    Sir, I came to the United States of America 8 years back. I graduated from <xyz> University with a Masters in <XYZ> and started working for <ABC> company where I hold the position of <ABC>. While in many respects I live the American dream of participating in a thriving economy, the dream is still incomplete because I cannot buy a home because the lenders do not consider me as a viable risk considering my Employment Authorization Document is valid for 1 year. According to them I am a risky prospect although I can easily put down 20% of the house value and have a stellar credit rating. This weighs on my mind heavily and many people I know are contemplating moving to other economies of the world to take advantage of a fairer immigration policy. In other circles I am also aware of developing nations trying to lure back their citizens to boost their Research and Development potential.

    This is the same draft (I just changed the Dear.... senator./congressman/USCIS Assistant Inspector) for each and every email I sent out.
    Congressmen& Senator needs faxed copies with Date and Sign on it.
    Yes the same to the USCIS dept also. I got replies from Senator and Congressmen.. but nothing coming out of USCIS tight lips.

    Talking about travel experience, here is one I had at the CDG Airport in Paris..

    I was flying back this Dec 31st, 2007 from Dubai and had a 5 hour layover at CDG. I had to go to a different terminal from the one I landed in... and that meant going through security check again at the new terminal.

    I placed by carry on backpack on the x ray machine and I was waiting for my bag to at least start moving before I walked through the metal detector. While the ICTS (pvt company) security agent on the othe side signalled me to walk through, i said (in English) that I would like to wait till the bags get into the X-ray machine..

    This did not sit well with this ICTS Agent.. He walked past the metal detector and proceeded to shove and push me past the metal detector.. (I forgot to mention that I had knee surgery ~ 20 days back to fix an ACL injury)

    I could not believe that I was shoved past a metal detector.. I said to the ICTS agent that he had no right to shove me and I asked to speak to his supervisor.. This made this so called agent more angry and he started to threaten me repeatening "you want to report me"!! His immediate supervisor said that since this was a security issue nothing could be done.. Not willing to give up, I asked to speak the head agent there.. He was a bit more helpful.. he gave me a website and a mailing address where I can write to..(with the details of which gate and what time I experienced this)..

    I kept repeating to every supervisor that I did the right thing and their agent did the wrong thing by shoving me..

    I was not satisfied with just some addresses and website for the terrible way I was treated. After a while of sitting at the terminal, I went back and I asked that I wanted to file a Police case against the agent. Initially, the agents said once you are in the terminal, you cannot get out.. I spoke to the head agent again who let me get out and gave me directions to the Police booth in the airport.

    At the police station, I stood around with Visa violaters for a while.. Eventually, they were able to find someone who spoke halting English.. Since I was not physically hurt, I could not file a Police case against the agent. What I was able to file was something like an incident report (but unfortunately no tracking #)

    This was an interesting first hand experience in overt racism.. being treated like crap because the agent thought he could get away with doing that to a South Asian looking person..

    - Air France

    - e-mailed ADPWEB [ADPWEB@adp.fr]

    and a few others..

    I am not going to let this ICTS Agent treat people like crap.. After he saw that I went out to put a police case, he came to talk to me at the terminal saying that I can shove him if I want and a lot of other excuses.. I kept repeating my mantra " I did the right thing. You did the wrong thing. You cannot force me to do the wrong thing.."

    I will keep writing to all the parties until I hear back..

    and Air France, even though I liked your service at the airplane, I am not flying through CDG ever again..

    Lets vote with our feet.. Lets vote with our money.. Lets avoid airports that don't treat all passengers equally..

    I cannot ask my colleagues to sepnd 30 minutes on phone, but I can certainly ask them to send e-mails. They helped me during admin-fix letter campaign and they are all US citizens.
    Can someone prepare a draft for such e-mail along with all the e-mail addresses and post here?
    I can target 15 e-mails by Tuesday.

    If I am correct, your PDs are current, right? Do you guys know if your case was pre-adjudicated and/or assigned to an IO? I keep reading from the forums that some apps with PDs as late as Dec 2004 and a couple of Jan 2005 got approved. Wondering why the earlier (eg. mine is July 04) not approved yet. Could we all join togther and write a letter to Napolitino(Thanks to SoP for the idea) and ask her to take some action on our cases?

    in resent SR, IO said my case is pre adjudicated and under review. we asked what's that mean, he doesn't know - if it's under review then how preadjudicated?
    i send request to senator before 2 weeks, but still no change in LUD and no reply.:confused:

    Hi All
    I got greened today. Same here for me and my wife. I voted on the poll for me. Let me know if you want me to add one more for my wife too.

    Here are my details for your reference:

    1. EB2 India
    2. PD: Dec 21 2005
    3. NSC
    4. I-485 Receipt Date: July 2 2007
    5. I-485 Notice Date: July 30 2007
    6. What I did: SR on 2/8 (File pending and awaiting assigning to officer) wife SR 2/8 (Actively working and need additional review)...wife is a dependent
    7. Went for infopass on 2/8 afternoon (First day when I was current)...guy told me your cases are pre-adjudicated and files are with officer and same for me. Was happy
    8. Called second level IOs from 3/8 till 3/14 everyday.
    9. Some were knowledgeable and some were not but more or less good people I met
    10. One good person on 3/10 told me Mr Sharma your file is in transit...may be in some crate or some bin and might be on the move to an officer...I said Infopass guy told me they are with officers then he said clearly NO...your status is in transit and your files are NOT assigned to officer and your paralegals July 23 referral is still open and I cannot expedite it. So write to NSC follow up and mention my name and tell to expedite your case and see if they oblige you and help you. Thats your only hope. I cannot override your outstanding July 23 2010 referral.
    11. I did that and surprisingly nobody replied to that and few days earlier I had written to same email id and I got standard response for me and my wife
    12. I wrote to Ombudsman last Wed and yesterday after a follow somebody acknowledged and said we will take action
    13. I contacted senator office in mid July 2010 and after full one month I was in their system and congressional staffer was assigned to me and he called me and said on Monday evening I am writing to NSC Liasion and told me to wait for 2 weeks
    14. To my surprise he forwarded me NSC update which said files are with adjudicating officer and it did say that they are processing 4000 cases in a month.
    15. Congressional aide called me and said per his experience this is a + email and you can be approved anytime now.
    16. At 6.02 am there were 2 SMS and I checked online status changed to decision and then emails which said welcome new permanent residents
    17. I have been in US for 10 yrs now. Did full time MBA (F1) and then switched 2 jobs, it was a second GC as I left a March 2005 labor and started new Perm labor with the second company on H1B
    18. Was able to file through July 2007 VB fiasco
    19. Left the company after 250 days and switch on H1B transfer and ported my GC
    20. My current employer attorney did file for AC21
    21. Was waiting for this current window of opportunity

    Honestly I did everything I could do and did NOT leave any table unturned. I dont know what worked or not but yes I tried each and everything.

    IV is a fantastic platform indeed. I respect each and every member and I will help in every possible way indeed.

    Now few questions and clarifications:

    1. My wife is in India returning on sat evening. She was on H4.
    2. When she left I gave her advance paroles original
    3. I also gave her print out of I-485 receipt
    4. I told her to print out USCIS GC approval email that came today

    Now questions:
    1. She should go to which queue at POE, Visa or the ones for citizens/permanent residents?
    2. What she should tell the IO? When she left she was on H4 and on Aug 17th my 485 was approved and here is the proof (approval email print out) and ask the IO to respond?
    3. What will happen then? She will be taken somewhere and they will put D-155 stamp on her passport OR she would be allowed to enter on her Advance Parole or She will be admitted on H4 with I-94?

    Anybody has the same experience, kindly explain me so that I can inform my wife immediately.

    Hi,
    I am happy to share the news that I received CPO hard copy on exactly Diwali Day. Lord Ramachandra Ki Jai.

    Here are the details of my case and what did I do to get this CPO mail. It may help others to follow up with USCIS.

    1. Applied EB-3 India in July 16th 2004 .
    2. Waited for about until 2006 July, but no signs of EB-3 labor approval.
    3. Applied EB-2 labor under PERM Sep 2006 and got approval in 7 days. this was amazing………..
    4. Applied I-140 for EB-2 labor in Oct 2006 and received approval after 6 months, still my EB-3 labor not approved.
    4. Applied I-485 on July 2nd 2007 along with my wife with EB-2 PD Sep 20th 2006.
    5. Received the receipt notice with the notice date of Aug 30th 2007 and receipt date of July 2nd 2007.
    6. Received the Finger print notice on Oct 15th 2007 and gave finger prints on Nov 10th 2007.
    6. Received the EB-3 labor approval in Dec 2007 and applied for i-140 for eb-3 and received i-140 approval in June 2008.
    7. Now I have 2 i-140 approvals one EB-3 with pd of July 16th 2004 and other eb-2 i-140 with Sep 20th 2006.
    8. Changed to better attorney who can better handle the i-485 in terms of the PD transfer and follow up with USCIS.
    9. Attorney sent Priority Date porting request to Texas service center in June 2008 along with new g-28 forms.
    10. Called at least 4 times in 2008, but got the response that my processing dates are not current yet means. Not reached the July 2nd 2007 or Aug 28th 2007 which is my i-485 notice date.
    11.In June 2009 Called USCIS POJ method and got some nice officer in Texas service center who opened the SR to open my case as my case is out of processing time.
    12. Got soft LUDs in June 20th 2009 and called usics cust service and came to know case is assigned to an officer.
    13. In July 20th 2009, got email update saying the case is transferred to NBC for further processing.
    14. Next day again got email, case is transferred to NBC and I will receive the interview notice.
    15. Got interview notice to go to local office on Aug 5th 2009.
    16. Online status changed to case transferred to USCIS office........
    17. Went for the interview on Aug 5th 2009 to local USCIS office along with my wife, office was very nice. Officer asked general questions which are on i-485 (like have u been arrested, have you been involved in terrorist activities etc.) form and questions about my wife's name and marriage date etc.. Officer did not ask even for employer verification letter also, I myself handed over that letter to her. She did not even saw that letter.
    18. Dates were not current on Aug 5th 2009, and officer told, she will take a decision after dates are current.
    19. Waited for Sep visa bulletin and dates became current, as my case is at local USCIS office, all attorneys who are the members of AILA will have direct contact to local USCIS office supervisor ph no and email id. These details will not be known to applicants. My attorney sent an hard copy request on Sep 5th 2009 to local USCIS office to adjudicate my case as my PD is current.
    20. Waited until Sep 15th no update was received from Local USCIS office or no update on i-485 LUDs online.
    21. Took info pass on Sep 16th 2009 and went to local USCIS office and got nice Info pass immigration office, very co-operative officer. He told me that my case is now back to central storage location and waiting for the visa no. I told him my PD is current, officer himself gave me an yellow form (please request for this form, otherwise they don’t give it normally) to fill up to send to other department supervisor in local USCIS office. Filled up and gave the form along with my i-485 receipt notices and i-140 notices. Officer asked me to wait 3 to 4 weeks to contact again. No luck until Sep 30th 2009.
    22. On Sep 26th 2009, attorney sent an e-mail to local USCIS office and got the standard response on Oct 1st 2009saying to wait for 3 months etc..Again attorney received an e-mail on Oct 2nd 2009 that my case will be adjudicated soon.
    23.On oct 4th 2009 took info pass again and went to local uscis office, again got nice infopass immigration officer and explained that they will request visa no only once (recently Murthy law firm posted that way USCIS and DOS dept interact) and I need to wait until visa no assigned by DOS. Gave again yellow form to sent to local USCIS supervisor to look into my case.
    24.Called 1-800 number and asked if there was any update on my case, got very very nice supervisor from customer service center, and he told me that my case is now assigned to an officer on Oct 6th and I should see result in 2 or 3 days.
    25Atttorney sent an e-mail again to local USCIS office explaining my PD porting details just to inform officer again.
    26.Got CPO email Friday oct 16th and received courtesy notice of approval i-485 on Diwali day on Oct 17th 2009.

    If the case is at local USCIS and your PD is current, please take info pass every 2 or 3 weeks, and request for yellow form and fill it up and give to info pass officer. This will help to move the case faster if the case is at local USCIS office.

    Overall, please call repeatedly to USCIS cust service to get some good officers and you will really here somany good things from them. What I understood from my exp, that the customer service officers now far far better and good than 6 months back..Really thankful to USCIS for providing good customer service.

    I hope this post helps most of the people whose dates are current....

    Lot of analysis. Here is my part. If DOS properly followed the INA as amended by AC21 act in 2000, EB2-I never retrogressed since year 2005. EB2 I might have been always �current�. EB3 including ROW might have been much worst situation than now. EB3-IN will always be in disaster state. Though it is unfair to (EB3) many, this is what the law. In later part of 1990s EB categories were retrogressed for IN, CH by about 2 years. When AC21 law passed in 2000, it did two very important things. One recapture of about 216,000 EB visas and it removed country quota in each EB category if excess visas available, in that category. That means it enforced horizontal spill over. In simple example, consider Mexico which is most subscribing country. Lets assume in a fiscal year, 40,000 Mexican are eligible for EB2 visa(and no other citizens in EB2), and millions of Mexican eligible for EB3 and in family based categories, still DOS should issue 40,000 EB2 visa to Mexicans irrespective of how much demand in other categories. Because of tons of backlogs in 485 (between 2000 and 2004), particularly in EB3, DOS issued about 185000 (out of 216000) to EB3. That�s why EB3 was current between 2000 and 2004. They simply ignored the EB2 demand by India and retrogressed in 2005, though total demand for EB2 less than the available pool of recaptured visas. Since the year 2007, they realized the mistake and now (since 2007) they are following correctly (though may not fair) the law. If they follow correctly the law, EB2-IN, Ch will become current soon. Till all EB2 become current, EB3 never see any spill over. Till EB3 �ROW become current, EB3 IN will not see any spill over. Till that point EB3-In will get only 2800 EB3 visas.

    May be you might have supported previous IV campaigns. I urge you to keep supporting them instead of going anything crazy like what you are planning.

    Finally if you have reasons to believe some firms are gaming the system then report them. That is American way of doing things.

    Always complain, even if there is no hard proof. The companies may not tell you on your face that they do not hire EADs. But the hiring manager or recruiter must be acting on a policy made elsewhere in the company, directed by some higher-up officials. It will be written somewhere. In that case, OSC can ask for archived e-mails, and phone conversations for a record of discrimination. If discrimination is proved, company is liable for fines, and the higher-up official is sacked. If there is no official communication, the company can claim that the hiring manager or recruiter is acting on his/her own and it is not the company policy. Then the hiring manager or recruiter is fired and the company pledges to enforce the rules strictly. Always a positive outcome for us.

    Complain to EEOC also in addition to OSC. Double the pressure on the erring company and you would see quick results.

    Hi All,
    I received the CPO email yesterday.My case details are PD : Dec 2004, 485 RD : Aug 6th 2007(I140 Filed concurrently),EB2 India.140 was approved on Tuesday.

    I140 was pending from 2007.When my attorney followed up in feb this year,USCIS gave the standard reply of waiting for 6months.After that they said,they will update in 10 days.They didn't update even after that and then i moved it to premium processing on Sept 28th.

    Took 2 info passes in Septembter(regd i140 mainly).First one was not of much help though the officer told my 485 is assigned to IO on Sept 8th.Second time it was different officer and she was very helpful.Tried looking why my 140 is getting delayed but she said ,if she opens my file then 485 file will go back to review queue as it is currently being reviewed by Sept 18th.So she didn't recommend doing that.I didn't open any SR after my first experience of 6 months waiting(without an result!!!)

    Before 485 approval day(i.e Tuesday) i called IO TSC Center but he doesn't know anything when i mentioned that my PD is Dec 2004 & that my case is current from last month.,he told my PD is the RD of 485.I thought no point in arguing with him and hung up.After that i was preparing to send mails to Senator but got the approval before that.


    Anyway,happy that it finally got approved .I am waiting on my wife's approval thought

    I am starting this thread for all of us not to just think about the GC process. If any one is residing here for 10 years without GC, think about making a law which can lead us to Citizenship. My thoughts on this:
    Many of our colleagues who landed with us during the late 90s (1998, 1999) and early 2000, who got their GC without any issues are now Citizens or waiting to become Citizen soon.
    What is our status?. Just think. Still we are strugling to get the GC. Even by law change, if we are getting the GC this year (by GOD's Grace), then we need to wait for another 5 years from now (approximately 2014). Many persons like me who have come to this Country in their later career will be very much affected due to this delay (we have lot of other issues like the dependents reaching the age of 21 etc., College, University fees etc.,).
    Core team and every one, please consider this and try to lobby for getting the citizenship without further wait if the persons satisfy the folowing conditions:
    1. If they are legally here for 10 years (With approved I-140 and waiting for Adjustment of Status without current date).
    2. If they have earned full 40 points in Social Security
    3. If they have paid the tax continuously for 10 years
    4. If they own a house and paying Mortgage (adding weightage to the Economy boost)
    and
    5. If they do not have any criminal records in these 10 years.

    Please again do not just concentrate on the GC issues. Consider this and if any one can come with a letter draft with legal openion, we can send it to all Congress members, State Governers etc.,
    Hope the members and the Core team consider this issue. I have one more thread on this, which I started some months back but the response was not that good. If every one of us unite on this and raise this to the Congress, I think the new Government may consider as this is very genuine.


    Agree with this approach. I'd rather ask big and settle for less than ask for less and settle for nothing! We really need to emphasize the point that we have been here for years legally paying taxes, other fees imposed on us NOT knowing the end state. Remember only the squeaky wheel gets the greese. More over there is never a good time, at least I have not seen one in the past 13 years, time always bring new challenges and issues but unless we speak up we dont make it to their priority list for consideration.

    You are correct I missed that it can act as a very good buffer if I go by my extrapolated inventory which also factors in PWMB and if the May VB news actually materializes then yes Jul - Aug 2007 will be very easily crossed.

    If there are 140K visas then EB3 category will get 140,000%28.7 = 40180
    NACARA program = 40180-5000=35180

    Employment Third Preference Other Workers Category: Section 203(e) of the NACARA, as amended by Section 1(e) of Pub. L. 105-139, provides that once the Employment Third Preference Other Worker (EW) cut-off date has reached the priority date of the latest EW petition approved prior to November 19, 1997, the 10,000 EW numbers available for a fiscal year are to be reduced by up to 5,000 annually beginning in the following fiscal year. This reduction is to be made for as long as necessary to offset adjustments under the NACARA program. Since the EW cut-off date reached November 19, 1997 during Fiscal Year 2001, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002)

    deduct 15% for consular processing = 29903

    again consider 5 different Chargeability Areas
    such as CHINA mainland born, INDIA, MEXICO, PHILIP-PINES and rest = 29903/5= 5980

    Worst case scenario, USCIS will have 5980 visas available for FY 2010.
    Now, if you compare data published by USCIS on pending cases can we guess
    we should see forward movement for EB3I at least July-2002 by end of FY 2010 ?

    Is it fair assessment?
