Well, I am just stating facts. Just because you dont like them, I cant help it. You got to learn to move on. Agreed on your point. But there are other discriminations at workplace such as , age, race, sex and sexual harrassment. Those who complain about it effectively terminate their careers. I had the same issue...
Here is the short version of how it unfolded. I've seen some quick responses from USCIS.
9/15/2010 - USCIS email indicating that cards mailed for both me and spouse
9/16/2010 - Spouse received card
9/21/2010 - Got email (LUD) that my card returned undelivered.
9/22/2010 - Called customer service updated the address
9/23/2010 - Got my card in mail (wrapped in an usps priority envelope) with tracking number
I was pleasantly surprised with the fastness of USCIS.

Hi,
We have already made plans for our India trip. We will be leaving US on June 2nd. Can we apply 485 on June 1st and leave to India on June 2nd.
Will there be any complications around this.
As we will be returning in July, we are not sure if my PD will still be current by the time we return back.

It seems the popular perception is that this is an Indian effort.
We need to correct it.
It seems some of the members who interviewed with the media got carried away with "Gandhigiri" and all things Indian. It sounds ironic, we are craving attention from Indian media while trying to become Permanent residents of USA.
I don't think we should read too much into it. IV is obviously not an all Indian forum but the entire idea started with inspiration from an Indian movie and almost everyone that reporters have spoken to is an Indian. So it is easy to take away that impression.
It's not always possible to cram every fact and our every grievance in a 500 word report that needs to be understood by readers who might have not even heard the term green-card.
We need to correct it.

Type in congressman your city name in google or yahoo search. It will give you various names for your senator and congressmen. Call them and give them your name FN LN, DOB, Alien number and fedex / delivery tracking mnumber. They will call you back with relevant information.

I totally agree with you. H1b and employment based GC's are so intertwined that they are almost inseparable. For example, you can get H1b extension based on your pending/approved PERM labor or your approved I-140 application. So, any change to H1b will in some way impact the GC process. I'm all for closing the loop holes in H1b provided certain reforms are also made in the EB green card process- like removing per country quotas and may be give EAD upon I-140 approval.
But do you believe they will do any good for us or they are really interest to protect us. Their aim is to divide and rule.

In my opinion it is very naive to think that USCIS/DOL just realized that they had 'misinterpreted' the law. ..... The ambiguity of the law for the preference of vertical vs. horizontal spill-over allowed them to do that.
In a couple of my previous posts I copied the relevant Sections (Sec. 202 and 203) of the INA which specifically states that distribution should be preferentially horizontal. Both Sections should be read together.
Please note that there is no ambiguity in the law and DOS may just have taken too long to change the US Code or other relevant section of their rules.
I will definitely be willing to change my interpretation if you can show where the ambiguity in the law lies. I'm definitely not a lawyer so it's quite possible that I'm missing some clause in the law.

Hi All,
I received the CPO email yesterday.My case details are PD : Dec 2004, 485 RD : Aug 6th 2007(I140 Filed concurrently),EB2 India.140 was approved on Tuesday.
I140 was pending from 2007.When my attorney followed up in feb this year,USCIS gave the standard reply of waiting for 6months.After that they said,they will update in 10 days.They didn't update even after that and then i moved it to premium processing on Sept 28th.
Took 2 info passes in Septembter(regd i140 mainly).First one was not of much help though the officer told my 485 is assigned to IO on Sept 8th.Second time it was different officer and she was very helpful.Tried looking why my 140 is getting delayed but she said ,if she opens my file then 485 file will go back to review queue as it is currently being reviewed by Sept 18th.So she didn't recommend doing that.I didn't open any SR after my first experience of 6 months waiting(without an result!!!)
Before 485 approval day(i.e Tuesday) i called IO TSC Center but he doesn't know anything when i mentioned that my PD is Dec 2004 & that my case is current from last month.,he told my PD is the RD of 485.I thought no point in arguing with him and hung up.After that i was preparing to send mails to Senator but got the approval before that.

If clerk is doing this as per instruction means, we are being noticed and that is precisely what we wanted anyways. I don�t think USCIS higher ups have any malicious intent. Whole issue may be due to lack of training of IOs.

I am tired of short term projects and I started my FT job search in March first week, got 2 offers, both companies are fine with EAD. Only question HR asked me is, "your EAD expires in Sept,when are you starting the renewal process?" I told her that I can apply for renewal only within 90-120 days time frame. She was fine with my answer and also mentioned that she is aware of the fact there is some time line for EAD renewal.
I'll be starting my new FT job from Monday.
So bottom line is there are some HR people who are well aware of EAD and the strings attached to it. You are definitely going to meet them sooner or later, don't loose hope.
BTW why am I using AC21? - my PD is March 2006 (EB3 India), so I decided to use AC-21/EAD, as nobody knows how long this GC journey is? I am already in my 8th year of H1.

There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?. First let me state that I need people like you to proceed and hence I will be happy to answer the points you rasied to the best of my ability:
We all agree that there is severe backlog. Only way the backlog will alleviate is by increasing visa numbers, which not going to happen any time sooner.
So some people (and I know around 10 of them) what they are doing is the following:
They got the chance to file their 485 last July , which is pending. They are now contacting several small desi consulting firms to file for their fresh labor in EB2 category. Once their labor is filled and new I-140 is approved, they plan to attach new I-140 to the original 485 and hence effectively convering to Eb2 category but with priority dates in 2002 and 2003 (because original I-140 had that priority). Worst, they would never join that desi consulting firm...
This how the system is being gamed. If I know 10 such cases, I am sure there must be thousand like that.Now you tell me , isn't that unfair to the people already in Eb2 line as well as the ones who do not know how to game the system

To know the reason for that you simply have to see past visa bulletins to know how long 2001-March 2004 PD's have been current... the answer is: for a long time in late 2007 and mid-late 2008.
