    Assuming that I got my EAD, and then my I-140 got denied for whatever reason.
    What happen next? Will i be out of status? do i have to leave the country? if i'm F-1 student will i be back on F-1?

    When i checked my status online, i saw that there was a LUD on my pending case on 10/7 and 10/8. Wondering there is a LUD, I called the NSC and the person on the phone told me that the case is being reviewed by an officer.

    My question is that if there are no numbers available, then why would there be a LUD on the case status. So has anyone else seen a LUD on their cases as recently as after Oct 1, 2008????

    MY PD is March 2006
    Filed 485 in July 2007.
    RD is Aug 2007.

    The main goal of IV is to bring an end to labor processing delay in the backlog center and I-485 retrogression. We have consistently mentioned this in all possible forums. This has been clearly mentioned on home page. And if there is anybody who has any doubt, we would request you to please call us at (281) 576-7185.

    I am beginning to realize that for some people who do not want to contribute, there will always be plenty of reasons and plenty of excuses not to participate & contribute. I think these people are the ones who are actually responsible for the problems of all of us. Our problems do not originate in the slow GC process or the existing bad legislation. Our problems originate due to the people who are always looking for reasons to not participate or do anything or these people who are always looking for reasons to feel offended. And these people are sure doing a wonderful job because there will always be plenty of reasons to feel offended or not feel part of the group or not find enough motivation to feel part of the bigger community.

    Asking questions or requesting a specific item in the goals is one thing. People beating the drum of transparency �. That is no big deal either. Everybody is entitled for their opinion. But people watching from the sidelines or for the people who want to include agenda as Goals of the IV or for the people putting conditions to their contributions, here is what I have to say to you. I would sincerely request you to never visit Immigration Voice or any other immigration related forum or website. You guys are the real problem because you are the once helping to foster the current system by not participating in brining the change. At the end of the day, know that you are the real culprits not the system which will be shaped by the contribution of each of us.

    In last 2 weeks the contributions has really come down drastically. Everybody please note that we are running very low on the funds collection. All of us have two choices. One, contribute for this cause generously and lead the friends and acquaintances by example and tell them to do the same. Secondly, find reasons to not participate or not to contribute due to this, that or whatever �. The choice is entirely yours. But with your choice also understand whether you are being part of the solution or part of the problem. And whatever you do (including posting negative messages), I would sincerely request everybody to ask yourself one question, whether you (or your post) are strengthening or weakening this effort.

    I would like to request all the members who have not yet contributed to please contribute generously. Please put your money where your mouth is. This effort or any similar effort for that matter cannot do much without the necessary funds that only come in the form of contributions from its members. And for those of us who have already contributed in the past, its time to please contribute more and help to fuel this effort.

    This is not just about the life of the people who started this effort or the core/active members who have taken the initiative and responsibility. This is about all of us whether or not you feel part of it or not. It doesn�t make any difference how you feel about the situation or state of affairs. Why? Because this will be over very soon. And for the people who want to continue to ponder over this idea of whether or not they have a sense of belonging to IV, I would sincerely request you to please understand and know that by any contribution to this effort, you are strengthening your own voices. Know that this is not about anybody else but you.

    With your 485 application packet, you need to attach proof of your 140 application.

    You can switch to EAD after you get EAD (which may or may not happen within 6 months of applying for 485 and EAD). 6 months after you apply for 485, you can switch employer with out negative consequences to your 485.

    Disclaimer: Any thing and every thing related to USCIS is like gambling.

    I hope they do that ..
    Can i apply for 485..with 140 pending? and then switch to EAD after 6 months?

    I will be completing my 9 yrs for H1 in Jan 2010...;)

    You create your own luck, my friend!! God is not working against you or anybody else.

    Very unexpectedly, just last year in a hospital, the doctor told me that unless I get operated ASAP, there is not much chance for me to live. As I was still trying to digest that news, I was thinking...

    ***k the Green card. ***k my job. I just want to live few more years until my son grows to at least 18 (he was just 1-and-a-half at that time).

    And I really laugh about the whole incident now. And when I see others vent or getting upset about something, I can't help but get a smile. Because I learnt the hard way that we never appreciate what we have got and always complains about what we haven't got.

    It's New Year time!! Enjoy and cherish your presence. And forget about the job/visa for a day or two.

    I agree with you Punjabi, I just got an car accident awhile back and thought the same thing like you. even a NORMAL situation is a blessing. we should always appreciate everything that we have and then from there maybe all the things that we always want will come by themselves.

    Happy New years All ... Let's enjoy and appreciate whatever that we have :)

    Hopefully next year will be better that this year.

    Thanks again for being ever so helpful. That being said, can you please share your thoughts on the following situation?

    140 approved, 485 pending for more than 180 days, EAD/AP approved, and in hand.

    Candidate leaves sponsoring employer and joins another employer (similar position/salary, etc.) New employer's attorneys send the AC21 letter and G-28 forms to the USCIS. The attorneys are very familiar with this, have handled lots of AC21 cases (Fragomen).

    Is there any way the candidate can call USCIS customer service and ask for the attorney/representative's name on file, just to make sure that the G28 did get processed and the attorney name on file got changed from the old law firm to the new one? Would customer service share that information with the candidate?

    I think this has been discussed on some other thread.. would it be a good idea to make the contributions public.. may be, this encourages others to contribute, when they realize how much more is needed to reach the monetary goal.

    In January, IV already said that they raised nearly 200K in 2006. Also, there are federal reports on www.opensecrets.org and senate's office of public records about how Immigration Voice spent money. They spent nearly 140,000 in 2006.

    I think that is enough transparency. There will be more when they file tax returns.

    Its not that people dont trust IV with money. I think people are just fine with waiting for 10 more years for Greencard. That's why, the core group should shut down this nonsense and do something better with their time.

    Sorry to hear this. Regarding medical insurance, your company has to offer you COBRA..you will end up paying almost twice the premium that you have been paying so far, but it would still be better than you footing the delivery charges (10k - 25K). Continue CORBA atleast till the deliver and post-partum - for as long as possible..

    Terminating you in your ninth month pregnancy is probably against the law, i think if you can prove it, you might be able to sue your employer, check your local state laws..

    When adding my wife to my medical coverage provided by my employer, my wife was pregnent, I did a bit of reading up, most of the group insurance policies offered by employers does not consider pregnancy as pre-exisitng condition. That is the major benefit of group insurance policies. If your husband is working in the west, Kaiser
    is the way to go!

    As mentioned in the above post, employer should offer CORBA, which can be your backup.

    Always remember that tough times will always pass!! just hang in there!

    This is the beginning of Americanization. Most of you will not understand what I say because you are here in US for a long time and being first generation immigrants (on a limbo) keep up with your tradition. Americanization is like a slow bleed. IT and BPO is investment. Returns will come in form of MNCs and businesses and finally benefit American economy.

    Just go back to India and look into the ITand BPO companies and lifestyles of people there. it will be 5 times higher than what we follow here as the Americanization is already induced.

    Bottomline, do not underestimate America. They know what they do.

    Future is India. After too much of outsourcing, INR will raise again USD and my guestimate is 1 USD to 20 INR after 10 years.

    Time to convert all savings in INR.

    I myself don't quite understand how exactly education and years of experience are translated into years of SVP. When on my PERM I had MS +5 years of experience required, they said on the denial notice: "The total time time for education, training, and experience entered on Form ETA 9089 equals 5". Which exceeds maximum of 4 years for level 7 (zone IV) and that's why they denied it (again, despite I didn't claim that that the requirements are "normal"). Apparently this 5 is not just experience years, nor just years of education. Does somebody understand how exactly the SVP time is calculated from degree and experience?

    Apply on the date your 6 months are left. Use the couple of months before that to follow up with your employer and Lawyer and get all paperwork done and application packet ready. If lawyer or the employer is slow, then one needs to push them since ultimately you are going to be affected and nobody else.

    The onus is on the H1B worker to be diligent and not leave everything to the last few months. DMV is only following the rules. Maybe some of them are not aware of the rules. The issue of not getting license despite H1B approvals, and H4s not getting DL is something one can take up as an issue with media and authorities. But just because the person did not bother to get the H1B extended until the last moment cannot be an excuse for relief when we approach the authorities.


    In some situations you would want to delay filing of your H1 extension.
    I did exactly this as my I140 has been delayed in background check since October 2006. I did not want to rush with filing my H1 extension as I could benefit from getting a 3 year extension instead of 1. Unfortunately USCIS never took a decision on my I-140 case till date even after I upgraded to premium processing in June. I filed for my H1B extension in regular processing on the very last day hoping I would see a I140 approval.
