[QUOTE=Das73]It's always a good practice to take a receipt notice of any action done by your lawyer & keep that for your records.
When you apply for EAD, soon USCIS will ask you to do fingerprints(BIO-2). I think you missed that part and it might be denied or void as it was left for so long!
You can file for new EAD online at https://efiling.uscis.dhs.gov/efile/InteractionMgr?interactionmgr.interaction=SetupEfo rms×tamp=1127234762990
Create your account & you can file your self with out lawyer's assistance. It's always suggested to file EAD(I-765) & AP(I-131) jointly. You can pay by credit card.
(1) After applying online, you will receive 'Receipt notices' of EAD & AP.
(2) Now a days USCIS will set up an apointment for BIO-2 of EAD.
(3) You have to send supportive documents for Advance Parole, like photos, brief explanation of qualifying for AP...I can give you those sample formats !
Coming to I-485 BIOMETRICS, call USCIS & ask them about BIO. Go to this website & register https://egov.immigration.gov/cris/jsps/index.jsp. You must add I-485,EAD,AP & I-140 receipt numbers like LINXXXX and you will get emails when they get approved. You can also see the changes on 'LAST UPDATED' column, which means your case is touched by an officer. But it's not the confirmation of approval until status message has changed or you got an email.
Go thru these 2 links & familiarize well. Hope your I-140 has approved. Finally these are suggestions only & I am not a lawyer. Consult an immigration lawyer if you have uncanny issues.
Goo Luck.

Thank you for your reply Mr.Das
1) My I 140 was approved
2) I just got my Bio appointment and i am all set with that. i received 1 week after the appointment date but we just walked in and got Bio with out any problem.
3) MY EAD is the only problem
As i mentioned it has been almost 2 years and its still pending. i gave my biometrics at that time and i received my AP for me and my husband. My husband (dependent) got ead but not me

I have two labors
PERM EB2
Labor: Certified
PD: Dec 06
I-140: Filed in Premium Processing on May last week
RFE Received: June 1st
RFE Response Sent: June 6th
Status: No updates from USCIS
I-485: I can file based on the pending I-140
========
RIR EB3
PD: Jan 2004
Labor: Noy yet Certified. Based on my case analyst at DBEC it should be certified by June 30th.
==========
Question:
1. If I file I-485 with EB2 labor. Can I use EB3 PD later for getting GC faster?
2. Does PD matters once I-485 is filed?
3. If I file I-485 with EB2 and then due to some reason my I-140 gets rejected what options I have?

I dont think it's true, I saw these rates are under international calling plan, so we are not signing up to that plan, so I would strongly believe that all cell phone calls are included to India, the same thing you can see when we click on the 60 countires list.....so find out with the tech support guys and keep update here to get the accurate answer on this...
I just spoke to customer service .they mentioned all cell calls to india are free under this WORLD plan.who ever is signing up , can proceed , can call customer service to confirm this as well to avoid any surprise charges

I'm wondering if these figures actually provide ammo for people who claim that H1b is driving down salary. A $50k median starting and a $60k median is not that great.
It's not too far off the mark. The median for initial employment is likely skewed by all the college hires and new arrivals. The $50k median is not too far off the mark from the $53,000 median reported by UIUC for 2005. The median for continuing employment is quite respectable at $68,000.

If it is for applications money, they might as well make it current.
There are not many applications between Jan2008 and jan2011
Cumulative
Demand Prior To China India All OtherCountries Grand Total
January 1, 2006 0 0 0 0
January 1, 2007 4,200 13,200 0 17,400
January 1, 2008 9,725 22,950 0 32,675
January 1, 2011 9,800 23,050 100 32,950
http://www.travel.state.gov/pdf/EmploymentDemandUsedForCutOffDates.pdf
That's because the existing cases have not had a chance to file their I-485 and therefore are not visible in that report. Does not mean they don't exist. My case is a perfect example of that. I'm not counted in that report but I certainly exist! :-)

I do not think so, as our message goes along with the flowers. So I really doubt whether USCIS has patience to remove those message tags before sending them to the Hospital.

This is a very good news. Kudos GC4Me, PD_Recapturing, ItIsNotFunny, NK2006, AkhilMahajan.... everyone.
I received a phone call (WOW!) from a sweet lady from CIS Ombudsman's office. I sent letters to his office and in the letter I mentioned my cell #. Anyway she wants a real person who got deniel. I told her that my friend got deniel (IVens are my fried). Anyway, she sent an email too after I asked her to give her info so that my friend can send her his case details. Unfortunately, the email I received shortly after the conversation, looks like general and does not have her ID. Please PM me if you like to hera more about the phone call.
==================
Thank you for your correspondence to the Office of the Citizenship and Immigration Services Ombudsman (CIS Ombudsman).
We greatly appreciate your comments regarding issues concerning the American Competitiveness Act in the Twenty-First Century Act of 2000 (AC21) processing at the service centers. What Mr. Aytes have proposed is too narrow. He is proposing that applicants whose application is pending due to Namecheck delay will not get the benefit for multi-year EAD. This is not what the current rule says. So asking for implementation of the current rule means asking for multi-year EAD for all I-485 applicants, not depending on whether or not Mr. Aytes is having a good/bad day.
There is already a standing rule since 2004-5. It is now 2008 and he has not implemented multi-year EAD rule. Given their past record, I would prefer that we not depend on their good heart for implementing this change.
One more thing, when thousands of people will write letters and something will get done, orgs like AILA and lawyers like Murthy will claim that they got it done for us :-), for our sake :-). Just wait and watch..... ;)
I think we should not mention the bellow point in the letter which we are going send to the president.
According to Mr. Aytes, USCIS is already working on it. Why to mention it in the letter?
That will rather give anti-skill-immigration crying babies one more thing to cry about.
Now what? Under the new filing fee schedule which took effect after July 29, 2007, issuance of EAD and Advance Parole for the post August 27, 2007 is "free, free, free" for the I-485 filers. Allegedly, the cost is incorporated in the I-485 filing fee of $1,020. The new regulation uses the term of "fee waiver" for EAD and Advance Parole for these I-485 filers. Now, you guessed it! Lo and Behold, the business calculation on EAD and Advance Parole has reversed. The DHS will lose a huge money by issuing single-year EAD and a separate Advance Prole document on a yearly basis over and over since they are free and they will have to keep producing it at no charge every year, which creates a huge workloads consuming its huge human resources and other production costs. This is particularly unacceptable to the agency under the predicted State Department Visa Bulletin for FY 2008 and in the future. Now, from the business standpoint, the DHS may make a huge money by issuing a multi-year EAD which will also function as a travel document. Ahah! No wonder why they are finally coming forward revealing their hidden agenda behind the new fee rule-making and EAD/Advance Parole reform business. Reportedly, Mr. Aytes of USCIS disclosed in a New York AILA conference that the USCIS was currently working on a single multi-year EAD card that will also replace the Advance Parole document. What a smart calculation it was in the new fee rule-making action

One question to all the smart people on this forum:
In the old system, if EB1, Eb2 and EB3 ROW are current then "all" unused visa from all the EB category be given to which category first:
a) EB1 Non Row
b) Eb2 Non Row
c) Eb3 Non Row
d) None of the above
Now second part of the question is :
If that category already has enough people in line, will the spillover to the next category will take place:
a) Yes
b) No

Can someone please explain:
If husband-wife are both on individual h1bs, and they want to file, say, based on the husband's labor/I-140 application, then should they be submitting an employment letter for the husband and copy of his employment letter for the wife? Or, do they need to submit the wife's own employment letter along with his applicaiton since she is also individually employed on an H1b?
Thanks!
Edited:
* Employment Letter - on employer's letterhead. This letter should confirm that the job on which the visa petition is based is available to you and it should mention your salary.
.. I think Pranju answered this question.... seems like we have to submit the employment letter of the person whose petition is being used to apply for the 485. Thanks!

The corporation can always say they have a policy to not hire someone with temporary work permit and there is no law against it. It is sad but that's how it is.
I don't think so. EAD is a valid form of employment, just like a Greed Card. If it is not then why certain employers hire u on EAB and why crtain do not?
It is just a matter of filtering out by claiming policy.
Most times, the hiring manager never gets into these things. Hiring manager is more concerned about skills and about how a peron fits the job best, but then in big corporations a lot of nepotism works (which is a different topic altogether and we can discuss nepotism in a different thread). It is the matter of how resumes are presented to the hiring manager and how the manager can be influenced prior to submitting the resume.
If a reqruiter or a HR starts fussing about ur resume and goes back and forth about EAD etc.... ur resume is never even going to the hiring manager no matter how much you convince.
In one instance, when I applied for a job, the reqruiting agency did all the initial crap discussion about skills, visa status etc..... after 2 days she gets back to me and first question is, "I know you are past 180 days on EAD, but can you tell me when you will get a Green card", I told her "I will get it anaytime and will continue using EAD till then". She said "Oh great". Then after an hour she calls me back "I just noticed on your resume that you have 2 short term projects, we place people in these companies and they stay for years together" , I said "contract projects can be short term/long term and there were personal reasons for me to hop these projects but you are most welcome to talk to the managers who I worked with", she dais "Oh absolutely not a problem". Then after half an hour she calls me "This work location may not be the best for you especially because you have to pay a toll on whitestone bridge, would you want to consider something in Manhattan?" I respond "Toll is fine, please go ahead and submit". Then she responds "Hmmm, ok".
I did figure that she did not want to deal with EAD but she was taking me on a roller coaster going back and forth. she never submitted my resume to tyhe hiring manager.

Writing a letter to the President urging him to implement reforms to help our community will not have any consequences in a Free, democratic country which guarantees freedom of expression to everyone, including citizens.
If writing a mere letter puts you in trouble in any country, then that country is not worth living in.
I alreay sent mine and my wifes. 2 for President and 2 for IV.
