    This is my case in brief:
    I resigned from company A (who sponsered by RIR LC, and I-140) about a year back.
    Filed I485 using approved 140 of comapny A in July 07, in the485 application we mentioned the details of the current company I am working in. Got EAD and AP approved. (Company A's management is co-operative and supports me to take back)
    Also got 3yr H1b extension approved for current company based on the approved I140 of company A.

    Now Iam traveling to India. Had an appointment in Chennai consulate . My previous H1B visa expired in 2004.
    Will there be any issues with that much gap 4yrs, in getting stamp?
    Is it an issue not working for GC sponsoring employer?

    If I use AP what are the issues?
    If asked at PoE (Newark EWR) why not working with company A? what should be better answer?
    Please respond.

    I am not saying that we are reporting fraud just for the sake of not tolerating it. This is effecting our GC. Earlier the effect was related to the job being taken away now it is effecting our GC too.

    Initially L1s were sponsored only by large offshore companies like TCS, WIPRO etc.. The effect was that the jobs were taken away. But it did not have much effect on the GC side as most of these large offshore companies do not process GC for their employees.

    But nowadays lots of small Offshore companies started doing L1As. These companies do not have lots of clients like TCS or WIPRo but they have a handfull of clients. So to make sure they have their clients they started bringing people in L1As and processing GC under EB1 for them. Although many of these people are developers and should be in EB3 and should be behind in the line. But as they are in L1A and are appling in Eb1 they are getting GC in no time and also taking the visa#s away. There are hunderes of these small offshore companies started getting people in L1As. Thus these EB1 Visa #s are not overflowing to EB2. This is effecting our GC.

    Now we have :
    1. Large offshore companies sponsored L1s taking the jobs
    2. The small offshore companies sponsored L1s taking the GC visa #s.

    If the L1As are indeed senior Manager then no problem, but the Developers/Business Analyst/ Project Manager without hire-fire authority are getting GC under EB1.

    Thus these frauds should be reported so that at least the # of EB1 visas are not taken by fraud.

    So you too can see how this fraud is effecting us all.

    Do you know why we are having GC delays ?

    1. Country cap for visa numbers
    2. Visa numbers wasted by USCIS by their inefficiency

    EB1 visa never belonged to EB2 or EB3 category. What if there were enough genuine EB1 people to claim all the EB1 visas. There won't be any spillovers. Spillovers are bonuses. It is never our right to claim those.

    If you want your GC faster, work with IV for country cap removal and recapture.

    Have you donated a single dime for IV's cause ?
    We always find it easy to go against fellow immigrants than fighting the injustice at root.

    I think, you meant earlier. No I won't because it won't yield anything. Its water under the bridge.

    I did mean later not earlier! It would yield you your GC! Most GC approved this month so far has gone to people with PD 2006. One of those is possibly yours!

    So go ahead and file a lawsuit.

    No one can travel on EAD. EAD is for employment authorization. AP is for travel. You cant mix and match the purpose of them.

    If you dont need to travel or if you have a valid H1 stamp for travel, dont file for AP. If you want to travel and if your stamp has expired and dont want to apply for new stamp, then file for AP.

    If you want to work for your employer and continue there and if you are sure of your job security, then you dont need EAD, and dont apply for EAD. However its a good idea since EAD is a great option of you are suddenly fired or laid off. EAD makes it easy to search for jobs coz the employer doesnt have to file your H1 and you can join them immediately without any hassles.

    Can you please provide me insight on my question?

    My company filed for my I485. i didnt file the EAD / AP at that time. I have a valid H1B stamped for multiple entry till 2010.
    So, as per your post, I can apply just for EAD, right? That is if I want to switch jobs after 180 days using AC21 and if I start using my EAD, can I go out and come back with my valid H1B stamping? Or do I need to have the AP since I have started using my EAD??
    Similarly, can my wife use her H4B even after she starts using the EAD instead of AP when she travels??

    Any help is greatly appreciated.

    Most makes sense but I don't think any candidates wait for their companies to file for EB1. EB1s can be filed by the candidates themselves. Right? All in all, if this happens, it will be good news for atleast a couple of 1000 EB2-I. :D

    EB1A/EB1B does not need but EB1C needs employer and was exploited by the Indian companies to the max. possible extend for the so called global managers

    wow...u guys have made my decision easier...better to go via ny directly to mumbai

    I have flown on Continental from Newark to Mumbai non-stop. The best international flight experience so far! I bought the ticket online at their website. Guess what! It was almost 60% the price of lowest price travel agents were quoting on other airlines!

    The flight is a bit long lasting just under 15 hours. But, it leaves at around 8 PM. After an in-flight dinner, it is bedtime. People who have taken overnight bus journeys in India, this is not much different. If you can manage to sleep in that half sitting position (I cannot!) then it is that much better. You wake up, eat breakfast, spend 3-4 hours enjoying their inflight individual entertaintment unit, and soon it is time to land in Mumbai.

    There is no hassle with food either. Indian veg is part of their standard offering. So, no hassle of ordering AVML and hoping that they will remember to serve it to you.

    The down side:
    1) The length - at 15 hours (16.5 hours during return), it can get too much.
    2) The service is as bad as any US domestic flight.
    3) If you do not live in Mumbai or Delhi, your journey would not end with this flight.

    I see that more airlines are moving towards this long haul model with flights lasting over 12 hours. I think it is great, because we avoid all transit hassles, such as security, transit visa, etc., etc.

    Soon, AI, Jet and Kingfisher are going to enter into this market. Hopefully more cities in India will connected to more cities in US this way.

    I agree we might not always have hard evidence unlike the OP here. And lot of employers might be doing this. I have never faced this, yet. However, we have to act on it. The first step is to complain to the govt. Maybe if there are lot of complaints, govt will investigate and find the dirt, and fix it.

    Another idea is to bring it to the attention of the job boards that discriminatory ads should not be posted. Lets give this a try.

    To those effected, write to the govt if you are in a situation where you can.

    I will once again be writing and sending posters to all the reps. This is one of our chances where we can get closest. If we miss this then there will be lots of uncertainity. Imagine we already missed it. See how desperate all can get.

    We have some time, Lets all spend considerable time this weekend, get bigger charts, use lots of good eye catching color, make our voices heard. Spend considderable time this weekend on this, please. Together we all can make a difference. Please do your best and spread this across your friends also who are waiting or have got their greencards. This one thing sucked up so much energy from so many here. Please support EB2 and EB3.     ummm...not sure what that means....are you saying 'american' people can give you better advice on this matter "of leaving the house because you are moving for a different job" than 'desis'.



    Are you sure you have a job, a house and have the capacity to get to work without needing assistance ?
    Your simplistic explanation about ARMs Vs length of ownership of the house, decision to 'leave the house' because of a job (whatever that means, did you lose your job or did you find a better job or what ?) is just incredible.

    How much down payment did you make ? Won't you lose that amount?

    Here is a conversation I had with a co-worker recently:
    Co-worker took a 3/1 ARM and bought a house which is beyond her means. Now the rate adjusted to a crazy amount and she is finding it hard to pay her mortgage. She blames everybody from her broker to banker to Obama to Paulson to foreign workers.
    Rationalizing to suit your needs is a fallacy. As a grown up you have to own up to the decisions you make. Running away from your financial commitments giving simplistic rationalizations will get you into deeper trouble.

    Anyways, my own interest in this discussion is what sledge_hammer nailed, people like him/her and I pay for your greed.

    Where did I say that american's gave better advice than desis. I was just trying to compare mentality of two diff community for a same situation.

    I am not saying we initiate a strike or something like that, just gather together to have some (ideally at the same time) rallies to get media's attention. It even can be done at weekend. Say we can have 1K demonstrators at five big cities each across the nation - it must be something.
    Afetr all, we are legal immigrants and our voices should be able to get delivered LOUDLY.
    The only thing concerns me is the traffic of this web site, I sincerely hope someone can forward my post (not necessarily the original one, a better version) to some immigrant web sites so we can work together.
    For me, I live in NJ, I have no problem driving to NYC on a Saturday morning to tell people what has been haunting us and is going to be haunting us for a long while.
    BTW, imagine such kind of rallies happen three times a month - it's gonna blow!
    We are SO DAMN OVERLOOKED!

    I was reading Murthy's FAQ on AC21 she did in 2002. Read Question 6 carefully. Revoking I140 was always an issue, may be never surfaced!
