I have followed the activity at this site for a few weeks now. The Indian community in the US is probably the most well to do and educated of all the minorities. Yet history repeats itself. Most are more concerned about esoteric subjects, nuclear treaties etc than the plight of the people here from their own country. If all the Indian community naturalized or not would stand up for this cause, people would listen. They would be forced to. But as always divided we fall. Somehow once this dash for permanent residence is over for people, they not only lose sight of their own struggle but also of the thousands of others involved. How many members on this site are actually green card holders or citizens?
I do hope that everyone here endeavors to contribute with the same vigor ever after he or she has obtained his permanent residence. Immigration will always be a struggle and all should be united for the people who will come and face this daunting task over the years.

There are 300k Applicants(conservative number) stuck at various stages for immigration relief. All of us want a reasonably fair and a little faster adjudication but none of us want to contribute, raise our voice or be heard.
We are legal-tax paying, high earning, skilled immigrants (would be- permanent residents and future citizens.) who contribute trememdously to this economy, and we are employed by employers who did not find suitable citizens in their cities/counties. NOW!. If we do not organise and get heard! we are the ones to suffer. "squeaqy wheel gets the grease".
Shame on us, If we cannot talk to other people just like us who are stuck, how can we make ourselves heard to the majority at large. IF we are not bold enough to invite our friends to join IV, then maybe we ought to get stuck in this mess.
It is time to act, organise ourselves. Time to invite our friends to join IV and make them aware and encourage them to participate in the activities like writing to editors, raising awareness, joining state chapters and fund raising.
Lets add atleast one more friend.

I dont think it is as simple as that. I feel they have a bunch of pre-adj files and they take a "one last look" at it before approving.
If cases are preadjudicated and approval is just matter of of running script to identify probable applicants then we should see all(Based on number VISA availability) the Approvals today only.
But that seems not the case.
So what is their Process to handle Preadjudicated cases?

Specifically it is much serious condition for people from India, China, Philippines and Several such other countries. Above group is formed by people who came here on student or H-1B visa. They are trying to fight for immigration reform for highly skilled immigrants. No one talks about improving immigration situation for employment based highly skilled immigrants. Those very few from the business group who talks about highly skilled, are only interested in increasing H-1B, so that they can get more educated employees. But if you work on H-1 you will know H-1B has several limitation like inability to change employer, spouse can not work etc. So it is very important to get Green Card as early as you can, if you are on student or H-1b visa.
In current situation even if you are wise and quick enough to decide to act quickly for green card, you can not do any thing except sending papers to USCIS ( INS) and paying their fee and wait endless till you get frustrated and depressed. If you are waiting for your green card you already know it. If you have not you will know it soon. Green card is almost invisible for Highly skilled immigrants from India, China, Philippines and several other countries residents, because of backlogs, country quotas, FBI name check delays, Labor Certification delays and backlogs etc. (Some of these words may be new to you. )
Employment based green card for highly skilled immigrant fall in EB-1, EB-2 and Eb-3 categories. Even if you have PhD and university job , you do not qualify for EB-1.
and that is only open category. For Eb-1 you need tenure track appointment at University with several years of experience, around 20 research papers and several international awards etc. Those who apply for Eb-2 or EB-3 or NIW ( national interest Wavier) should not hope for green card in next five years under current situation
This excellent group of people comprising of many bright people from India, China and many other countries around world, is very active in Washington D.C to change the above situation in our favor. Though it was formed in 2006 only it has around 10,000 members. All of them are fighting for our green card.
I urge you to take look at their website. I am sure you will be impressed by the work they have done in last one year for highly skilled immigrants. They have already established strong political contacts and are using lobbyist to pursuer changes in laws in our favor. This is right time for you to get involved with your future green card process by supporting this organization so that they become successful in their mission.
Before you go through their entire website, I want all of you to register just as a member. So that they can increase the strength of organization. You all might be knowing that In Washington D.C every thing works based on two numbers, votes and economical. I want them to succeed for my, your and future highly skilled immigrants benefit. Remember they are fighting for our green card, which will give us several more rights compare to our current immigration status. It is better to contribute to them rather than paying several thousand dollars to the lawyers. Lawyers just fill forms (you need to check that three times before submitting !!!) and never promise to get you anything. I agree with you that this isn't just fair to people who are stuck in DOL. People who have been waiting for years together will continue waiting while people who got their PERM approved as recently as this year will file for 485. Where is the justice in this? I guess DOS & USCIS have not clue what they are doing as far as the PD's are considered. Couple of months back they had retrogressed as far as 2001 (EB3) & 2003 (EB2) and now they have all become current. How can this possibly happen?
Few of my friends purchased pre-approved labors paying thousands of dollars (which I don't approve anyways) and now they feel cheated having wasted the money for nothing.
I am happy that at least the recent applicants do not have to go through the ordeal which most of the members of IV had to deal with for few years now. My sincere hope is that they value their GC as much as people who have been stuck in this backlogs. It would be a very ungrateful of them, if they think that getting GC's is a piece of cake and it can be obtained in a year. I hope & pray that PD remains current for few more months so that people stuck in DOL have an opportunity to file their 485's soon.

But would you rather have seen USCIS waste over 40000 visas by the end of the year without any PD movement (as reported by some on this forum)? We would have had another thread here blasting the inefficiency and unfairness of USCIS.
Bottomline, I would not like to work in USCIS right now.. They are basically damned if they do, damned if they dont. That said, I do hope that BECs get their act together like USCIS is trying to and get everyones labor cleared by the deadline before the next retrogression hits.

I need to go to some place where I can spit out my frustration. This is just not done. Completely unfair.
With a user id that you have and your comment above :D, I think people might take you seriously. Take it easy buddy.:) I might not go to the mall today as I was planning to and stick to home.
Life has lots of other issues,so while the GC is important it cannot and should not come before all other problems in life. Talk to the people who have been diagnosed with cancer or something else and have been told that they will live 6 months at the most, you'll understand what priorities in life are.
I do wish it was Friday today then could have downed a few pegs tonight :rolleyes:

It looks like you are aware of some USCIS internal policy that is not known to all. I used to think that the policy was based on the per country quota for each category. Maybe you can enlighten us all. What is the acceptable gap in PDs between EB2 and EB3 for AOS approvals? In your example it seems to be less than 4 years. Can someone with a PD of 2005 (EB2) get approved before another person with a PD of 2001 (EB3). Since you seem to understand the policy so well, could you please explain it in detail with specifics?

You are bringing nothing new. Kid waiting in India for his first flight to USA know that. You have to have a eye to see the big picture. One other option you can pursue is to just go out of the country (Canada/Mexico) immediately after quiting your job and get H4 stamping and come back on H4....I would advise to talk to a lawyer regarding the first option.....Good luck with your MBA...
