My lawyer received the following RFE during premium process of my PERM I-140 application.
===Here is the text from original RFE========
Submit evidence that alien obtained a true 4 years bachelor degree in Computer Science, Engineering, MIS, Math or Equivalent. Evidence of education must be in form of an official diploma, record/transcript showing all dates of attendance, area of concentration of study, and date of degree award, if any. The evidence submitted shows that the alien completed a three year Bachelor in Science Degree in India

IV is non-profit organisation. If IV hires a H1B holder, it wont fall under the cap. ( Provided IV qualifies as non-profit for the sake of H1Bs )

Hi abhisam - I did the same. What happened to your EAD renewal application.?
my application was forwarded to the phoenix lockbox. My checks were cashed from phoenix and then the application was sent to Texas. I recieved reciept notice dated april 16from Texas Service center and am waiting for the approval. I had read in some USCIS press release that if you send your application via usps then they will forward it to the correct center but if you send it via fedex or other courier service then they will return the application to you.

This has become a ranting thread of EB3 folks. One simple question:
How many of you EB3 India folks who are complaining actually went to Washingtno DC last month for IV Advocacy event?
I hear it was not even 250 people. If you take out all EB2 people, so few EB3 people. This means EB3 people do not really want to do anything but after every visa bulletin come to the site and rant.
We in EB2 do not have much to worry. Our dates will move fast. But you EB3 had a chance last month and you blew it by not doing anything. So stop complaining.
I dont think we all are complaining...We are just thinking out loud hopefully some solution / direction comes out of it. But one thing is sure people certainly did not like your attitude.. It could be that you are deliberately trying to instigate something just for fun or maybe you are having a bad moment or may be none of these, I was just trying to think the rationale behind your comments ...(could be even u just stated something and people didn't understand whatever u really meant and applied thier own interpretation)...only u or god knows the truth...I dont have anything against u and know for sure that even u dont have anything against us.

Speaking for myself, I'm not seeing the value.
So...when I see them advocating for things that will make a difference, I might consider contributing at that time.

I believe IV should take this very seriously

but i rarely see a vote on what IV plans to advocate for

i send all my papers to my lawyer in january for filing of Labour certification thru perm for state of Tennessee and yesterday i asked my lawyer about the status of my file so he said that your file is still not submitted as state of tennessee is not accepting now so will have to wait ,is any one in this situation

I know there are plenty of suggestions flying around and here is my 2 cent, it may or may not make too much sense, but here it is.
We can rant about the difficulties of not getting a GC, make emotional pleas of our struggles all day, but nothing talks better than money. In the current scenario nothing will grab more attention if you can show how we contribute to the US govt and the US economy in monetary terms. Nothing else will get the attention of these lawmakers like money can. ;-)
Can we put out some numbers for the lawmakers, in terms of our contribution to federal & state taxes, social security, property taxes and overall economy by way of our purchasing power home, cars, appliances, vacations, etc (all the amount that you spend in the US) and multiply these numbers by the number of folks waiting to get GC or who have the GCs. I am sure when you add all this up it will be a significant number, which is bound to catch some attention. Assuming the majority of us make more than the average American, all these figures will definitely standout.
Also propose a one time fee of $10,000 to apply for GC right away. I am willing to pay this fee if USCIS can grant me a GC or provide us a way to stay and work legally in this country with no tie in to the employer. This could be a significant amount of revenue, especially when all lawmakers are looking to reduce the deficit and raise some income. As it is they are regularly increasing the visa fees to pay for some bill to the other like the 9/11 workers healthcare bill, etc. If a 100,000 folks(not sure how many are there in total) like us cough up $10,000 that could equal 1 billion. May seem small amount compare to the US deficit, but when you add up our total contribution it is significant. This may be totally outlandish, but I think something on this line is worth talking about. Like I said, nothing talks better than money.
Not sure if there have been other similar ideas, but if we can compile a few pages of such information with numbers, graphs, comparative charts etc and hand them out to the lawmakers it may help.
Comments and feedback welcome. May be this is totally a dumb idea, but if the admins think it makes sense willing to discuss and prepare something. Also this post is not meant to begin a debate or to distract us from our goal but just some thoughts.
PS: Have contributed in the past and intend to participate (financially and in person) on the Advocacy day.
Currently GC's are being sold for, more like, 500k (EB5 quota).. maybe we should be haggling to bring that down to 10000 or something, stating "startup" argument, and also the fact that it doesn't really take 500k to open a business that subsequently generates employment in the e-age. Some slogan like "untie our hands" ?

No news on EAD,
65 days and counting.
Got RFE on e-filed AP for my wife. They probably lost photos and asked for new set. Just shipped the reply and photos back to TSC.
Hope that triggers something.
Last time, I got couple of soft LUDs on 07/24; 07/25; 07/27 on all our EADs and APs. Wife's AP has hard LUD 08/05 (when they issued RFE) and soft LUD 08/06 (when RFE was mailed).
65 days and counting.

I arrived at the Situation Room at about 1 pm on Monday.. didn't know anybody and nobody knew me so I was searching for a Core IV type look on anybody's face... Poor 'beenwaiting' was eating her late lunch at what seemed like a registration table and she noticed my dillema.. she promptly put her lunch aside and briefed me on the agenda and my meetings.. Thanks 'beenwainting'...
Next I remember was helping Sanjeev (can u PM me your handle?) with his tie and hurrying with Shivkanth and Sumita (can you PM me your handle too?) to a Senator's meeting. That Senator's staff knew the issues pretty well and it was fun to watch Shivkanth debate with her.
SriKondoji - it was nice meeting you. The reception and the rally next day were a great experiences. Finally I had some great Indian food at the Union Station with Indio0617, Pappu and Dr. Gupta (can u PM me your handle?)
All PA (Philly) members - let's plan on meeting over coffee sometime in the next couple of weeks.

The experience of attending the rally was therapeutic in a way... Day in and day out one is sucked in to the bubble of daily life, work, kids, family..... and on top of it, the thought of interminable wait for GC really burns you from inside. You know you have to go through it and you know there are thousands like you who are stuck too. And then one fine day, these thousand faceless online handles come to life together and in the nation's capital and actually march and meet the lawmakers. This has truly been a great experience.

So now this thread has turned into a sob story of how a handful of misused EB1 visas are bad for the whole group (i am a screwed up low level EB3, i am not in competing with EB1's or 2 or 4's for that matter) ...we just need some bad guys to pin the blame on. We are loosing sight of the big picture here. We can either complain or cry or do nothing, to each his/her own. write a letter to the authorities. they will take 5 years to investigate and 10 more visas will be available to for redistribution to Eb2 from EB1, meanwhile we will create a new thread everymonth and complain how messed up the system is and how screwed up we are...:p.
...reminds me of a quote from Maya Angelou:
"If you don't like something, change it. If you can't change it, change your attitude. Don't complain."
Lets all get together and work for visa recapture, it is free of country and category caps, everyone will benefit.
I completely agree. Tell me how are we acting differently than the Americans blaming the foreigners for bad economy? Look at the bigger picture before pointing fingers at each other. BTW, I am not an EB-1; I am just an EB-3 :)

Instead of writing a letter, why not start with a phone call. Find out a bit about the staff ahead of time (Google, Linkedin, etc.) and then call the person that is most likely to be helpful. Then ask for a meeting.

I don't think it's an end of fight for IV or for that matter for us. Ability to file for I485 is just like getting out from one queue and standing in another big one. Once the folks who are stuck in backlog gets their labor will be in front of this big line as you know the priority date counts. Only advantage for the people filing 485 is an EAD, which I know is a big one. With thousands of people filing I485 in July, I believe EAD itself is going to be retrogressed.

I heard some friends saying using L2 charts, ( I am new to this and Plan to do trading from now as I think it is good to enter now or it is right time to get in .. )

So this $300/$500 collection target is something to work towards, but once I am in the team, I get to run/walk even if I am unable to raise the full amount, right?

Lastly, you can also do this in groups to make it easier and more fun. For instance, my non-IV friend who has signed up with Team IV will host a Coffee Hour with me. All guests will buy baked goods from us (coffee is on the house) and the total money raised can be split 2-ways to add to our individual fundraising goals.

But you went further than that, I don't understand what is the whole idea of one group passing judgment on others. There are EB2 better than EB3 threads, the labor substitutes vs. honest to God super qualified deserving PERM filers, then there is US educated vs. non US educated and now renters vs. home owner and savers vs. big spenders. What I fail to understand is, if you have to make your point please do so but keep your opinion about others to yourself on your blogs or you personal websites.

What's wrong if a couple is saving and filling their bank accounts ? Tell me one thing that is wrong about being frugal ? May be they are saving to for their future education or for their kids education ? For a small business ? or Simply retiring at 40 ? or May be having a bank account full of money gives them same pleasure that you get from your McMansion ? Or they simply want to live debt free and sleep well at night. So unless I have some material possession to show for my money, I am wasting it all away ? Isn't it ?

If you want to throw your hard earned money and pay the highest possible rents, please go ahead. Don't preach. Besides living frugally gives your kids a better shot at quality education then overspending on unnecessary things.

They can provide food, shelter and health insurance for their family during tough times, they are rich. What's wrong if a couple is saving and filling their bank accounts ? Tell me one thing that is wrong about being frugal ? May be they are saving to for their future education or for their kids education ? For a small business ? or Simply retiring at 40 ? or May be having a bank account full of money gives them same pleasure that you get from your McMansion ? Or they simply want to live debt free and sleep well at night. So unless I have some material possession to show for my money, I am wasting it all away ? Isn't it ?
These are people who want to live in cheapest rent (even with double income) in single bedroom & they don’t mind children sleeping in their bed room. They don’t mind sending their children to low grade schools.
If you want to throw your hard earned money and pay the highest possible rents, please go ahead. Don't preach. Public education is free and private school are not cheap so please explain what do you mean by "Low Grade Schools" ? Besides renters can choose any school they want by simply renting in the best school district at all grades. Your point doesn't make sense. Besides living frugally gives your kids a better shot at quality education then overspending on unnecessary things.

Making money is a perfectly fine ambition is a capitalistic country. May be their ambition is to save early and then provide the best for their family by working part time in later years. Please define "high ambition" ? Buying a high rise condo ? McMansion in a suburb ? Would that instantly qualify me to be an ambitious achiever ?

It doesn't matter what your views are, if they have money in the bank they are actually "rich". If they can maintain the same life style in good times and bad times, they are rich. They can provide food, shelter and health insurance for their family during tough times, they are rich. Unfortunately your views will NOT pay bills, so you can distribute them freely on this forum all you want it won't make a difference.

Don't insult someone just because he/she is homeless. People do go through tough times and not everyone is fortunate to have smooth sailing all along. You said have seen it all but you haven't learned to be humble !!! May be you ain't seen nothing yet. Start with "Pursuit of Happiness" the movie that is.

Has anybody tried the new online system? How good is it? Does it give you tracking number, etc? Mor importantly, has it made the process any faster? Thx.
I mistyped my DOB (month and date in reverse order) in application, I expected it will let me correct. But it confirmed and generated the file #. I called them how to correct, they have no idea since it is new to them. Finally one officer over phone told to write a covering letter explaining the problem along with application.
So BE CAREFUL while entering the important data. Once you click on the Submit, and OK for popup buttons it is done. No separate confirmation page. The same entry page gives a popup to confirm changes, if you Ok it thats it. File is generated. Mailed mine on 4/17/08 and praying to God. I'll call them next week.
