You are laying your own immaturity out there by rambling on and on about vague facts and statements only to make the same point again and again - that you think IV does not represent EB3. Why dont you state that one line and save us the trouble of reading your meaningless drivel??

Your RD cannot be mid September. That must be your Notice Date. I bet your RD (the date CIS received your app) is either July or August.
ty for the info. I guess u are way better off than me in that case, i've got a PD of July 06, and RD Mid Sept.... so a long wait..... for me.

This question has been posed before but I did not find answers so am posing too: When can one travel safely to India after applying 485?
1) If EAD and AP are filed along with 485, how long will they take to arrive. Service center dates indicate that EAD and AP currently at Jan 07. Does that mean that they are taking over 4 months to issue EAD/AP?
2) There is a an Interim EAD. Is there an interim AP if AP is pending for over 90 days?
3) Is it possible to request EAD/AP at a later time?
4) My H1B is up for reneval in Oct 07. Can I get a 3 year extension on H1, apply for a H1B visa in India and travel back to US on this? Would this be a faster option?
5) When do FP notices typically come out after applying for 485?
6) What is the grace period for FP if one misses the deadline (Is it still 12 weeks? Will the new rule to remove 12 weeks on RFE/NOID have an impact on FP?
7) If you are using an attorney for 485, will all such notices (FP, etc.) go to the lawyer as well. The concern here is that if the notice comes to my home address and I am out of the country then I am liable to miss that appointment.

The recurring payment is a nice idea, however the options are limited.
For e.g. I tried to revise mine to $25 from $20, there's no option to do so.
I will probably cancel this subscription and setup one from my bank.
$25, $50, $75, $100 are ideal amounts. I don't know if PayPal charges for each subscription option you create(I would think not).
Please chew on it and and implement, if you think it's good.

I think you can take info pass appointment and show them EB2 approved I-140 with priority date as Spt 2004. Last year I also converted my EB3 to EB2 but my lawyer filed I-140 and I-485 concurrently around Aug 2010 and USCIS rejected the application saying priority date is not current for the first time. My lawyer filed is second time with old fees stating that when application originally filed with old fees they again rejected and finally 3rd time with new fees they did accepted applications. For my case they approved my EB2 I-140 and 485 just same day....... and got my n my spouse's green cards... after painful immigration journey....

Another thing that I do:

the flyer is a word file and print several copies and keep it in your car. When you go for shopping, groceries, temples, etc... keep them in your hand and if you see someone like you .. (South Asian, Asian...) there is a chance they maybe retrogressed.
Give them the flyer.
Sometimes you will be pleasantly surprised to meet other fellow IV member and will make new friends.

This is a wonderful idea. Having waited for 10 years for green card, if one has to wait for 5 more years for naturalization (that allows one to vote in the elections), then it is indeed an utter discomfort. We need something like IV but with a different name: NaturalizationVoice (it would be envy -NV- of all in IV ;-)) to campaign for immediate ready-to-serve naturalization of highly skilled (like Saralayar, of course) permanent residents.. NV should also campaign for an amendment that would allow highly skilled immigrant turned naturalized citizens (eg. Saralayar) to contest as presidential candidates. If any such person wins, he or she could either ban immigration (at least for other high skilled people) or abolish waiting period for greencard.
Makes sense, like the idea of abolishing the waiting period for GC.... but with all due respect i belive that will never happen esp in a post 911 era where there is a lot of checks. I belive if they put the name check process in a fast track it would be benificial. Suks that we have to wait another 5 years after getting GC to get Citizenship, if anything i would think counting 5 years after 485 is logical.

Even if you succeed in changing the law and change interpretation of spillover, you won't see much difference in wait for GC.
Only EB3 folks who have PD in 2002, 2003 may greatly benefit by this. Rest of EB3-I will have to wait for atleast 5-6 years.
We should instead concentrate on Visa recapture.
I am not trying to hijack this thread or dampen your efforts. Just trying to infuse some sanity here.

American Families united is an orgalization that is trying to bring legislative changes to family related issue including the Age out issue. This is their website.

Its all about money, to get our voices heard thats what we need to employ a lobbyist, unless we happen to know a congressman or his aides
Have been speaking with Connie Mack's office who has a copy of my law suite also Adam Putman's office, seem interested.
We all need to write to our congress people to raise awareness.

I is only based on a law. In the past CIS used the law to implement one set of policy (horizontal spill over). Since the middle of 2008 CIS is using the same exact set of laws to implement a different set of policy (vertical spill over).
Allocation of immigrant visas is not a policy matter. It is based on law. Any change should come thro law change. Congress (&president) has to amend the law (INA) how to modify the allocation. It is not a simple matter. Both DOS and USCIS knows it unfair to keep EB3-IN in 2001; but they can't do any thing. Thats whu EB3-IN folks should try hard to make the congress to change the law. Contacting DOS or USCIS not going to help, as they have no authoity in changing the allocation methods (they only execute the methods).

My Attorney Applied my Labor in Last October 2007 It was denied in December 2007, Then Attorney again filed a new Labor application in december 07, 2007 Unfortunately In January , we received a audit notification for my Labor certi.... under business neccessity Reason ......... We replied on February ,2008, after almost 2.5 months theres is no any reply from Atlanta processiong center ........

Our problem is like a bus, stuck and needs a push. You may think "what will a single push from just me, do". I may think the same too. So we both and all who think alike will not do anything.
Instead. Do whatever u can. Here pushing the bus is doing your part.. write to media, reps, whoever you think.. I know many people out there who do this, I am one of them very dedicatedly doing it.. but these efforts are not sufficient. Dont wait for anyone to come and help you.
Again, you must be a fool to wake up suddenly NOW, and not in the last 5-7 months. There is nothing to hope for, with 2000 or 3000 cases approved every year. Simple mathematics.
I can imagine there are 90% folks who gave up, do nothing.. Dont do that.. even if its a small effort, yet do it. And tell us what you did.. That will motivate us, and I may do better.
