Hundreds of members visit this website every day. I am just really surprised that we are having trouble getting people to participate in Advocacy Days and raising $50,000. It seems like a no-brainer to me to participate in whatever way possible.
There have been around 250 contributions so far. Some members have contributed a few hundred dollars each, with a couple of members contributing $500+ each, and some have pledged $100 for every $2500 or $5000 raised, just to help try and reach the target. They wouldn't have had to put in so much if everyone else chipped in.
I am really curious to know why you are not getting more involved and at least contributing financially to this effort if you cannot attend the Advocacy days. You are the beneficiary. What is holding you back from trying to do something tangible to help yourself, your family and your friends? Are you seriously going to tell me that it's not even worth $50 to you?
This is the best shot we are going to have in the next two years.
I am not doing this for IV. I'm doing this for myself, my brother and my friends stuck in the green card mess.

It would be great if all those messages were from IV. But how do we know that our opponents are not doing the same thing ? Let's be optimistic though. Good job, IV members. Let's keep those phone calls going.
So I read that the amendment for recapture has been removed from the funding bill. Guess we are back to the start again? This really makes me to start hate the fact that we are held as the hostage of illegals

i assume this is for everyone, including citizens. you may want to make the legal part bold in the phrase "legal immigration". immigration automatically raises everyone's eyebrow but you need to emphasize that the fight here is for "legal" immigration. that is a key differentiator especially when nobody knows what the heck EB, priority date etc is.
Use the following as a template to send all your contacts via email!!!!
*not a chain mail. a genuine request to be part of a democratic US bill-making movement* call YOUR Senator and at least one from the list below *
i am writing to you with a rather 'unusual request'. thousands of high skilled legal immigrants (especially from India and China) are stuck for between 5 to 10 years in the 'Green Card' queue with no 'end in sight' due to a broken system. previous attempts by groups like Compete America (www.competeamerica.org (http://www.competeamerica.org)) and Immigration Voice (www.immigrationvoice.org (http://www.immigrationvoice.org)) have been rebuffed by powerful lobbies and special interests.
if you are able to help, know that thousands will thank you. if you are uncomfortable, i will fully understand and seek your forgiveness for this intrusion.
if you know someone that will benefit from legal immigration reform (e.g. graduate students, etc.), do pass this message along. again, this is NOT a fake chain mail. check out www.immigrationvoice.org (http://www.immigrationvoice.org) to see how those forgotten in the immigration queue are trying their best to make their voices heard.

if you can do more, please call your Senator and at least one from the list below with the scripted message:
currently, Rep. Zoe Lofgren from California, has introduced a couple of bills that can provide temporary relief to thousands of tax paying high skilled workers.
HR 5921 Introduced to eliminate per country limits
H.R. 5882 introduced to restore approximately 218,000 unused EB visa numbers.
HR 6039 introduced to exempt STEM degree applicants from numerical limits
In addition, the Murray amendment was accepted in Senate Appropriations Committee by voice vote today.
"OK, enough of that mumbo jumbo" I hear you say :), "what can I do?"
Tell them that you would like to talk to some one who handles immigration/legal matters, If forwarded to voice mail, leave a VM. If the VM is full, you can get back to the main line by pressing 0 and then leave a message with them.
The message you have to deliver when calling these offices is
I would like Representative "Representative Name" to co sponsor bills HR 5882, HR 5921 & HR 6039 sponsored by Zoe Lofgren. All three bills have wide bipartisan support in the house and will help reduce the back logs associated with USCIS. These bills are a great first step towards immigration reform.
DO NOT GET INTO THE LEGAL/ILLEGAL DISCUSSION WITH STAFF MEMBERS
Only if the staff member bring up the issue of CIR, in that case say that -
In the past we have been supporting Comprehensive approach and still continue to support comprehensive approach and we look for our our main issues to be addressed whenever comprehensive bill is passed. However, this is is just an interim fix to begin or start the immigration reform process.

SIMPLY PUT -- please consider taking a few minutes to call at least one of the above lawmakers' offices with the above 'scripted' message. I am not a script-driven person, but the dynamics of law making dictates that simple messages about support for a Bill go a long way towards helping lawmakers form their opinion. This is DEMOCRACY and CIVICS in action :).
Will you take a few moments to do your bit to help thousands of hard working professionals and their families? In 1 day, Rep Cueller from Texas has signed on as a co-sponsor after receiving numerous calls.
Steve Ballmer, Safra Catz, Craig Barrett, Carly Fiorina, Scott McNealy, Charles Vest and others all came together for... what?http://www.competeamerica.org/hill/letter_congress/index.html
we get tons of spam a day. lets take a few moments to help those that join us in contributing to the US economy through their hard work, taxes and social security contribution. of course, they spend hard earned $$$'s on wall st and main st. lets help them help us all.

Yes . Employers/lawers can check status.
Does anybody know any link that gives online status of PERM labor ? I heard that there is one for employers but not for employee.

D. EMPLOYMENT VISA AVAILABILITY IN THE COMING MONTHS
There has been no forward movement of the Employment cut-off dates for November. The reason for this is that it is still too early to see what impact the movement of the cut-off dates toward the end of FY-2007 may have on demand. Depending on the rate of demand being received from Citizenship and Immigration Services offices for adjustment of status cases, some forward movement of dates may be possible for December.

Thanks for signing up. The good part about these events is they are both Walking and running events so newbies should not hesitate to Join. We picked an event in Houston because Texas had the second highest number of letters for the Admin Fix campaign :)
I am in - along with my husband (and he is going to kill me for signing him up ...he he) for the Houston 5K run - lets start with that and see if I can finish..I'll take on more if I have success with this!
BTW, there is also a kids run for children ages 5 to 15 (K - 8) - my kids won't qualify for it, but those that have kids in this age group can truly train as a family.

I don't think it's an end of fight for IV or for that matter for us. Ability to file for I485 is just like getting out from one queue and standing in another big one. Once the folks who are stuck in backlog gets their labor will be in front of this big line as you know the priority date counts. Only advantage for the people filing 485 is an EAD, which I know is a big one. With thousands of people filing I485 in July, I believe EAD itself is going to be retrogressed.
Pls.....
Applicant1 with PD Jan 2007 PERM he files I485 gets EAD 6 months waits for GC
Applicant2 with PD Jan 2004 BEC cannot file for I485 gets his LC DEC 2007
in Sep PD will retrogress say to 2003. Applicant2 will not be able to file. Priority dates will not move again until everyone who has filed for 485 incl. applicant2 have been given a GC.
But u are right..pls everybody who getz a chance to file for 485 pls keep up the fight for those who are in BEC

Well I responded in Oct 2008 and it had RFE status. It didnt change for the past 2 years and it changed to "RFE Review" yesterday. Is this just a coincidence or something to extract out of it ?
For RFE rebuttal, it will remain in the same status until it is approved. You should have contacted them after 60 days of your rebuttal. But as of now, it is fine I guess.
My friend had very similar situation. His status remained as REVIEW until it was finally approved. So no need to worry.

I'm all for this. This is very close to my heart. I probably care more about this than I do, my 485 approval.(can't have one without the other, I know I know. But still.).
I don't know when I'll get my 485 approved, hopefully within the next year. But I'm willing to work on this, whatever it takes - contributions, lawmaker meetings, DC.
I'm in.
This has got to be simple too. When the citizenship law was first drafted, immigrants got their green cards within months of entering the country. Start to End of the greencard process took under a year, if not less.
The intention of the law was to have them learn the language, the ways of the country, and assimilate, which was expected to take about 5 years, before applying for citizenship.
These days the green card process itself take over 5 years for a lot of people. Most Indians and Chinese in the EB2 category, and pretty much the entire EB3 category have lived here longer than 5 years. In those 5 years they have gone to school here, paid income taxes, bought homes, and learned the language (well they had to, in order to qualify for an employment based green card!). What more "assimilation" do they need to do?
I definitely think that the following should be the criteria for eligibility to apply for citizenship,
- An approved green card
- 5 years of continuous U.S. residence starting from the date the 485 application was received.
Let's do this.
Excuse me, but what's 485 got to do with assimilation? It would be perfectly legitimate for people who are waiting for their dates to be current, following the exact same logic as above
People sometimes draw the line just where they themselves have just crossed it

BTW, today I treid calling USCIS. First the 1st level representative spoke and she straightway created a SR for me and my daughter. Once she finished that part Politely I asked her to transfer to an IO. Luckily without any wait call got connected to an IO. Had very brief conversation with him. He was fixated on my EAD being valid till August 2010, so according to him I don't have to worry about. But I persisted with my line of questions like current status, whether it is pre-adjudicated?, whether all clearances are done etc. Only thing he replied was "Your Case is in REVIEW". I asked him what does review means. His answer was review means review. Our conversation stopped there.
What do you guys think on "Your case is under review"?

Can you please let us know the procedure? I'm very much interested in filing a formal complaint with the CIS and Ombudsman. I'm not against genuine candidates getting their GC through MNC executive category, but would like to stop this malpractice.
You can email to Ombudsman at CISOmbudsman.Publicaffairs@dhs.gov providing all the detaisl. As a routine they ask to fill a form with your case particulars, explaining why something investigation should be done. Those forms are then sent to USCIS, who routinely give some absurd explanation.
In other words, it could help if there are lot of emails, or letters to Ombudsman (address and fax # can be found on their website - google for it). Emphasis should be on USCIS inefficiency, not following the sequence, PD's etc., if several example cases (via filling forms as they need those for privacy reasons). Give simple examples, such as in May 07, EB2-India cutoff was April 04, now in May 09, it is Feb 04, whereas in the meantime many with PD's in 2005 and 2006 have been granted visas. Why?
Note that PD's, a very important critieria for retrogressed country cases, are not anywhere other than the paper applications. Therefore, USCIS/DOS have no way to know who should or should not be processed next. They claim that they process cases in order they receive (paper filings). By processing, they mean they check all docs (birth certificates, medicals, photos) AND Priority Date currency. If at the moment your file is being looked at, your PD is not current, it is put aside. This completes their processing of your case, and they move to the next one. What happens to cases put aside in this way, is not defined or clear. In last quarter, they ask permission to work on larger number of cases (which they get via widened PD cutoffs). unfairness is evident with this process.

I heard the following on the southern california talk radio. They mention that there are some blogs that speculate on how and what the conference will compromise. I am searching for the blogs they mentioned, i will post the link if i find them or if it is relevant to work related immigration.
"The current compromise being negotiated (or idea being floated) is based on a phased induction of the 'amnesty' program. based on certain verifiable checks and balances on the border and employment verification issues that will satisfy the conservatives. They also mention that it will take 3-4 yeas to set up the infrastructure to handle the increased workload. The undocumented workers will be able to apply by 2009 or so" nothing was mentioned about H1 and EB related issues.
