Both of you can apply 485 based on your own PD but do not apply the other as dependent 485. That way you are not taking any chances. The only dis advantage is both of you will get GC at different times as they'll be processed independently. Both of you will have two chances with either one in the long run!!!

Mr East India is so EB2 intelligent that he does not hesitate to give a lecture to the dull EB3 guys. Here is a lecture to you from a lowly EB3 worker. He pompously states that it is the job requirements that classifies the job as EB2. But completely glosses over the facts that most of EB2 job certified as such, really do not require a mandatory Masters degree. This is where the slick lawyers come into play by tailoring the job as EB2. Most of the American colleagues of the so called EB2 advanced skill "inventor" do not have a Masters degree doing the same job. Also, most of the Masters required job ads are found especially in our nurturer of highly skilled programming "job shops".

Spoke to NSC yesterday morning. I was told case is with an officer and you will hearing something soon. Not sure if this is a standard answer or not. I have seen other posts where ppl were told their case was under extended review etc. etc.
When I called USCIS by POJ method they said it is infront of an officer, Is it a satandard answer for every one?

As you landed on H1 and converted to EAD, you need to enter PAR: PAROLE for your current status.
And previous receipt date/s needed for their perusal proof of previous EAD successful approvals, so that they c'd approve the current EAD without much proofs.

You can use that labor. Here is how you would proceed.
Comply with the advt requirements and whatever else is pending - in couple of months you will have your old labor approved - once old labor is approved , just follow the process normally as you would do.
Since both labors were filed in same category , you dont need to do PD porting or anything. Life is pretty simple for you ( wrt PD porting ).

I called congressman Hinjosa's office.
The staffer asked me where I am calling from. Then said you are not a constituent of the congressman and was not willing to transfer to the person who handles immigration issues. I insisted on leaving a message and he took the message, but was surprised, did anybody else encounter this? How do we handle this if it happens with other congressmen?

Can i file it myself ? i did talk to a lawyer and she said we need a document from a company saying that the position is still open before we can file I485 by myself.

Unfortunately your lawyer is correct. You can't file 485 (even if you have copies of labor certification or I-140) on your own without a letter from your current employer explicitly stating that the position posted in labor certification will be open at the time when you get your green card.
