For those in South ( Texas, Oklahoma, New Mexico, Louisiana) best way to go to India is new Emirates direct flight between Houston and Dubai and then onward to India.
I have had 3-4 friends fly this route since they started flying in November 2007 and they have nothing but praise for everything. These guys have excellent food and entertainment and no transit visa hassels plus duty free sopping in Dubai is good.
Pluse - they put you up in a hotel if your Dubai layover is more than 8 hrs (for economy class passengers) and you get a free transit visa to visit Dubai. During my last trip to Bangalore, I went via Dubai (NYC - Dubai direct flight) and on my way back we had 11 hrs layover. My wife and I got a chance to see the city. Next time we are going to India we are planning on staying for a few days and go for their desert camp trip.

He had to wait in the airport for 24 hours and some people for 48 hours for the next flight. yes, but july 2007 VB and the subsequent USCIS change related to approving cases with pending namechecks added a significant number awaiting for approval. Then a couple of months back USCIS woke up from slumber or had a shot of 100 proof single malt, re read some law and decided that the overflow allocation should be changed. The result is that there will be next to nothing for EB3 (for that matter EB2 will also have less overflow available) as they clear the backlogs, i doubt anything besides a recapture in the short term and a significant rehaul in the long term will work...i hope i am wrong but EB3 I and C are in for a long wait.

We all know that IV is not Indian. More Indian!=All Indian. Lets not worry about it and most importantly I request IV members from all countries to ignore it as a reporter mistake as they script stories in their fashion to elicit more coverage. It is almost impossible to edit the story that has been distributed by Reuters/AP. Once its gone, its out of their hands.

At last, after 10.5 years, 4 employers, 2 Labor filings, 1 Perm and 2 -I 140 (One from my employer and one from my spouse employer),1 - I485 filing, 2 SR, 1 senator request, 1 infopass - Got the mail - CARD PRODUCTION ORDERED for self, spouse and son.
What to do now? I dont know, for the last many years, used to think everyday about this 'CARD' and now nothing else to think about. May be, I should start thinnking about ????
But for now, Just going to relax and savor the moment.
Thanks for all the Guys, Gurus, Seniors, Juniors and all who contributed to the various discussions. I am pretty sure that I cannot stop logging to this website even I got my 'Card'. I will try to help you guys in some way or the other.

i dont think the country makes a big difference, i have two friends stuck in name check (one was born in canada with an english first and last name). i think its the combination of the name, DOB and a crappy system

To set the record straight.....Mr. Hunter should first learn English Grammar. It's "I have been" not "I has been". And yeah, don't get lost in statistics, just because laws in US are designed to encourage corporate fraud in variety of forms doesn't mean corruption is any less. The only difference is low grass-roots level corruption which is direct result of differences in population density.

It only talks about guest wokrer program and opposes HR-4437.

If I am not wrong, buffering wud be to take in new 485 applications, process them and keep them ready.
In that context, most of the applications till 07/07 have been preadjudicated, new buffer wud require dates to be pushed to 07/07 or later.
I would think they move to 07/07 first to see any missing demand to appear in the next month or two and then move significantly, if needed, in the final quarter!

I agree we might not always have hard evidence unlike the OP here. And lot of employers might be doing this. I have never faced this, yet. However, we have to act on it. The first step is to complain to the govt. Maybe if there are lot of complaints, govt will investigate and find the dirt, and fix it.
Another idea is to bring it to the attention of the job boards that discriminatory ads should not be posted. Lets give this a try.
To those effected, write to the govt if you are in a situation where you can.

You get an first email for their interest as your resume matches teh job
description and they want you to spit out everything in your reply

work status, they do not communicate to have you spitted out specifics.
They call you. If you do not spit out, they would not go ahead. If you spit
out "EAD" smart ones do not even talk further and you find all

Received the physical card and the welcome notice on mail yesterday for self and welcome notice for my wife. Status still under initial review for self and for wife it is under post decision.

Went to Infopass on 9/13/2010, was told that we have to wait and we will get an interview letter.
Contacted Senator's office - Told to wait for 4 week for someone to contact us from the senator's office, only 2 weeks has passed.
Sent email to NSC follow up - ncscfollowup.nsc@dhs.gov
Sent email to SCOPSSCATA@dhs.gov
Either sending email to ncscfollowup.nsc@dhs.gov or SCOPSSCATA@dhs.gov should have helped in our case.

Started new labor under perm process in 2006
