We are working really hard to get our amendments in. Please understand, we are not doing this for fun. We are into this just like you for our green cards. It would really help if we get support instead of having to answer the same questions over and over

We are trying to get our amendments in the bill. It is not an easy task considering that the senators have achieved a fine balance behind the doors and are unwilling to be the ones to break it. But again, we are going full steam with this as it means as much to us as to you. And remember, we are a voluntary non-profit organization. Before you start doubting anyone here, remember, there is no gain for us doing this.

Personally I think these processing dates are crap , It use to be valuble before July-07 but not any more.
I think if CIS use computers and run a small query they know how many cases are pending which fall under processing dates
The only advantage with the dates is opening SRs, which dont have any value and complete waste of time.
My EB3 140 was filed on July 5 th 2007 at NSC and transfered to TSC on April 07 08 , for TSC 140 processing dates are Aug 26 07 . I guess they have their own rules for transfer cases .
CIS is giving preference to priority date current cases as they need to use the numbers, all others are in limbo .
God please give us more strength and patience .

Must an H-1B alien be working at all times?
As long as the employer/employee relationship exists, an H-1B alien is still in status. An H-1B alien may work in full or part-time employment and remain in status. An H-1B alien may also be on vacation, sick/maternity/paternity leave, on strike, or otherwise inactive without affecting his or her status.

You dont need an EAD, if you still have valid H1. AC21 has nothing to do with EAD. However, if your H1 is expiring soon, and you have already used up 6 years of H1, you would need an EAD, because H1 extension beyond 6 years is available only for people who cant file I485 because of retrogression.

I was not planning to change company and just filed my 485 without EAD last week. But now situation has changed and the lawyer said i need EAD if i want to use AC21 after 6 months. I'm hoping to get a receipt notice soon so that i can file for EAD without the increased fees. Anybody has any link to where it says we don't need EAD for AC21 so i can check with my lawyer?

a question: after 140 approval, does the service center notify you of the approval and send you a copy, or do you only hear next from the NVC ? I'm waiting on my 140/CP filing for the last two weeks and getting a little anxious. Also when can one call up the NVC to confirm that they've received the file ? thanks a lot.

often times i have noticed that the blissfully ignorant GC applicants come better off than rest of us- who act like chicken with the head cut off after every bad news!!! may be they dont worry too much and look at it from a whole another perspective...who knows...i wish i could be one of those, but i am too far in the game...damage is already done...:D
:):):) One thing I surely belive and that is positive thinking.. Perhaps that may be chnaging the aura of not only that person but 485 filing and aura of USCIS officer as well.:)

At PortOfEntry, CBP officers are QUESTIONING IF you are working for the sponsoring employer and many folks just switched jobs with AC-21 with no valid H1B anymore.
Questions:
1. What are the Consequences at Port of Entry on travelling with AP and NOT working for the ORIGINAL GC sponsor?
2. Can anyone share thier experience what was the outcome at Port of Entry when the answer is "NO - I am not working with sponsoring employer anymore" Were they held at Portof Entry indefinitely ?
3. What Steps can anyone take when at CBP office/Immigration Official is NOT allowing you to re-enter US on Valid AP (I-485 pending) and you are NOT working for sponsoring employer and no valid H1B?

dont want to judge ur sentiments, but think about this.
if GOD only cares abt people who constantly praises god, then muslim countries should do way way better :D they pray so many times a day. nobody follows religion and GOD like muslims do :D, not even hard core christians :D. even hindus pray a lot. In todays schedules to come to I485 filing stage takes min 1-2 years. Let us assume 2 years. (personally it took 5 years)
So lets say 2 people (EB2 & EB3) apply for GC in year X. After X+2 they are eligible to apply for I485.
Let us say EB2 is current then EB3 should be current - 3 years. Otherwise the EB3 will have the motivation to refile in EB2 and clog the system further.
If EB2's PD is (current - 3 years), EB3 should be not more than 2 years behind (The time it takes to get to I485 stage).
I doubt people at USCIS have the time, interest or the inclination to understand this bit of simple math - As a result you will have people with multiple applications trying to to beat the broken system.

Your intentions are good - but the approach you took needs to be refined further. None of what I wrote above is personally against you - I appreciate your efforts but feel that we need to approach it differently - probably equating updates with money is not a good approach given that once someone gives money , they may start having a feeling of entitlement and we may not be ready to handle it.

Without a doubt, the poll I have posted is clearly focused on a single dimension i.e. whether receiving more regular updates will help people get more involved and contribute more (whatever be that amount, it would be in addition to current status). While there could be several other ideas to increase participation level, this is what I felt was important to me and was looking to gauge if others felt similalry. However, I clearly don't have a patent on ideas - if you have a different approach or idea I would assume you wouldn't hesitate to pursue that to achieve our goals.

After all no one gives without any expectations and based on this poll, there are at least some of us for whom being informed along the process is one of those expectations, especially since none of our goals will be achieved overnight.
