July 2nd filer.
Transfered from NSC to CSC. My bad luck. Didn't apply EAD, AP. No news on FP. I heard that CSC processes FP lat than other centers. I know my neighbours got FP notices who filed a month later from NSC.

What is received date? What is delivered date? How come there are 6 days gap between those days? Even if you assume that the receiving guy took 6 days to lift his hand and receive, how come the received date is before the delivery date? So he received it even before it was delivered to him.

yea this is correct. a member named united nations posted a detailed break down on immigration portal a few months back. This has been implemented by the DOS by suspending the AC21 rule of a variable cap and enforcing a hard cap of 7%. This was mentioned in the november or december 2005 bulletin.
From my perspective I think its a travesty that when the UCIS and the DOL has classified some of us as "exceptional" aliens, we can still not adjust our status because we were born in India or China while Mexicans with the same qualifications can. If the country limit is to avoid monopolization of numbers and enhance diversity...all categories for Mexico should be "U"

The following is from November 2005 visa bulletin published October 2005.
"During FY due to anticipated heavy demand, the AC21 provisions are not expected to apply, and the amount of Employment numbers available to any single country will be subject to the 7% cap."
Well, now I realized it is not DOS but again its me who was not upto date with the trend. This means that India cannot go beyond its 7% using unused visas. In the same bulletin there is something that indicated that it allocated too many visas to India in the past. Most likely DOS does not take any action until ROW eb3, eb2 and eb1 are current. Now I have also understood why the perm is necessary at the this time for row. Perm helps row move faster thatway in the loooooong run helping India when all the row is current.
There will not be any spillover to any India categories in the near future. This is the reason why India eb2 went unavailable. EB1 will soon follow the case. Eventhough eb3 moves, it was like unavailable for a long time. 1400 greencards a year in each category (excluding spouses from this ordeal) is hardly enough for India. I doubt there would be any encouraging direction in future as India had consumed too many visas in the past years. This is sort of balancing act as far as DOS is concerned. Only a change of heart can save India.
This is really bad for India as most of the people applied for 485 after spending nearly many years in BEC (that itself a retrogression). With Philly clearing non-rir 2001 eb2 labors, can't wait to see october's eb2 retrogression dates.
I wouldn't care about where the overflow/spillover goes as it is not for India.
Atlast, the email from murthy.com about eb2 visas going unavailable did not surprise me. My parents named me right and I am an enlightened person now.

If you don't get anyone, then take appointments yourself anyways without delay. Once you get the appointment, try to find more people in your state to come with you. Because, till 2005 there were extra 100,000 (total 242,000 were issued) recapturd numbers available. Therefore, no one cared (DOS/USCIS) about AC21 law that removes country quota. EB2 were curren for all then.

GC is an american dream and like any american dream it is just a dream that remains a dream for most of the ordinary people.Even if you get a gc it wouldn't make u a millionare.
Instead think about starting some good business and forever get out the clutches of the "law of ordinary people" which states that if you are a reqular person u'll continue to be so in any society untill you die and will find some way to make your life miserable.Hence if not GC tomorrow u'll complain about money and later missing India etc etc

MSFT do not abuse h1b visa - they maintain their pay scales and follow all rules. When they say they want h1b visa quota available it basically means - they do not want to turn away a talented candidate because of lack of visa. All these companies are genuine in their usage. So they can definitely give a proper response.
Now for a company like INFY. WIPRO, etc.. - h1b, l1b etc.. is a part of their business modal. They need some visa to bring people in and out as it is a big part of their business. If they really were serious - they must have presented their case and also work with US govt for a different kind of visa that allows them to do their business by convincing the govts about trade etc...
Now comes the consulting companies. There are companies that genuinely bring people and rotate them at various clients for projects and people stick to them till green card. But due to sheer greed - some of these have abused the system - they have absolutely no sympathy for their acts of greed. The max they can do is threaten, usse small time lawyers, cancel pay, write letters to USCIS to cancel 140 etc... do you expect them to give a proper response to the Senators?

I never said 80,000 FB visas are reserved for EB. Then those numbers would not be called as FB visas, would they?

Hence I said, USCIS is THE bottleneck. For the 3 years (out of the total of 15 years), unavailability of visa numbers is THE issue. When is this name check reform getting implemented. Why is is so difficult to implement ?

I know alot of my friends, who do not care or know about IV, but have got the email chain and sent flowers on their own

I guess since no one wants to do anything about their situation - we can all sit back and wait for another 4-5 years and hope that we get a green card at that time since that is the amount of time it is going to take most of us if nothing was to change in the current process.
