here on F1 and i was on F1 when we applied for 485.
    after i got my masters i did not apply for opt and used the EAD card i got through 485 for working.
    I changed my status from F1 to H4 once i graduated.I never traveled after i came here.

    Will i face any problems in future when our pd becomes current.
    Our lawyer says there should not be any problem but i don't know if he is correct.:(

    I have a WAC number and petition approved in Feb 07. Stuck here for 1 month, 18 days and counting. I called DOS and didn't receive a positive response. Will try calling KCC tomorrow.

    :confused:

    Good luck to you.. I understand it is really frustrating... and they don't really care for us.

    if more people post their details then we might be able to conclude something.. there are always exceptions so it is very difficult to figure out.. (well, it might be possible that there is no pattern but if we get more details of more cases then we can think something... after all we can't do anything apart from this ...:mad: )

    This is ridiculous; all I see is unnecessary hurdles being produced I see efforts of discouragement towards coming to this country on H1B. First they suddenly start auditing 60% PERM cases and now suddenly delaying visa unreasonablyincreasing Visa numbers and making Green Card processing faster is aside, we are facing other problems.

    For an employment-based petition, in order to proceed and be valid, they need to still INTEND to be employed by the sponsoring employer if and when they get their green card. The employer however, does not need to sign any forms per se with relation to the adjustment petition. If the alien is currently working for the sponsoring employer (on H-1B or other) he or she can port or transfer employers without penalty or without losing the
    green card process 180 days after they file the I-485 petition. At that point, they can change employers and work for whomever they wish (provided they have a valid work permit)

    I have an employment-based petition and I'm presently unemployed. From what I understand, the sponsoring employer can hire me when I get my green card. So, when I get my EAD, which is most probably in 3 months, can I use it to work for whomever I wish?

    Damn this sucking life man, no social life, no career life, no nothing life. Even animals must be living a better and meaningful life. It sucks big time, did it ever happen in history that uscis revised a visa bulletin on the day it is supposed to go into effect ....

    We must fill their mailbox guys, let tham know this cannot be accepted.

    uscis.webmaster@dhs.gov

    National Customer Service Center (NCSC) at 1-800-375-5283 (TTY 1-800-767-1833)

    I don't intent to sound rude, but why would this make your life "Suck", "no social life" , "no career life", "no nothing life".

    Iam in the same position as everybody else, and am deeply dissapointed with the news (hence Iam here), but I just spend 2 hours in a nice pub, drinking nice micro brews, came home had a nice talk with my wife (H4), we are planning on going out for dinner and maybe watch Knocked up afterwards (heard its nice).

    If this were to be true, it would delay our GC by another 2-3 years, but we are in this country on our own free will, making good money. Be dissapointed, but this is not the end of the world..Mantain the perspective...

    My flowers from FTD got shipped through DHL. Are they going to stop the DHS guy and ask him to go to the Hospital????

    They would have to collect the flowers first and then send them there themselves.

    Thats good enough for us!

    I have received Courtesy copy of I485 Approval notice, and law firm received the Original I485 Approval Notice.

    Is there any use for Original I485 Approval Notice or just Green Card is Enough?

    Ask them to connect you to the head/Senior executive. I did the same thing with my local cable+phone and was connected to a the head of their customer Service. That person connected me to more senior marketing person. That marketing person called me and emailed me to discuss. The company had no idea about Vonage plan and seemed unprepared to have a strategy to stop the exodus of its customers to Vonage.

    All of you can do the same. When more people do it, it will generate market demand and customer demand that money hungry capitalist companies cannot ignore. If you do not do it, then one company will have monopoly over this market.

    I just talked to one of teleblend rep (live chat on their website, very easy to do and I can do this during lunch time from office). The guy said they are working on something but was not providing any time line or details. I told him to hurryup else I will switch. Looks like we need more teleblend customers contact them to get this done faster. Guess they are waiting to see what effect or how many customers actually switch to vonage. Teleblend must offer $20 world plan in order to stay afloat in competition. I say this as they now offers $15 unlimited us-canada Vs. vonage $25 unlimited us-canada plan so far.

    This is approx data from last year DOS yearly report.

    EB1 = 41k
    EB2 = 53k
    EB3 = 42k
    EB4 = 11k
    EB5 = 2k

    Total was ~ 150 k ( 140k + 10 K from Family Quota's Spill over )

    so basically EB1 and EB2 row didn't give any spill over , it was EB5 and family based spill over.
    This year we will not get family but instead EB1 will give same share so in the end total spill over for year will not be more than 20-22k.

    You can dissect it a million ways from here to sunday, the fact of the matter is that EB 3 as a whole and E3 I&C in particular are messed up big time. We cannot sit twiddling our thumbs while we wait, most EB3s have supported most of the action items. What is wrong in exploring different options. we are not obstructing anybodys efforts. Vertical allocation or horizontal allocation doesnt matter, what matters for most is that there should be consistency in actions. They keep changing the rules every couple of months. if we know the number of people stuck in each category per year/per country we can come to our own conclusions and decide if we want to stay or go. There are greener pastures everywhere. Every year our lawyer tells us that its a matter of 12-18 months and you keep waiting...the only reason is that...we have been waiting so long, lets wait a couple more and see. i know some will immediately give comments like, 'leave sooner, one less family in the queue'..or..'port to EB 2 you ##$@'...to them i say i hope you are fortunate enough to avoid getting trapped in a situation like us.
